The Council met in the Council Chamber at City Hall at 7:00 P.M. on the above date with the following Councilmen present: Present -DeWolfe, Riesland, Halferty Absent - Logan, Hobel Also Present: Chief Administrative Officer Bryant, City Attorney Boyer, City Engineer Floyd and City Planner Wagner APPROVAL OF MINUTES - City Council It was moved by Councilm-n Halferty, seconded by Councilman Riesland, and carried, that the minutes of the Council meetings held April 14, 24 a~ 28 be approved, with the ad- dition to the minutes of April 24 that Clayton Bullen appeared before the Council as consultant on the Civil Defense discussion regarding the purchase of radio transmitter receiver sets. Copies of the minutes were sent to each Councilman. APPROVAL OF MINUTES - Planning Commission It was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that the minutes of the Planning Commt ~sion meetings held April 6 and 20 and May 4 be approved, copies having been mailed to each Counci]man. ORDINANCE No. 473 - Prohibiting Filing False Crime Reports with the Police Dept. - Second reading and adoption. It was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that Ordinance No. 473 be placed on its second reading. After the reading of the title, it was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that the reading of the text be waived. The Ordinance was thereupon adopted by the following vote, to-wit: AYES: Councilmen Riesland, Halferty, DeWolfe NOES: None Absent: Councilmen Hobel, Logan RESOLUTION No. ]J~32 - Rejecting claim of George Munoz Offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Riesland, Halferty, DeWolfe NOES: None Absent: Councilmen Hobel, Logan ~/~ENT DECONTROL DISCUSSION City Attorney Boyer asked if the Council wished to postpone action on rent decontrol until after July 31, at which time rents might be decontrolled under the new rent control law. He stated that all units built in 1947 and after had been decontrolled. He further re- commended that the Council obtain the services of some groups, such as Chamber of Commeroe, Realty Board and Apartment House Owners Ass,n., to make a study of the rental situation so that the Council would have facts on which to base their action. It was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that action on rent decontrol be postponed until after July 31, and that the National City a~ Chula Vista Realty Board and Apartment House Owners Ass'n. be requested to make a study of the rental situation to guide the Council for any action taken after July 31, 1953. ~/iNTERMFDIATE CLERK AUTHORIZED FOR POLICE DEPARTMENT An intermediate clerk for the Police Department was authorized some time ago but was in- advertently omitted from the minutes of the meeting. In order to have an official record, it was moved by Councilman Halferty, seconded by Councilman Riesland, and carried, that an intermediate clerk be authorized for the Police Department. -2- PL~MBING ORDINANCE It was decided to postpone the reading of the proposed plumbing Ordinance until further study had been given to it and that Hal Johnson and Emerson Logan, local plumbers, be requested to study the Ordinance and present their recommendations. 4/~PUBLIC NEARING ~ SHAPOV ZONE VARIANCE APPEAL - Date set It was moved by Councilman Riesland, seconded by Councilm~n Halferty, and carried, that June 9, 1953, at 7:00 P.M. be the time for the public hearing on the Shapov Zone variance appeal. PAYMENT OF BILLS After examination by the entire Council, it was moved by Councilman Halferty, seconded by Councilman Riesland, and carried, that Warrants' No. 6523 to 6635 be approved for payment~ The motion carried by the following vote, to-wit~ AYES: Councilmen Riesland, Halferty, De~olfe NOES: None Absent: Councilmen Logan and Hobel AUTHORIZATION OF TRAFFIC LIGHTS: E STP~ET AND THIRD AVENUE ~XT~NSION WIDENING City ~ngineer Floyd gave a report on the recent traffic survey at the intersections of Third and I, J and K Streets and asked that the Council indicate at which intersections they desired traffic signals, so that he might execute the agreement with the Division of Highways for use of gas tax funds. After lengthy discussion, it was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that traffic lights be authorized at the intersections of Third Avenue and G, H, J and K Streets and also at the intersections of National and J and K Streets, In further discussion on gas tax funds it was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that the engineers estimate of $22,000 for the widen- ing of Third Avenue ~tension be approved. Also that the City Engineer work up an estimate for the widening of E Street from Third Avenue to Fourth Avenue and submit I~ for approval to the Division of Highways for expenditure from the 1953-54 gas tax allocation. PUBLIC HEARING - Safeway zone variance appeal - 7:30 o'clock P.M. This being the time and place as advertised for the public hearing on the Safeway Zone variance, Mayor Pro-tom DeWolfe asked City Planner %Vagner to read the application for the variance as submitted to the Planning Commission by Safeway Stores and also the report from the Planning Commission setting forth reasons in support of their decision to grant the variance. After the reading of the application and report, Attorney DeWitt Higgs, representing the firm of Johnson, Tyson and L~nds, and John Williams, who filed the only appeal to the Planning Commission decision, gave in detail the reasons for the appeal as con- tained in the written appeal on file, and asked the Council to refer the matter back to the Planning Commission. Mr. Robert Tyson also spoke on behalf of the appeal. Mrs. Francis Smith, owner of the property involved, stated she joined with Safeway in the application for the zone variance and gave her reasons why the decision of the planning Commission should be upheld. Attorney Fry, representing Safeway Stores, stated final action should wait until a case now before the Superior Court, quieting title to the land involved, is settled. If title was not quieted it would not be ne- cessary to go ahead with the zone variance request. It was moved by Councilman Riesland, seconded by Councilman Halferty, and carried, that the public hearing be continued to June 9, 1953, at 7:00 p.m. ~/SPR~D ZONE SIGNS AUTHORIZED City Engineer Floyd reported that the five speed zone signs as requested by the Council would cost a total of $90.00. The signs are to be erected one at either end of Third Avenue ~t the City limits, one at either end of National Avenue at the City limits and one on Bonita Road at the City limits. It was moved by Councilman Halferty, seconded by Councilman Riesland, that the five signs be purchased and installed. The motion carried by the following vote, to-wit: AYES: Councilmen Riesland, Halferty, DeWolfe NOES: None Absent: Councilmen Logan, Itobel ~REQUEST FOR TAXI STAND CHANGE A letter was read from T. B. Thomas, Yellow Cab Company, requesting he be given per- mission to change his taxi stand from in front of Guilbert's Pharmacy to one in front of the Morrin and Underwood Office on Third Avenue. Also that stands be permitted in front of the Flamingo Cafe and Hal's Shell Service on National Avenue. It was moved by Councilman Riesland, seconded by Councilman Halfarty, and carried, that the change on Third Avenue be granted, with Mr. Thomas psying any expense to the City involved in the change, and that the request for spaces on National Avenue be denied. JOINT ~EETING OF NATIONAL CITY AND CHULA VISTA PLA~ING CO~ISSIONS City Planner Wagner stated that the National City and Chula Vista Planning Commissions were holding a Joint meeting Monday, May 18, at ?:30 P.M. at the Chula Vista Council Chambers to discuss highway problems, Harbor planning and a Joint recreation program for the tidelands between the cities. City planner Wagner stated that members of both Councils were invited and urged to attend. 4~REQuF~T TO LEAVE STATE Councilman Riesland requested permission to leave the State from ~!ay 17 through June 1, 1953. It was moved by Councilman Halferty, seconded by Councilman DeWolfe, and carried, that Councilman Riesland be granted permission to leave the State, as reqUested.
