OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held Tuesday - December 16, 1952
The Council met in the Council Chamber at City Hall at 7:00 P.M on
the above date, with the following Councilmen present:
Councilmen Riesland, Logan, DeWolfe, Halferty
Absent: Councilman Hobel
Also presents Chief Administrative Officer Bryant, City Attorney Boyer,
City Engineer Floyd, Assistant to the City Engineer Wheeler,
City Planner Wagner
INTRODUCTION OF REAR ADMIRAL RAY TARBUCK
Admiral Tarbuck of Coronado, nominee for membership on the new County
Board of Health, was introduced to the Council. He spoke briefly on his experience
and qualifications and felt that, being retired, he would have as much time to
devote as anyone to the office. He thus offered his services if the Council saw fit.
DRAINAGE REPORT - Roosevelt and Fourth Avenue
City Engineer Floyd recommended the catch basins be enlarged at Fourth
Avenue and Roosevelt Street, and that the 15 inch culvert across the street be
replaced with 18 inch culvert, with a 24 inch pipe from the west basin to the
property line. Extimated cost $450.00 plus labor. However, Major Floyd stated
it would be a waste of money for the City unless Mr. Love, whose property is
involved in the drainage problem, puts curb and gutter in front of his property to
keep the mud and debris out of the catch basins.
It was moved by Councilman DeWolfe, seconded by Councilman Halferty,
and carried, that Chief Administrative Officer Bryant be instructed to notify
Mr. Love as to the findings of the City Engineer, as presented to the Council, and
see if he is willing to cooperate with the City by installing curb and gutter, and
removing the present wooden catch basin on his property, as long as the City is
willing to spend $450.00 plus labor, to correct the problem.
,REPORT ON DALEY MINIATURE GOLF COURSE MATTER
City Engineer Floyd reported he had talked with Mr. Daley, and was
informed that he inters to move that portion of his golf course extending onto
the City right-of-way just as soon as dry weather permits him to get in with the
necessary equipment, or he would be willing to pay the City if they desired to do
the work. City Engineer Floyd thought it not wise to take City equipment off
urgent work to do this job. It was suggested that Chief Administrative Officer
Bryant write Mr. Hazard, with a copy to Mr. Daley, informing him that Mr. Daley
has every intention of clearing the waterway as soon as conditions permit.
- DISCUSSION - Motor Vehicle Department and Post Office Building Site
After general discussion on possible locations for proposed Department
of Motor Vehicle and Post Office buildings on the Civic Center site, it was decided
to have the Planning Commission present an over-all plan for locating future
buildings on the Civic Center grounds at a later meeting.
Chief Administrative Officer Bryant asked permission to investigate a
plan to make off-street parking space for Library employees on Library grounds.
(,- TWO HOUR PARKING LIMIT CONTROVERSY
Walter Sullivan, 244-A Garrett Avenue presented a petition by property
owners and tenants living on Garrett Avenue between E. Street and F. Street who
were opposed to the two hour parking on Garrett Avenue. Walter Gibbs, 244 Garrett
Avenue and one of the signers of the petition, thought the merchants should furnish
their own parking lots, and get their own cars off the streets.
Roy Acuna, 202 Del Mar Avenue opposed the two hour parking on Del Mar
Avenue on grounds it was residential property and not needed at this time.
A letter was read from Joseph Meditz, favoring the two hour parking
on Church Avenue. Mrs. Daisy Bigelow and Mr. McCoy spoke in favor of the two
hour parking on Church Avenue in that they were able to park in front of their
places for the first time in years.
Councilman DeWolfe stated that after studying the situation, it was his
opinion that Garrett Avenue was not getting the use that was anticipated, and
moved that due to the fact that Garrett was still in residential zone and shoppers
were showing no interest in parking there, that the two hour parking limit be
eliminated on Garrett Avenue immediately after Christmas, except for 1110 feet South
of E. Street and 290 feet North of F. Street, which area is within the commercial
zone. The motion was seconded by Councilman Logan, and unanimously carried.
X, DISCUSSION - Easement for California Water & Telephone Co. on First Avenue
City Attorney Boyer stated the California Water & Telephone Co. was
requesting a pipe line easement on First Avenue by the Rosebank School similar to
the one given on E. Street between National Avenue and Bay Boulevard. City Attorney
Boyer sea of the opinion that the City should establish a policy that easements in
public streets for public utilities not be granted, and that the Company be required
to obtain a franchise for use of the public streets if further rights than those
that may be granted by the old Kimball Deed are thought necessary by the Utility
Company.
It was suggested that the matter be layed over until a later date for
further consideration.
SOUTH BAY IRRIGATION DISTRICT RESOLUTION No. 23
Resolution No. 23 of the South Bay Irrigation District requesting the
California Water and Telephone Company to extend service area to boundaries of
South Bay Irrigation District, and to eliminate restrictions on use of water within
area, was read to the Council with a request for its endorsement by the Council.
It was moved by Councilman DeWolfe, seconded by Councilman Halferty, and
!carried, that the City Attorney prepare a Resolution of Endorsement.
APPLICATION FOR REMOVAL OF OLD RULE No. 2 - California Water & Telephone Co.
City Attorney Boyer reported that the California Nater & Telephone Co.
was applying to the Public Utilities Oo*mission for permission to remove old Rule
No. 2, whichzestricted service to additional agricultural land within the Sweetwater
District. It was Mr. Boyers opinion that the rule should be rescinded and the
City should do everything necessary to cooperate with the Company to have the
application granted.
It was moved by Councilman DeWol.fe, seconded by Councilman Logan, and
carried, that City Attorney Boyer be authorized to take steps to see that the
application is granted without delay, as far as the City is concerned.
SAFEWAY STORES, INC. - Request for dedication of Church Avenue
Mr. Frank Frye, representing Safeway Stores, said they will improve and
dgdicate 2W feet extention of the present Church Avenue, if the City will accept it.
Safeway Stores, Inc. and Mr. Francis Smith, owner of property East of Safeway to
share the cost fifty-fifty, with the entire street being paved and sidewalks and
curbs on the Safeway side being installed immediately. Mr. Smith would be given a
year to put curbs and sidewalks on his side, due to undecided future development
of his property.
City Planner Wagner stated it was the recommendation of the Planning
Commission that the City accept the dedication.
It was moved by Councilman Logan, seconded by Councilman Halferty, and
carried, that the City accept the dedication when the street is fully i*proved, or
when the owners execute a contract secured with cash or bond guaranteeing improvements.
ORDINANCE No. 1165 - Relating to the planting and removal of trees upon Public
Streets - First reading
It was moved by Councilman Logan, seconded by Councilman Halferty, and
passed, that the Ordinance be placed on its first reading. It was thereupon
read in full.
After discussion it was moved by Councilman Halferty, seconded by
Councilman DeWolfe, and carried, that the City Attorney be instructed to condense
the Ordinance, and bring it back at a later meeting.
ORDINANCE No. 166 - Establishing spded limit of 35 miles on National Avenue
and E. Street.
It was moved by Councilman DeWolfe, seconded by Councilman Halferty,
and carried, that the Ordinance be placed on its first reading. It was thereupon
read in full.
ANIMATED SIGN TO PARKING IAT
Councilman DeWolfe proposed that the City Engineer check prices for the
installation of an animated sign directing traffic to the City Parking Lot.
Walter Davis, Manager of the Chamber of Commerce, presented a proposed
sign estimated to cost $500.00.
It was suggested that smaller signs at less cost be designed and submitted
at the next meeting.
_REQUEST FOR PLUMBING INSPECTOR
Chief Administrative Officer Bryant asked authorization to set up an
appropriation in order to proceed with an examination for an additional Inspector.
The Inspector would work under the Building Inspector, with plumbing option,
at a starting salary of $378.00 per month.
It was moved by Councilman DeWolfe, seconded by Councilman Halferty,
and carried, that Chief Administrative Officer Bryant be authorized to proceed
with setting up the appropriation for an additional Inspector with plumbing option.
AUTHORIZATION OF JUNIOR CLERK FOR FINANCE OFFICE
Chief Administrative Officer Bryant asked that he be authorized to hire a
Junior Clerk for the Finance Office, due to the increased work load. It was
moved by Councilman Logan, seconded by Councilman Halferty, and carried, that Chief
Administrative Officer Bryant be authorized to hire a Junior Clerk for the Finance Dept.
ADJOURNMENT It was moved by Councilman Logan, seconded by Councilman DeWolfe,
and carried, that the meeting adjourn sine -die.
