HomeMy WebLinkAboutcc min 1961/04/04 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF TBE CITY OF Chula Vista, California Held ~esday April 4, 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, Smith, McAllister, Menzel Absent: Councilman DeGraaf Also present: Principal Civil Engineer Harshman, Acting City Attorney Boyer, City Administrator Fulwiler, City Planner Fretz Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of prayer. PUBLIC HEARING- Highland Annexation This being the time and place as advertised, for a public hearing on the proposed Highland Annexation, Mayor McAllister declared the hear- ing open. No one in the audience wishing to be heard either for or against the annexation, and the Clerk having received no written protests, the Mayor declared the hearing closed. ORDINANCE No. 756- Approving Highland Annexation - First reading It was moved by Councilman McMains, seconded by Councilman Smith and carried, that Ordinance No. 756 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister,Menzel Noes: None Absent: Councilman DeGraaf PUBLIC HEARING- Rezoning of property at rear of 320 Broadway This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-3 to C-2-P of property at the rear of 320 Broadway, Mayor McAllister declared the hearing open. ORDINANCE No. 757- Rezoning of property at rear of 320 Broadway- First reading It was moved by Councilman Menzel, seconded by Councilman McMains and carried, that Ordinance No. 757 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Menzel,McMains,Smith,McAllister Noes: None Absent: Councilman DeGraaf 7:08 P.M. - Councilman DeGraaf took his seat at the Council table at this time. PUBLIC HEARING- Rezoning of property South of "H" Street, West of Broadway This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-3 to C-2-P of certain property on the West side of Broadway, South of 'H" Street, Mayor McAllister declared the hearing open. No one in the audience wishing to be heard either for or against the rezoning, and the Clerk having received no written protests, the Mayor declared the hearing closed. ORDINANCS No. 758 - Rezoning of property South of 'tH" Street, West of Broadway - First reading It was moved by Councilman Smith, seconded by Councilman McMatns and carried, that Ordinance No. 758 be placed on its first reading, and that reading of the text be waived° The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,Mc~atns Noes: None Absent: None ORDINANCE No. 753- Adoption of Municipal Code- Second reading It was moved by Councilman Mc~ains, seconded by Councilman Smith and carried~ that Ordinance No° 753 be placed on its second reading; that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister, DeGraaf,~enzel Noes: None Absent: None ORDINANCE No. 754-Repealing Ordinance No. 456-Registration of Criminals- Second reading It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that Ordinance No° 754 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAlllster, Menzel,McMains Noes: Councilman DeGraaf Absent: None ORDINANCE No. 755- Anti-noise Ordinance- Second reading It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that Ordinance No. 755 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None RESOLUTION No. 2589- Approving revised memorandum of Agreement-Gas Tax Offered by Councilman Smith, read, passed and adopted by the follow- ing vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None RESOLUTION No° 2590-Limiting parking on portion of First Avenue Off,red by Councilman Smith~ passed, adopted and approved by the following vote, AYES: Councilmen Smith,McAllister,Menzel,McMains Noes: Councilman DeGraaf Absent: None ~?REPORT ON 1911 Act Liens City Administrator Fulwiler reported that he and City Finance Officer Grant had met with representatives of the Assessor's office and County Council on the possibility of placing 1911 Act Chapter ;27 assessment liens on the tax rolls. It was found that for a nominal fee, the assessments can be placed on the County tax rolls. However, the County Council was of the opinion it would be more advantageous to the City to foreclose on the liens, which usually assures prompt payment, than to place them on the tax rolls. After discussion, the Council expressed favor in proceeding as we have, in hopes payments will come in without resorting to either foreclosure off' placing on the tax rolls. -2-
