HomeMy WebLinkAboutcc min 1961/05/09 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista~ California Held Tuesday May 9~ 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 PoMo with the following Councilmen present: Councilmen McMains~ McAllister, DeGraaf, Menzel Absent: Councilman Smith Also present: Principal Civil Engineer Harshman, Attorney Boyer, City Attorney Duberg, City Administrator Fulwiler~ Administrative Analyst Ross, City Planner Fretz In the absence of Mayor Smith, Mayor pro-tem Menzel presided, asking for the pledge of allegiance to the Flag, and a moment of silent prayer Statement: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Council for the regular meeting of May 9, 1961 APPROVAL OF COUNCIL MINUTES It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that the minutes for the Council meetings of April 11~ 18, 25 and May 2nd be approved, supies having been sent to each Councilman. ~/PRESENTATION OF AWARD Mayor pro-rem Menzel presented an award to the Police De)artment acce Chief-of-Police ~uinn from the International for cooperation in extending training to police officials sent to the United States from other countries. 'REPORT ON PROPOSED TELEGRAPH CANYON SEWER City Attorney Duberg, in reporting on the question as to how the City's share of the proposed Telegraph Canyon sewer extension could be paid~ stated that it is legal to pay the full amount at the present time from the Sewer Fund~ or over a period of time, prsvided the agreement specifically states payment will be made from the Sewer Fund only. In answer to Councilman McMains remark that no moneys should be expended until the area is annexed to the City~ City Administrator Fulwiler restated that it was the desire of Bollenbacher & Kelton, at this time, to get only an expression from the Council as to its willingness to enter into an agreement for construction of the proposed sewer, before commencing annexation proceedings. It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that the Council accept the report of the City Attorney and that the City Administrator and Engineering Department work out with the firm of Bollenbacher & Kelton a feasible contract or agreement for payment by the City of its share of the cost of the proposed Telegraph Canyon trunk line s~wer extension. ~//APPLICATION FOR CARDROOM LICENSE REVIEWED Letters were read from E.J. Blackwell and LoB,Briggs requesting that the Council reconsider their action at a former meeting in denying the application of Mr, Briggs for a license to operate a cardroom at 246 Broadway. Mr. Blackwell~ owner of the property in question, stated that even though the entrance to his Trailer Court was adjacent to the site of the proposed card room, his tenants had no objections, and there were no teen-age girls in the Court to be offended. Police Chief quinn stated that the observations outlined in Mr. Blackwellts letter were strictly those of Mr. Blackwell, and he as Chief could nott of course, speak for their authenticity. City Attorney Boyer restated that the Council must grant the license unless it is determined that the applicant is not a suitable or proper person to carry on the business~ or if the premises proposed to be used shall be deemed not to be suitable° Councilman RcAlllster stated that having been appraised of the actual facts he had no further objections~ and moved that the application of Mro Briggs for a cardroom at 246 Broadway be approved° The motion died for lack of a second. It was moved by Councilman McAllister that the application be reconsidered after further investiga- tion~ and a report made to the Council. The motion died for lack of a second. ~PORT ON DEDICATION OF MITSCHER STREET CUL-DE--SAC Principal Civil Engineer Harshman reviewed in detail all that has transpired to date on the improvement of Mitscher Street between First Ave° and Corte Maria, Due to errors and misunderstandings on the part of both the property owners and Engineers~ it ~as recommended by Mro Harshman that the City crews install the foundation base in the Mitscher Sto cul-de-sac~ and upon the deposit by Mr, Lively of $712~46~ the City to have a contractor lay A,C, paving over the cul-de-saco It fas moved by Councilman seconded by Councilman DeGraaf and carried~ that the Engineering Dept, be directed to proceed with the plan as outlined by Mr, Harshmano ORDINANCE No. 761 - Rezoning North side of 'H' St, between Smith Ave° and Fifth Ave, - second reading It was moved by Councilman DeGraaf~ seconded by Councilman McAllister and carried~ that Ordinance No, 761 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote~ to-wit: AYES: Councilmen DeGraaf~Menzel~McMains~McAllister Noes: None Absent: Councilman Smith RESOLUTION No. 2601 - Accepting & dedicating portion of property for James Street Offered by Councilman ~cAllister passed~ adopted and approved by the following vote~ to-wit: AYES: Councilmen McAllister~DeGraaf~Menzel~McMains Noes: None Absent: Councilmen Smith RESOLUTION No, 2602- Intention to make changes & modifications- Sweetwater Industrial Park Offered by Councilman DeGraaf~ passed~ adopted and approved by the following vote~ to-wit: AYES: Councilmen DeGraaf~Renzel~McMains~McAllister Noes: None Absent: Councilman Smith PLANNING COMMISSION RECOMMENDATION ON REZONING I letter was read from the Planning Commission recommending that property ~est of Broadway and from "H" to "L" Sts, be rezoned from R-3 to R-1 and R-2o A Public hearing was set for June 6th at 7:00 DUMPING SURPLUS FILL AT FOOT OF "F" STREET Upon the recommendation of the Harbor Commission~ it was moved by Councilman McMains~ seconded by Councilman DeGraaf and carried~ that any surplus select fill materials acquired by City Crews be dumped at the foot of "F" St, It was pointed out that no solids were to be dumped in this area, ASSEMBLY BILL No, 789 (Library Bill) City Attorney Duberg gave a report on the meeting he attended in Sacramento on behalf of the City in opposition to Assembly Bill No. 789° Library Bill) ADJOURNMENT - 8:15 It was moved by Councilman McMains~ seconded by Councilman DeGraaf and carried~ that the meeting adjourn until May 16~ 1961 at the hour of 7:00 P,M.
