HomeMy WebLinkAboutcc min 1952/02/13MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Wednesday, February 13, 1952 The City Council met in the Council Chamber on the above date at 7:00 P.M. with the following Councilmen present: Hobel, Riesland, Kidder, Logan. Absent: Councilman DeWolfe. Also Present: Administrative Officer Bryant, City Attorney Boyer, City Planner Wagner, City Engineer Floyd, Asst. City Engineer Wheeler. RESIGNATION OF COUNCILMAN KIDDER Councilman Kidder submitted his resignation to the Council in the form of a statement, as follows: "For almost nine years I have served as a member of the Chula Vista City Council. I have been proud of the opportunity to serve in this civic capacity. However, my service as a councilman has required me to devote literally thousands of hours to municipal problems at the sacrifice both of my family life and my occupation. Since the compensation of a councilman is extremely nominal, and since the wishes of my family have been that I retire from this position, I have indicated for several years that I would not again be a candidate for reelection when my present term in office expires in April, 1952. I have decided to, and do hereby, submit my resignation as a member of the Chula Vista City Council, effective immediately. My reasons for resigning these few weeks before my term would normally expire are these: My attorneys have advised me that the trial of the politically inspired charges against me would cost the taxpayers of this County several thousands of dollars and would result in considerable expense to me personally. I am confident that I would be completely vindicated by a hearing, but by the time this matter could be finally determined, my term of office would have expired and the expenditure of taxpayers, money and my own money would have been a waste. In view'of my long known intention not to seek reelection, this waste can be eliminated by my resigning at this time." It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the resignation be accepted, and that a vote of thanks be given Mr. Kidder for the loyal service which he has given to the City of Chula Vista. APPROVAL OF MINUTES - City Council It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the minutes of the Council meetings held January 81 22 and 28, 1952 be approved, copies having been mailed to the Councilmen. APPROVAL OF MINUTES - Planning Commission. It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the minutes of the Planning Commission meetings held January 21 and February 4, 1952, be approved, copies having been mailed to the Councilmen. ,\f OPENING OF GAS BIDS Administrative Officer Bryant opened and read bids from five oil companies. It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the bids be referred to the Purchasing Agent and Director of Public Works and the City Attorney for study and recommendation at the next meeting. V DRAINAGE PROBLEM - Mr. Augustus. Mr. Augustus appeared before the Council in regard to a drainage problem on his property which has arisen since the erection of the Flower Street School. City Engineer Floyd stated that by installing a large pipe across the land of Mr. Augustus, the situation could be relieved. Mr. Augustus was opposed to granting an easement for this purpose. It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the City Engineer make a further study of this situation for a recommendation at the next meeting. FIESTA DE LA LUNA - Walter Davis Mr. Davis requested permission from the Council to use the "F" St. ball park and the land opposite the City Hall for the forthcoming Fiesta de Is Luna, tentative dates for which are June 5, 6 and 7, or June 19, 20 and 210 1952. It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that permission be given to use the two pieces of ground for the Fiesta de la Luna. X PROTEST TO ORDINANCE No. 446 - Mr. Patterson Mr. Patterson appeared before the Council in regard to Ordinance No.446 which regulates the height of fences and hedges. He wished to protest the ordinance if it applied to wire or ornamental fences, which are 50 percent open. It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the Ordinance be referred to the City Attorney for an amendment excluding wire and ornamental fences which do not unduly obstruct vision. FINAL MAP - Kuebler Terrace No. 6 - Harold Foster. It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the final map and improvement plans of Kuebler Terrace #6 be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the performance thereof which contract and bond shall be first approved by the City Attorney as to form and legality. FINAL MAP - 'Wesley Park #2 - Harold Foster. It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the final map and improvement plans of Wesley Park #2 be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the performance thereof which contract and bond shall be first approved by the City Attorney as to form and legality, or upon the payment to the City in cash of the estimated costs of the improvements and execution of a contract to be approved by the City Council and the City of Chula Vista. \, FINAL MAP-Oagasta Terrace - Harold Foster It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the final map and improvement plans of Canasta Terrace be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the performance thereof which contract and bond shall be first approved by the City Attorney as to form and legality. < TENTATIVE MAP - Vista Real - Harold Foster It was moved by Councilman Riesland, seconded by Councilman Hobel, that any action by the Council be postponed until all the Councilmen are present. The motion was carried by the following vote, to -wit: AYES: Councilmen Riesland, Hobel NOES: Councilman Logan ABSENT: Councilman DeWolfe >"-TENTATIVE MAP - Loma Alta Park - Henry Algert It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the tentative map of Loma Alta Park, heretofore approved by the Planning Commission, be approved, subject to the City Engineers recommendation for the proper radius in the turn -around. -3 - RESOLUTION No. 1296 - Accepting Maintenance of Bay Blvd. East and West and a portion of Woodlawn Avenue. Offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote, to -wit: AYES: Councilmen Riesland, Logan, Hobel. NOES: None ,ABSENT: Councilman DeWolfe. ORDINANCE No. 448 - Amending Parking Meter Ordinance - Second Reading. It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the Ordinance be placed on its second reading. After the reading of the title, it was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the reading of the text be waived. The Ordinance was thereupon adopted by the following vote, to -crit: 4XES: Councilmen Riesland, Logan, Hobel. NOES: None ABSENT: Councilman DeWoi'fe. RESOLUTION No. 1297 - Accepting Easement to portion of Garrett Avenue Offered by Councilman Logan, read in full, passed, adopted and approved by the following vote, to -wit: AYES: Councilmen Logan, Hobel, Riesland NOES: None ABSENT: Councilman DeWolfe The City Clerk read a letter from Mrs. Janice Stewart, Librarian, requesting that Mrs. Keith Hall be appointed to fill the unexpired term of Mrs. Arthur Lynda. It was moved by Councilman Riesland, seconded by Council- man Logan, and carried, that the appointment of Mrs. Keith Hall to fill the unexpired term of Mrs. Arthur Lynda be approved. POLICE DEPARTMENT REQUEST A Chief of Police McCollum Chief of Police McCollum requested permission from the Council to send Detective Sergeant Woods to F.B.I. School in Washington, D.C. and pay his transportation costs, and that his salary continue for the 90 day period. It was moved by Councilman Hobel, seconded by Councilm a3 Logan, that Detective Sergeant Woods be sent to F.B.I. School, starting March 17, 1952, and that his transportation be paid and his salary continue for the 90 day period while there. The motion was carried by the following vote, to -wit - AYES: Councilmen Hobel, Logan, Riesland NOES: None ABSENT: Councilman DeWolfe PAY BILLS After exguination by the entire Council, it was moved by Councilman Hobel, seconded by Councilman Riesland, that Warrants Nos. 4489 to 4621 be approved for payment. The motion was carried by the following vote, to -wit: AYES: Councilmen Hobel, Riesland, Logan NOES: None ABSENT: Councilman DeWolfe. i DEPARTMENTAL INTERCHANGE OF BUDGET Administrative Officer Bryant requested that the Council authorize him to exchange ten thousand dollars within certain departmental accounts in the Budget, all such accounts being in the general fund of the City. It was recommended that Mr. Bryant set up the accounts for approval at the next meeting. '�LOYMENT OF LABORER City Engineer Floyd requested that the Council authorize the employment of a laborer to assist the Instrument Man in the Engineering Department. It was moved by Councilman Hobel, seconded by Councilman Riesland, that a Laborer be employed for the Engineering Department. -4 - VACANCY ON CITY COUNCIL It was moved by Councilman Riesland, seconded by Councilman Hobel, and carried unanimously, that Mr. Victor L. Wulff, Jr. be appointed to fill the unexpired term of Mr. Z. Dwight Kidder. RESOLUTION No. 1298 - Notice of Election, Consolidating Precincts and Appointing Election Officers for Regular Municipal Election April 8, 1952. Offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote, to -wit: AYES: Councilmen Riesland, Logan, Hobel. NOES: None ABSENT: Councilman DeWolfs ADJOURNMENT It was moved by Councilman Riesland, seconded by Councilman Logan, and carried, that the meeting adjourn to Wednesday, February 20, 1952.
