~.~ SECOND PAYMENT AUTHORIZED IN ROHR TAX ILKPAYIfKNT SUIT
It was moved by Councilman Smith, seconded by Councilman bGraaf and
carried, that ~50,655.33 he appropriated from the unappropriated surplus
of the General Fund for the second payment to Rohr Aircraft Corp. on the
Jud&~tent in Superior Court Case Mo. 300839-Rohr vs City of Chula viers,
repayment of back taxes includinE principal, lntereet, and proportionate
share of costs. The motion carried by the foil.winE votes to-wit:

APPEAL TO ACTION IN PLANNING COMMISSION DECISION IN DENYING FENCE
" HEIGHT VARIANCE
A letter was read from Walter Norek and Duke Novak, 245 Oneida Street
appealinK the action of the PlanninE Commission in denyinK them a.heiKht
variance for s fence from 3'6" to 6'. Also read was the report of find-
inks from the PlanninE Commission. February 14th at 7:00 P.M. woe the
time set for a public hearinN on the appeal.
PEOPOSKD V~CATION OF PORTION OF FIFTH AVENUE SOUTH OF "H" STREET
A letter wae read from the PlanninK Commiesion reEardinK the request
of Mr. John Keeley for vacation of a portion of Fifth Avenue 8outh of "H"
8treeS. The P1tnninE Commission recommended that no portion of Fifth
Avenue be vacated until the ri,ha-of-way width needed to serve Broadway-
Hale is established. No Council action taken.
/~'FINANCIALRKPORT
City FSnnnce Officer Grant, in reportinE on the financial condition
of the City for the firet six months of the fiscal year, revealed that
revenuee were down approximately 5~ of the amount anticipated. In view
of this information departmental budEets have been reduced by the City
Administrator by 5 to 6 percent.
DISCUSSION ON PAVING OF EAST "I" STREET FROM HILLTOP TO CLAIRE AVENUE
City Administrator Fulwiler stated that property owners on the North
side of Smsa "I" Street between Hilltop Drive and Claire Avenue had
dedicated 10j foot of land for street purposes which they were willinK to
improve, but did not wish to improve the center 8 feet which was not
improved at the time Claire Vista Subdivision was developed. City
Administrator Fulwller asked Councils' opinion on City participation in
the project. The Council expressed approval of the City improvin~ the
8 foot center strip if the property owners improved the North 10~ feet.
ARDING BID ON THIRD AVENUE STORE DRAIN
Principal Civil Engineer Harahman reported having received six bids
on the proposed Third Avenue storm drain at Parkway, the low bid being
that of the Pace Construction Co. in the amount of $25,831.50 for the
bane bid and ~8,550.80 for Alternate "A". Base bid includes a new
concrete'pipe culvert paralleling the tvs existing culverts and Alternate
"A" includes construction of a box culvert with removal and salvage of
two existing culverts.
It vas ms, ed by Councilman icEnina, seconded by Councilman Menzel and
carried, that the low alternate "A"bid of pace Construction Co. be accepted
and thSt ~24,000 bo appropriated from the reserve for Capital development
of the General Fund and $4,550.S0 from the culvert account of the General
Fund for payment to pace Construction Co.
The motion carried by the following vote, to-wit:

City Administrator Fulwiler reported having received a request from
Ams Arnold of Arnold's Garage to enter into a contract with the City for
lease of three undeveloped parking spaces at the rear of the City parking
lot at Landis Ave. and Center St. City Administrator Fulwiler vas
requested to finish developing the three lots for use as additional
municipal parking.
/RBQU~.ST'FOR SEWBItLINE
Letters were road from the Signal Oil Company and Chula ViSta Realty
Inc. requesting that the City install sewer from Riverlawn Ave. up "L"
Street on a repayment basis for any property owner who does not participate
in the improvement at this time. The Engineering Department was directed
to bring back at the next meeting, bid figures that have been received
on this project.
t //REQUEST F~ ADDITIONAL TAXICAB STAND
A letter was read from the Martin Cab Co. requesting an additional
taxicab stand at 2S4 Center St. immediately in front of the one now in uae.
The City Administrator stated he would have the Chief of Police study the
request. Councilman 8mith asked that an investigation be made to 8es
i.~.the City can legally rent these spaces to the Cab Company.
MOOSE LODGE SAFETY SIGNS
A letter was read from the Planning Commission recommending that the
requemt of 'the Moose Lodge to construct safety signs on public right-of-
ways near schools be denied. No action taken by the gouncil.
~//H~Q..~UEST FOE.ANAPPROPRIATION TOWARD I~gTAININGRATE EXPERT
City Attorney Kugler recommended that the Council appropriate an amount
not to exceed $750 toward retaining a rate expert to review the rate
increase application of the Hah Diego Gan & Electric Company and to testify
at the hearings before the PUC. The final amount to be congributed by
the City within the maximum~ is to be a pro-rata share, in accordance w~h
the populatio~in relationship to all the other cities which agree to
retain this export.
It was moved by Councilman Smith, seconded by Councilman DeGraaf and
carried that the City Attorney proceed with, negotiations.in the manner
in which he recommended for the hiring of a rate export.
~/ff~QUEST FOR SEWER LINE
Hrs. Hazel Chiodo owner of property at 32 "J" Street Place stated
that she and three other property owners were ready to install sewer in
the street, but a fourth property owner did not wish to participate at
this time. Mrs. Chiodo azked if the City Wwould pay the cost of the sewer
for the one'property on a repayment basis in order that the sewer could be
installed. The request was referred to the City Adminiztrator for consult-
ation with the City Engineer and report to the Council.
Councilman Nenzel reported there was start of a new dumping ground
across the street from 210 E. Katerzon St,~ and azked if "No Dumping" signs
could be posted. Administrative Officer Fulwiler stated he would have

DISCUSSION ON U~TROPOLITAN SEWER
Administrative Analyst Ross gave a resume of studies made to date of
capacity reservations and financing of the proposed Metropolitan Sewer
System as it would affect Chula Vista. E.W.Blom, Assistant City Manager
of San Diego and A1 Firestone, Assistant City Attorney of San Diego were
present to answer any questions Councilmen might have on the Metropolitan
Sewer. Each Councilman was given an amended copy of the proposed sewage
disposal agreement with San Diego, the amendments of which were reviewed
by Attorney Firestone. Mr. Blom and lir. Firestone were both of the
opinion it would be difficult to lay out a boundary for each participat-
ing agency and state precizely which area would be served by whom, as was
the desire of the Council. Inclusion of such requirements in the a~reement
could be Conteztsd and jeopardize sale of the bonds. Mr. Blom did state
that he would, with the help of Attorney Firestone, draft a letter to the
City outlining generally the boundaries of areas upon which Chula Vizta
could, depend to use our reserve capacities in the Netropolitan Syztem.
The Council waz in agreement that such a letter would be advisable.

City Administrator Fulviler stated that word from Joan Vincenz~County
Director of Public Works indiogtod the County ia planning on installing
for Spriq Valley Sanitation District a trunk line sewer from their treat-
ment pLamt to the buy and are going to ask the cities of Enn Diego and
Chula Vista to participate in the cost accordinE to anticipated use.
Mr, Fulwiler vas directed to get an estimate of the cost to the City to
participate in construction of the Sweetwater-Spring Valley trunk line
and report back to the Council.
