OF THE CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday - November 25, 1952
The Council met in the Council Chamber at City Hall at 7:00 P.M.
on the above date with the following Councilmen present:
Riesland, Logan, DeWolfe, Halferty
Absent: Hobel
Also Present: Chief Administrative Officer Bryant, City Attorney Boyer,
City Engineer Floyd, City Planner Wagner and Assistant to
the City Engineer Wheeler.
THIRD AVENUE TRAFFIC REPORT
Chief McCollum reported that he now had 4 officers assigned to Third Ave.,
working shifts allowing 1 and 2 men on the street at all times. He stated there
would always be some conjestion, but felt sure the department could cope with it
this year with the men now available.
ROBERT WILSON
Congressman Wilson appeared before the Council and spoke briefly on his
hopes for the development of the South Bay Harbor and asked the Councilmen to
feel free to come to him with problems that come up in the future.
RESOLUTION NO. 1377 - Dedicating Whittington property for Casselman Street.
Offered by Councilman Halferty, read in full, passed, adopted and approved by
the following vote, to -wit -
AYES: Councilmen Riesland, Logan, DeWolfe, Halferty
NOES: None
ABSENT: Councilman Hobel
FUNDS AUTHORIZED FOR PURCHASE OF SIGNS
Administrative Officer Bryant asked the Council to appropriate $535.19
for the purchase of signs to control parking as outlined in Resolutions 1378 and
1379. It was moved by Councilman Logan, seconded by Councilman Halferty, that
1535.19 be appropriated from unappropriated surplus for the purchase of the signs.
The motion carried by the following vote, to-wit-
AYES- Councilmen Riesland, Logan, DeWolfe, Halferty.
NOES: None:
ABSENT: Councilman Hobel
RESOLUTION No. 1378 - Establishing two hour parking time zones.
Offered by Councilman Logan, read in full, passed, adopted and approved by the
following vote, to -wit:
AYES: Councilmen Riesland, Logan, DeWolfe, Halferty
NOES: None
ABSENT: Councilman Hobel.
RESOLUTION No. 1379 - Establishing one hour parking zone on "Em Street.
Offered'by Councilman Halferty, read in full, passed, adopted and approved by the
following vote, to -wit:
AYES: Councilmen Riesland, Logan, DeWolfe, Halferty
NOES: None
ABSENT: Councilman Hobel.
f- BUSINESS LICENSE DISCUSSION
Attorney Boyer stated that he had worked on the ordinance but wanted
to look into more stringent peddlers ordinances. Mr. Bryant suggested that
Mr. Boyer get a copy of the peddlers Ordinance for Santa Cruz, and pattern
ours after that one. Councilman DeWolfe suggested a committee heretofore
appointed to make a study and recommend a new license ordinance,be reactivated
so that a new ordinance could be forthcoming as soon as possible.
Mayor Riesland ordered the committee reactivated, and added Administra-
tive Officer Bryant, City Clerk Campbell, and businessman Joseph Carpineto to
the committee.
RESOLUTION NO. 1380 - Determing that the public interest and necessity demand
the acquisition of construction of a certain municipal
improvement, and making findings relating thereto.
Offered by Councilman Riesland, read in full, passed, adopted and approved by
the following vote, to -wit:
AYES: Councilmen Riesland, Logan, DeWolfe, Halferty
NOES: None
ABSENT: Councilman Hobel
ORDINANCE NO. 464 - An ordinance of the City of Chula Vista, California, order-
ing, calling, providing for, and giving notice of a special
election to be held in the City of Chula Vista on the 20th
day of January, 1953, for the purpose of submitting to the
qualified voters of said City a proposition to insur bonded
indebtedness by said City for a certain municipal improvement -
First reading.
It was moved by Councilman DeWolfe, seconded by Councilman Halferty, and
carried, that the ordinance be placed on its first reading. It wasthereupon
rea& in full.
ORDINANCE NO. 463 - Regulating the keeping of domestic fowls and animals -
First reading.
It was moved by Councilman Logan, seconded by Councilman DeWolfe, and carried,
that the ordinance be placed on its first reading. It was thereupon read in full.
ORDINANCE NO. 462 - Pertaining to the moving and relocation of buildings. Second
reading.
It was moved by Councilman Logan, seconded by Councilman DeWolfe, and carried,
that the ordinance be placed on its second reading. It was thereupon read in full.
It was moved by Colmcilman Halferty p seconded by Councilman DeWolfe, and
carried, that the last sentence of Section 4 which would require such houses over
10 years of age to be rewired be deleted from the ordinance. The proposed ordi-
nance, as changed, was thereupon placed on its first reading.
u TRAFFIC SURVEY REPORT FOR NATIONAL AVENUE
Administrative Officer Bryant read a report from Police Chief McCollum,
giving results of a recent traffic survey on National Ave, with a recommendation
that the present 25 mile per hour speed limit be retained. Letters were read from
the Chula Vista High School P.T.A., Mr. Rubie, Principal of Chula Vista Junior
High School, J. Rindone Jr., Principal of Chula Vista High School, Jack Davis,
Davis food center, and Mae Feaster, principal of Flower Street School, all re-
questing that the speed limit on Natiovi Avenue be retained at 25 miles per hour.
A delegation of National Ave. tusinessmens Assn. members, headed by
Lorenze Koester talked in favor of raising the speed limit to 35 miles per hour.
Mr. Koester said the association was vitally concerned over traffic safety and
believed the 25 mile limit is not eliminating accidents; the 25 mile limit is
impossible to enforce; and adequate crosswalks and public education were needed.
The association chiefly wanted reasonable laws passed with reasonable enforce-
ment. No engineering or traffic survey was presented by the proponents of a
25 mile limit.

Attorney Boyer stated the City had limited control over speed limits
as the subject was regulated by State law. However, the City, after making
a proper engineering and traffic survey and after determining that conditions
warrant a change in the speed limits may make a change as provided in Vehicle
Code Sec. 511.3. If the present survey on National Avenue indicates that a
continuation of the 25 mile limit is proper, the Council cannot legally change
to 35 miles without basing its determination upon a survey.
Councilman DeWolfe favored a 35 mile speed limit on most of National
Avenue with a slow down to 25 miles for two or three blocks in the more heavily
built up section.
Councilman Logan thought the matter should be tabled for a month or two
in order to see what problems might arise after new subdivisions under con-
struction on the west side of National Avenue are completed.
Councilman Halferty thought the logical speed limit was 35 miles, with
constant patrol.
Mayor Rissland suggested a new survey be made with the thought of using
both the 25 mile and 35 mile limits as suggested by Councilman DeWolfe. He
thereupon appointed Councilman DeWolfe, Chief McCollum and Lorenze Koester to
make the survey and report back at the next regular meeting.

TIJUANA RIVER WATER
Attorney Boyer presented a request from DeWitt Higgs, attorney for
the California Water and Telephone Company, asking that the City sign a joint
letter with National City and San Diego International Boundary and Water
Commission asking that immediate action be taken to apportion equitably the
waters of the Tijuana River between United States of America and Mexico. It
was moved by Councilman DeWolfe, seconded by Councilman Halferty, and carried,
thaE'the Mayor be authorized to sign the letter as requested.
CANCELLATION OF TAXES
It was moved by Councilman DeWolfe, seconded by Councilman Logan, and
carried, that the taxes on Parcel 27-130-1 in the amount of $5.33 be cancelled,
this property having been dedicated for street parposes. Also that the taxes
on parcels 27-30-28 and 29 in the amount of $117.13 be cancelled, these two
parcels having been purchased by the City for pakking lots:
RESIGNATION OF GEORGE CORNELL - Civil service commission.
A letter was read from Mr. George Cornell tendering his resignation from
the Civil Service Commission. It was moved by Councilman Riesland, seconded by
Councilman Logan, and carried, that the resignation be accepted with regret, and
that a letter of appreciation be sent to Mr. Cornell.
APPOINTMENT OF RICHARD HIGGS - Civil Service Commission
A letter was read from the Employe as Association, submitting the names
of Charles B. Dum II, Richard A. Higgs, and Harry Williams, from which the
Council is to pick one to fill the vacancy of George Cornell. It was moved by
Councilman DeWolfe, seconded by Councilman Logan and carried, that Richard Higgs
be appointed to fill the vacancy of George Cornell on the Civil Service Commission.
TREE RECOMPIENDATIONS FOR CITY STREETS
Administrative Officer Bryant read a letter from the Junior Women's Club
asking the Council's approval of their.gl8nned drive to have citizens plant either
Goldenrain trees or Korean Ash in their packings. The Council unanimously agreed
to the project.

Y' FRENCH LAUNDRY SUIT
Attorney Boyer stated that the statute of limitations may prevent the
City from sueing for the 1950 license and penalty of the Original French
Laundry Co., also that the City may not be legally entitled to file a civil
suit to collect a license tax unless the ordinance specifically so provides.
The attorney for the Ja=dry company reported they would be willing to settle
the balance claimed by the City on the basis of 50¢ on the dollar. Attorney
Boyer recommended that the City accept the offer. It was moved by Councilman De -
Wolfe, seconded by Councilman Halferty, and carried, that the City accept the
sum of $87.50 in settlement of the 1950 business license.
RESOLUTION No. 1381 - Approving compromise agreement with California Water and
Telephone Company.
Offered by Councilman Halferty, read in full, passed, adopted, and approved by
the following vote, to -wit:
AYES: Councilman Riesland, Logan, DeWolfe, Halferty
NOES: None
ABSENT: Councilman Hobel
ADJOURNMENT
It was moved by Councilman DeWolfe, seconded by Councilman Logan, and
carried, that the meeting adjourn to December 2, 1952 at 7:00 P.M.
