OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held Tuesday, May 20, 1952
The City Council met in the Council Chamber at City Hall on the above date at
7:00 P.M. with the following Councilmen present: Riesland, Hobel, Halferty, DeWolfe,
Logan. Absent: None.
Also Present: Finance Officer Grant, City Attorney Boyer, City Planner Wagner, City
Engineer Floyd.
REVIEW OF WAGE SCHEDULE - Civil Service Commission.
Mayor Riesland read a letter from the Chairman of the Civil Service Commission,
recommending a blanket salary raise of 10', to all employees in the classified service,
with certain changes in the Classification Plan. It was moved by Councilman Hobel,
seconded by Councilman Logan, and carried, that receipt of the letter of recommendation
be acknowledged, and that the letter will be used in a further study of the proposed
budget.
REPORT ON 1911 ACT - Sidewalks and Curbs.
City Attorney Boyer reported that there are two ways in which the City can take
advantage of the 1911 Improvement Act for curbs and sidewalks. 1). The whole City,
or a large portion of the City can be made into one district, which would necessitate
the hiring of outside engineers to make the study, and outside attorneys and assess-
ment specialists. Mr. Boyer recommended O'Melveny & Myers as competent attorneys.
2). If 50% of curbs and sidewalks are in on one side of a street, the City can demand
that the property owners in that block put in their own curbs and sidewalks. If the
property owners do not comply, the City can have the work done and assess the property
owners. Mr. Boyer reported that the attorney fees for procedure on above would be
approximately 2% of the contract price up to $300,000.00 and 1% for any portion of
the contract price over $300,000.00; that it is impractical for the City Attorney to
do the legal work for 1911 Improvement Act districts for the reason that the con-
tractor would secure and pay for the opinion of recognized bonding attorneys in any
case, and add the cost to the contract price. Mr. Boyer advised that he has not
discovered a case when procedure No. 2, above, had ever been used. The Council recom-
mended that City Engineer Floyd contact an engineer in San Diego who is making such
a survey at the present time, to give the City a rough estimate on what will be
needed for a similar survey in Chula Vista.
y APPRAISAL ON CITY DUMP PROPERTY - City Attorney Boyer.
Mr. Boyer reported to the Council that the appraisal, which Council authorized
Administrative Officer Bryant to have made was as follows: the land was appraised at
$800.00 per acre, 6/10 of which would be $500.00; severance damages, $1,300.00,
making a total of $1,800.00. The State Highway had offered $310.00.
f. IMPROVEMENT RECOMMENDATIONS
Councilman Halferty presented a letter to the Council containing the following
recommendations for improvements throughout the City:
Clean the drains protecting the playground on "F" Street so that the work will
not be nullified by water standing on the playground and then clean off the grass
and grade the area back of the present backstop for a small children's play area,
and provide rest rooms in the former school room for spastic children.
Scrape, grade and put in driveways on the area west of the Community Recreation
Building and put up a backstop for ball games. This can be a parking area for ac-
tivities in the Bowl and Recreation Center as well as a playground. The rest room
facilities for this area are already in the park. Flood lighting of this area is not
necessary at this time, but should be planned for as the flood lighting for the park
is considered.
Immediate abandonment of the City property on "H" Street, and moving the barns
to the gravel pit at the north end of Fifth Ave. Scrape, grade and put in a backstop

and other playground equipment. The Federal Government should put in curb and side-
walks in this area as it is the border of Federal Housing, and also fence the "H"
Street side.
Hire the re -grading of the gravel pit to change the direction of drain which
now dumps a great quantity of water on Eucalyptus Park. I say hire this done, be-
cause I believe it can be done much cheaper on contract than by trying to use City
crews and inadequate City equipment. Stock -pile all salvageable dirt or granite for
future use below the American Legion Building.
Mr. Halferty further stated that he believed the Council should consider the
above recommendations and act on them immediatelyi The Council recommended that
copies of Mr. Halferty's letter be given to the Recreation Commission for consideration,
and that they report their findings to the Council.
�__, REPORT ON ASSESSMENT METHODS USED IN OTHER CITIES.
Mr. Grant reported to the Council his findings on a study of the different
methods used by surrounding cities in obtaining their assessed valuations. This was
followed by a general discussion of ways to increase the City's revenue. It was
moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that a
Committee, comprised of the City Attorney; Walter Davis, Secretary, Chamber of Com-
merce, and Councilman DeWolfe, investigate City business licenses and bring back a
recommendation for the next regular meeting, June 10, 1952.
APPOINTMENT OF CITY ATTORNEY
It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried,
#hat the appointment be deferred until at least three applicants have been inter-
viewed, Mr. Boyer to continue to serve until an appointment has been made.
EXTENSION J.DEL MAR AVENUE - South of Seavale St.
Mr. Caldwell and Harold Foster appeared before the Council in regard to the
above-mentioned extension. It was recommended by Council that the City Attorney
contact Mr. Smith, property owner involved, with regard to his participating in the
installation of curbs, gutters and surfacing.
