HomeMy WebLinkAboutcc min 1961/03/28 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday March 28, 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, Smith, McAllister, DeGraaf Absent: Councilman Menzel Also present: Principal Civil Engineer Harshman, City Attorney Kugler, City Administrator Fulwiler Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of prayer STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Council for the adjourned regular meeting of March 28, 1961. ANNOUNCEMENT OF CITY ATTORNEY'S APPOINTMENT TO JUDGESHIP Mayor McAllister announced that it had been confirmed that City Attorney Kugler had been appointed by Governor Brown, Judge of the South Bay Municipal Court. The Mayor extended congratulations and commended Mr. Kugler on his service with the City. City Attorney Kugler stated he had City business all up to date and thanked the Council and the staff for their cooperation and support while he served as City Attorney. It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the Mayor appoint a committee to make a study and recommendation on appointment of a new City Attorney, and that in the meantime Attorney Albert Boyer be contacted to act as City Attorney until an appointment is made. ~"PETITION FOR IMPROVEMENTS ON PARKWAY i petition bearing twenty-two signatures was read requesting that the City take steps to improve Parkway between Fifth Avenue and Broadway. Mr, W, O. MacRae urged that the Council take immediate action to eliminate the hazards caused by the half street condition. Mrs. H. B. Bowlin stated the property owners were willing to pay for the improvements in front of their properties if the City would take action to acquire the thirty feet on Broadway, necessary to put the street through to its full width. It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the City Administrator meet with the petitioners to determine if it will be possible to form a 1911 Act improvement district. ORDINANCE No. 751- Moving and demolition of buildings- second reading It was moved by Councilman DeGraaf, seconded by Councilman McMains and carried, that Ordinance No. 751 be placed on its second reading; that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,McMains,Smith~McAllister Noes: None Absent: Councilman Menzel ORDINANCE No. 752- Amending No. 721-Going Out of Business-second reading It was moved by Councilman Smith, seconded by Councilman McMains and carried, that Ordinance No. 752 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen ~ith,McAllister,DeGraaf,McMains Noes: None Absent: Councilman Menzel ORDINANCE Noo 753- Adoption of Municipal Code- First reading It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that Ordinance NOo 753 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,RcMains,Smith,McAllister Noes: None Absent: Councilman Menzel ~'~N~ING OF ADULT RECREATION CENTER Letters were read from the Chula Vista Art Guild, the Chula Vista Garden Club and the Chula Vista Chamber of Commerce recommending that the Adult Recreation Center be names "Norman Center" in honor of the Park Superintendent. Councilman DeGraaf stated he had suggestions of "Library Park" and"Senior Park". Councilman DeGraaf commented that he preferred the word '~park" to "center" It was moved by Councilman Smith, seconded by Councilman Mc~ains and carried, that the new adult recreation facility on 'F' Street be names "Norman Park". RESOLUTION No0 2587- Confirming sewer assessment district - Fifth Avenue Sewer Offered by CounCilman Smith, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,RcAllister, DeGraaf,Mc]ains Noes: None Absent: Councilman Menzel RESOLUTION No. 2588-Establishing boulevard stops at intersection of First Avenue and "F' Street Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McAllister, McMains Noes: Councilman DeGraaf Absent: Councilman Menzel RESOLUTION - Limiting parking on a portion of Guava Avenue City Administrator Fulwiler explained it had been suggested by the Postmaster that a drive-in mail box might be installed in front of the Civic Center which would necessitate a portion of the curb being painted red. The Council was not in favor of installing a drive-in mail box in front of the Civic Center. No action taken. ORDINANCE No. 754- Repealing Ordinance No. 456- Registration of persons convicted of crimes It was moved by Councilman Smith, seconded by CounCilman McMains and carried, that Ordinance No. 754 be placed on its first reading and that reading of the text be waived. The motion carried by the follo~ ing vote to-wit: AYES: Councilman Smith, McAllister, McMains Noes: Councilman DeGraaf Absent: Councilman Menzel City ~ttorney Kugler stated that repealing of this ordinance was advisable because the California Supreme Court has declared a similar Los Angeles ordinance invalid, due to conflict with State Legislation. ORDINANCE NOo 755- Anti-noise ordinance- First reading It was moved by Councilman DeGraa£, seconded by Councilman Smith and carried, that Ordinance No. 755 be placed on its first reading and that reading of the text be waived. The motion carried by the follow- ing vote, to-wit: -2- AYES: Councilmen DeGraaf,McMains,Smith,McAllister Noes: None Absent: Councilman Menzel 4~TRASH CONTAINERS Mr. Gerald Baker, representative of Baker, Baker & Schrade, Inc. requested permission to place seventy-five trash contain- ers throughout the City with the privilege of renting out space on the containers for advertising. The Council agreed with Councilman Smith's suggestion that the matter be taken under advisement. ~ATER POLLUTION CONTROL BOARD A letter was read from the San Diego Regional Water Pollution Control Board stating that at their meeting of April 3rd, a resolution will be introduced containing a proposed order to the City of Chula Vista to cease and desist from discharging wastes in the San Diego Bay. Time for compliance with the order will be set for no later than August 1, 1963. It is hoped the City will be in a position to connect to the Metropolitan Sewer by that date. ,~,O~POSITION TO SENATE CONSTITUTIONAL AMENDMENT TO SECTION 3 of ARTICLE 15 Letters were read from San Diego Port Director John Bate and the Chula Vista Harbor Commission urging the Council to oppose the Senate State Constitutional amendment to Section 3 of Article 15, which would allow the Legislature to sell unused tidelands to private parties. It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the Council go on record asbeing opposed to the proposed amendment to Section 3 of Article 15 of the State Constitution. PPROPRIATION FOR FIFTH AVENUE SEWER PROJECT It was moved by Councilman ~mith, seconded by Councilman DeGraaf and carried, that $9284.80 be appropriated from the sewer income Fund to cover cost of installation of sewer on Fifth Avenue, North of "C" Street on a repayment basis. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAllister,BeGraaf,McMains Noes: None Absent: Councilman Menzel ~JUDSON ESTATES CIVIC ASSOCIATION Mr. Jack VanCamp reported a large pond directly back of Fire Station No. 3 on East Oneida Street had become a problem because of the hazard caused by small children playing around it. The owners of the property having been contacted, said the property would not be developed for some time. Mr. VanCamp asked that the Council do all possible to have the pond filled. The matter was turned over to the City Administrator to see if he can persuade the owners of the property to fill the pond. Mr. Dave Jones, representing the Judson Estates group, asked what the Council could do to improve the East side of Hilltop Drive between Oxford and Palomar Streets, in order that there would be a place to walk. The Council directed the City Administrator and City ~gineer to look into the matter. iD AWARDED ON REVISION OF SIGNAL AT FOURTH AVENUE AND ~C" STREET Principal Civil Engineer Harshman reported having received three bids on revision of the signal system at Fourth Ave. and 'C~' St., the low bid being that of Perry Electric Co. in the amount of $2,974. It was moved by Councilman McMains, seconded by Councilman Smith and carried, that the low bid of Perry Electric Co. be accepted and $2,974. appropriated from the reserve for Capital Development of the General Fund for payment to Perry E~ectric Co. The motion carried by the following vote~ to-wit: AYES: Councilmen McMains~Smith~McAllister~DeGraaf Noes: None Absent: Councilman Menzel ~J~ROPRIATION FOR NECESSARY EQUIPMENT FOR REVISION OF FOURTH AVENUE AND "~' STREET SIGNAL The Council having authorized purchase and installation by City staff of certain fixtures needed for revision of the signals at Fourth Avenue and '*C" Street, Principal Engineer Harshman asked permission to purchase the pole and mast arm from the firm of Pfaff and Kendall and the other needed parts from Automation Signal Corp. The cost was figured at $2926.00° It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the Engineers proceed with purchase of the needed equipment as requested, and that $2926°00 be appropriated from the reserve for Capital Development of the General Fund to cover the cost. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf~McMains~Smith~McAllister Noes: None Absent: Councilman Eenzel ~DISCHARGE OF EFFLUENT FROM SPRING VALLEY'TREATMENT PLANT Principal Civil Engineer Harshman read a letter he wrote to the San Diego Regional ~ater Pollution Control Board, and asked the Council*s backing in sending it to the Board. The letter stated emphatically that the City is opposed to the discharge of the effluent from the Spring Valley Sanitation District treatment plant any place except in San Diego Bay. Should the Board allow a point of discharge other than into the Bay, it was suggested in the letter that some form of tide gate be installed upstream of the discharge to prevent 'the effluent from backing upstream. It was moved by Councilman McMains, seconded by Councilman DeGraaf and carried, that the letter be sent to the Pollution Control Board as written° ADJOURNMENT 8:30 It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the meeting adjourn until April 4, 1961 at 7:00 P.M.
