N. on the above date, with the following Councilmen present: Councilmen Riesland, Hobel, Halferty Absent: Councilmen Logan, DeWolfe Also present: Chief Administrative Officer Bryant, City Attorney Boyer, City Engineer Floyd, Assistant to the City Engineer Wheeler and City Planner Wagner APPROVAL OF MINUTES - City Council It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the ~.~inutes of the meetings held January 13, 21 and 27 be approved, copies having been mailed to each Councilman. APPROVAL OF MINUTES - Planning Commission It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that the Minutes of the Planning Commission meeting for January 19 be approved, copies having been mailed to each Councilm~n. Y~CONSID~ATiON OF PROPOSED REFUSE COLLECTION CONTRACT A proposed refuse collection contract between the City and the Chula Vista Sanitary Service was read in full to the Council. A letter from Sam Kazarian, in the form of an application for a Franchise with the City for the collection of refuse, was read to the Council. It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried that the matter be set aside until the next regular meeting, in order to give the Council an opportunity to study the proposals. ~/PEPPER TREE LANE TRACT NO. 2 - Tentative map It was moved by Councilm~n Halferty, seconded by Councilman Hobel, and carried, that the tentative Map of Pepper Tree Lane Tract No. 2, heretofore approved by the Planning Commission, be approved subject to improvements required by Section ? of the Subdivision Ordinance, and that a one foot lot along the East side of Madison Avenue be deeded to the City; that curb returns be made with a greater radius at each corner; that all setbacks on Kearney be considered as side yards; that tangents be placed on reverse curbs, and setbacks on "K" and "J" Streets be considered side yard setbacks. COUNTRY CLUB VISTA - Final map It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the final map and improvement plans of Country Club Vista Subdivision be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the performance thereof, which contract and bond shall be first approved by the City Attorney as to form and legality. Also that the name "Country Club Vista" be retained instead of "Country Club Villas No. 2" as suggested at a previous meeting. ~KUEBLER TERRACE No. 9 - Tentative map It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that the tentative map of Kuebler Terrace No. 9 heretofore approved by the Planning Commission, be approved, subject to improvements required by Section 7 of the Subdivision Ordinance, and that Cypress Street go through to ~not; 20 foot setbacks on First Avenue only if that is the setback approved for the Uecker Subdivision to the North; and 20 foot setbacks on "~', "F", and First Avenue. KUEBLER TERRACE No. 8 - Final Map It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that the final map and improvement plans of Kuebler Terrace No. 8 be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a Bond guaranteeing the performance thereof which contract and bond shall be first approved by the City Attorney as to form and legality. Also subject to the City Engineers' final check, and that the cost of rearranging curbs of the cul-de-sac be borne by the Subdivider of the property to the North. RESOLUTION No. 1402 - Approving Improvement Contract for Kuebler Terrace No. 8 Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes: None Absent: Councilmen Logan, DeNolfe ~'~'~VERDE PARK No. 5 - Final map It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the final map and improvement plans of Verde Park No. 2 be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guarantee- io~ the performance thereof, which contract and bond shall be first approved by the City Attorney as to form and legality, and with said improvements subject to the final approval of the City Engineer. RESOLUTION No. 1403 - Approving improvement contract for Verde Park No. 5 Offered by Councilm=n Riesland, read in full, passed, adopted and approved by the following vote to~it: AYES: Councilmen Riesland, Hobel, Halferty Noes: None Absent: Councilmen Logan, DeWolfe CHULA VISTA ~ANOR - Final map It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the final map and improvement plans of Chula Vista Manor be accepted upon the execution by the owner of a contract with the City of Chula Vista for the i~tallation of improvements and the posting of a bond guaranteeing the performance thereof, which contract and bond shall be first approved by the City Attorney as to form and legality. Also subject to final check by the City Engineer, and with the provision that Parcel A be deeded in fee simple to the City. RESOLUTION No. 1404- Approving improvement contract for Chula Vista Manor Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes: None Absent: Councilmen Logan, De~folfe TELEPHONE RATE RAISE - City Attorney Boyer City Attorney Boyer inquired of the Council if the City were interested in joining with other cities in opposing the proposed telephone rate raise now pending before the Utilities Commission. Glendale is organizing the protest and would like to know the feelings of the other cities on the matter. City Attorney Boyer was of the opinion it would be well for the City to join in the protest, if the City and County of San Diego plan to participate. It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that City Attorney Boyer write the proper authorities in the City of Glendale to the effect that the City of Chula Vista is interested in participating in the joint effort. RESOLUTION No. 1405 - California ~,~;ater & Telephone Co. Easement on First Avenue City Attorney Boyer stated that the California ¥~ater & Telephone Co. was of the opinion that in its settlement of the E. Street-First Avenue pipeline re~ocation matter, November ll, 1952, on a compromise fifty cents on the dollar basis, it was on condition an easement in First Avenue was to be granted. City Attorney thought it only right that the easement be granted, and that it might prove a good precedent to show that we have granted them an easement at their request, and an implied admission by the Company that the general easement contained in the "Kimball 'Deed" was subject to limitations. It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the easement be granted. RESOLUTION No. 1405 - California Water & Telephone Co. Easement on First Avenue Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes: None Absent: Councilmen Logan, De-t~olfe RESOLUTION No. 1406 - Dedicating Lot D of Kenwood Village as portion of Fig Avenue Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes: None Absent: Councilmen Logan, DeWolfe RESOLbTION No. 1407 - Authorizing investment of Surplus Funds Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes None Absent: Councilmen Logan, DeWolfe ORDINANCE No. 4?0 - Imposing a fee for inspection of public works in new subdivisions - first reading It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the Ordinance be placed on its first reading. It was thereupon read in full~ ORDINANCE No. 465 - Relating to planting of trees on City Streets - 2nd reading It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that the Ordinance be placed on its 2nd reading. After the reading of the Title, it was moved by Councilman Halferty, seconded by CounciLman Hobel, and carried, that the reading of the text be waived. The Ordinance was thereupon adopted by the following vote, to-wit: AYES: Councilmen Halferty, Riesland, Hobel Noes: Ngne Absent: Councilmen Logan, DeWolfe ORDINANCE No. 469 - Fixing time and place for Council meetings-2nd reading It was moved by Councilman Halferty, seconded by Councilman Hobel, and carried, that the second reading be 4eferred until later when a full Council is present. /oCJDR~ESPO~DENCE A letter was read from J. H. Tompkins, Realtor, ffering the City industrial property at the foot of F. Street for $16,500.00 It was moved by Councilman Hobel, seconded by Councd]m~n ~eland, and carried, that the letter be tabled. A letter was read from the library board requesting ~an appropriation to make a study looking toward the location and construction of a new library. ~ LIBPJ~RY COMMITTEE It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the Mayor appoint a Library Committee to investigate the possibilities of enlarging, improving, or building a new Library, and to consult with the City planner ~agner on the views of the Planning Commission as to a suitable site. Mayor Riesland appointed Councilman Halferty and Councilman Logan to the Library Comma ttee. RESOLUTION No. 1408 - Authorizing Quit-Claim Deed to Budd Gregg for Lot 57 - Rosebank Subdivision. Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Hobel, Halferty, Riesland Noes None Absent: Councilmen Logan, FREEZING OF FURTHER CONSTRUCTION in 1911 Act District City Engineer Floyd read a letter from 0,Melveny & Nyers, in answer to his request for their recommendation concerning the discontinuance of construction by said property owners during the pendency of the 1911 Act proceedings. O~Nelveny & Myers recommend that the Council "freeze" the status of the improvements by refusing to issue further permits to property owners. It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that effective immediately, no further permits be issued for construction of sidewalks, curbs and gutters in the confines of the 1911 Act District. DISCUSSION - Trailer Parks License Councilman Halferty asked why Littlejohn& Wesselink were granted a use variance, when they were unable to pass health inspection on their establishment in the county. City planner ~¥agner explained that the Trailer Ordinance does not allow the Planning Commission to turn down an applicant on past performance. The applicant is checked at the time he takes out his business license, as the Trailer Park must pass inspection before it is issued. 4'~EGULATION OF DISTRIBUTION OF RELIGIOUS LITERATURE Councilman Halferty asked if there was no way of curbing the number of people selling religious tracts on the streets and inconveniencing people by constantly soliciting at the door° City Attorney Boyer stated such matters could not be licenses or prohibited so long as there was no violation of law or breach of the peace. Councilman Halferty suggested that City Attorney Boyer look into the matter to see if something can't be done to limit the number of people distributing religious tracts on the street, and report back. 6~VE~RANS OF FOREIGN WARS Project City Engineer Floyd reported that the Veterans of Foreign Wars have found clips that will fit on the parking meters for their downtown Flag project. Two clips cost $2.70, as compared to $2.00 for the ground socket proposed originally. It was the VFW desire to use the clips, if the City would pay the 705 difference in price. It was suggested by Council.mu Halferty that the Veterans of Foreign ~ars buy the brackets, and charge the 70~ to merchants participating in the project. ~AMBULANCE SERVICE It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that Chief Administrative Officer Bryant investigate the possibility of having a private ambulance service in the City, or City owned ambulance service, and report back. ~AUTHORIZATION TO PAY CIVIL DEFENSE WIRING BILL Chief Administrative Officer Bryant asked authority to pay ,50.00 to Chula Vista Electric Company for installing additional relay to enable fire station to bring in all sirens. It was moved by Councilman Hobel, seconded by Counc~]m~n Halferty, and passed, that Chief Administrative Bryant be authorized to pay the $50.00 from unappropriated surplus. SCHEDULING OF PARK BOWL BUILDING A letter was read from John Lewis, Direstor of Recreation, asking clarification as to w~o is to be in charge of scheduling the Bowl Building. After discussion, it was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the Park Superintendent be authorized to schedule the building. PAYMENT OF BILLS After examination by the entire Council, it was moved by Counci]m-n Hobel, seconded by Counci]m~n Halferty, and carried, that Warrants No. 6096 through No. 6269, be approved for payment.
