HomeMy WebLinkAboutcc min 1961/03/21 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday March 21, 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, Smith, McAllister, DeGraaf, Menzel Absent: None Also present: Principal Civil Engineer Harshman, City Attorney Kugler, City Administrator Fulwiler, City Planner Fretz Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of prayer. STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Council for the adjourned regular meeting of March 21, 1961. ~BLIC HEARING- Appeal of First Federal Savings & Loan Assn. on set-back ~' Variance This being the time and place, as advertised, for a public hearing on the appeal of First Federal Savings & Loan Assn. to action of the Planning Commission in denying them a set-back variance to erect a canopy to the property line on "H" Street just East of Broadway, Mayor McAllister declared the hearing openo Mr. Harold Starkey, Harold Starkey, Jr. and Frank Hope, Jr. spoke in favor of the varianceo No others wish- ing to be heard, the Mayor declared the hearing closed. It was moved by Councilman DeGraaf, seconded by Councilman McMains and carried, that the First Federal Savings & Loan Assn. be granted permission to place seven posts on the "H" Street property line of their property on the Northeast corner of Broadway and "H" Street, for support of a proposed canopy to the entrance of their building. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains, Smith, McAllister Noes: None Absent; None RESOLUTION No. 2582- Approving Civil Defense & Disaster Agreement Offered by Councilman Menzel, passed, adopted and approved by the following.vote, to-wit: AYES: Councilmen Menzel,McMains,Smith,McAllister,~eGraaf Noes: None Absent: None ~/"PLANNING COMMISSION REPORT- Conditional Use Permit A letter was read from the Planning Commission reporting that they had denied the application of William Schneider for a conditional use permit to operate a real estate office in his home at 652 "H" Street. ORDINANCE No. 750- Sale of Fire Arms - Second reading It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that Ordinance No. 750 be placed on its second reading; that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None ORDINANCE No. 751- Moving & demolition of buildings-First reading It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that Ordinance No. 751 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None ORDINANCE No. 752- Amending No. 721 -Going out of business-first reading It was moved by Councilman McMains, seconded by Councilman DeGraaf and carried, that Ordinance Nco 752 be placed on its first reading and that reading of the text be waived° The motion carried by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister,DeGraaf,Menz~l Noes: None Absent: None ~,/~'ANTI-NOISE ORDINANCE Councilman Smith was of the opinion some consideration should be given to zoning in the proposed anti-noise ordinance. Councilman Menzel suggested that it might be wise to limit noise control to the R zones only~as a start. The ordinance was referred back to the City Attorney for redrafting. RESOLUTION No. 2583- Approving Master Agreement-Gas Tax allocation Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None RE~LUTION No, 2584-Amending No. 2112-Limiting parking on Jefferson Ave. Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None ~/~ID AWARDED ON FIFTH AVENUE SEWER ,, Principal Civil Engineer Harshman reported having received seven bids on construction of a sewer line on Fifth Avenue North of Street, the low bid being that of the Pace Construction Co, in the amount of $9,~84.80. It was moved by Councilman Smith, seconded by ,c d Councilman Men~l an carried, that the low bid of Pace Construction Co. in the amount of $9,~80 be accepted. The motion carried by the following vote, to-witT~ AYES: Councilmen Smith,McAllister, DeGraaf,Menzel,McMains Noes: None Absent: None ~/' ACCEPTANCE OF BID FOR PURCHASE OF THREE POLICE CARS City Administrator Fulwiler reported having received one bid from McCune Motors for purchase of three police cars. The total bid, including sales tax was $6,844.25 with a trade in allowance of $2,325.00 bringing ~he net amount for the three new cars to $4,519.$5. It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the bid o3 McCune Motors be accepted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None RESOLUTION NCc 2585-Determining that certain sewer facilities be constructed (Travelodge) Offered by Councilman McMains, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister,DeGraaf,Menzel Noes: None Absent: None -2- RESOLUTION No. 2586- Authorizing City Administrator to apply for Public Law Funds Offered by Councilman McMains, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister, DeGraaf,Menzel Noes: None Absent: None PROPOSED THIRD AVENUE PARKING DISTRICT PETITIONS FILED City Administrator Fulwiler reported the petitions for the proposed Third Avenue parking district had been filed with the Clerk. A report will be made to the Council after the checking of signatures and assessed values as to sufficiency. PURCHASE OF PROPERTY FOR PARKS ADVOCATED A letter was read from the Chula Vista Garden Club urging the Council to secure available property for City parks. No action taken. ~SAFETY COUNCIL RECOMMENDATIONS A letter was read from the Safety Council recommending that a four way stop be installed at the intersection of First Avenue and "F" St. It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that the recommendation of the Safety Council be approved. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzel Noes: Councilmen DeGraaf, McMains Absent: None A letter was read from the Safety Council recommending that a 1911 Act proceeding be commenced against property owners of the property along the South side of Naples St. between Monserate and Nacion Streets. The Council suggested that petitions be circulated among the property owners tq, see if they are willing to install the improvements now at their expense. ~/~QUEST TO CLOSE CROSSINGS A letter was read from the Public utilities Commission asking that the City advise them as to the City's position concerning closing of crossings over the San Diego & Arizona Eastern Railway Co. tracks at "I"' St. "J" St. and "K" St. It was moved by Councilman Smith, seconded by Council- man DeGraaf and carried, that the crossings be kept open and do action taken on the request of Public utilities Commission. ~/EEQUEST TO BE HEARD AT HEARING ,,,T,, Third Avenue Parking District Mr. William Drew requested that when and if there is a public hearing on the proposed Third Avenue Parking District, that letters sub- mitted from property owners and business men asking that the City proceed with the former method of securing parking lots, be considered. City Administrator Fulwiler assured Mr. Drew that the letters would be recon- sidered at the hearing. . REQUEST FOR CURBS! GUTTERS AND SIDEWALKS ON LANDIS AVENUE Mr. Steve Petrovich, 224 Landis Ay. requested that property owners on Landis Ave. between E. St. and Davidson St. who do not now have their sidewalks, curbs and gutters in, be forced to do so. The City Administrator was directed to look into the matter. ~/'~REQuEST TO CALL FOR BIDS ON TREE REMOVAL Principal Civil Engineer Harshman requested permission to call for bids at the prevailing minimum wage scale for removal of trees on Fourth Avenue from "E" St. to "H" St. preparatory to the widening of Fourth Avenue. The Council was opposed to the removing of trees on Fourth Ave. at this time as they were of the opinion the project to extend 'E' St. to Bonita Road should be coml~leted before the continuation of the Fourth Avenue widening. -3- ~/CITY ADMINISTRATOR AUTHORIZED TO CONTACT UNITED ENTERPRISES ON PARK LANDS At the suggestion of Councilman McMains~ the City Administrator was directed to contact representatives of United Enterprises in New York pertaining to the Cityts interest in acquiring property from them for park purposes. ~EED OF HIGH POWERED POLICE CARS QUESTIONED Councilman Mc~ains questioned the need for police cars capable of going 120 miles an hour~ now that the State has taken over patroling of the Freeway. City Administrator Fulwiler informed the Council that the State is taking care of wrecks~ court appearances~ etc. on the Freeway~ but the City still is doing patrol work on the highway. It was moved by Councilman Smith~ seconded by Councilman Menzel and carried~ that the Council go on record as being opposed to Assembly Bill NOo775. It was moved by Councilman Mc~ains~ seconded by Councilman DeGraaf and carried~ that the Council go on record as being opposed to Assembly Bill No. 494° It was moved by Councilman Menzel~ seconded by Councilman ~mlth and carried~ that the Council go on record as being opposed to Assembly Bill No. 350. It was moved by Councilman ~aith~ seconded by Councilman DeGraaf and carriedv that the Council go on record as being opposed to Assembly Bill No, 401.
