SPEAKER TIME LIMITS: The time allotted for speakers may be adjusted by the Mayor. - Five minutes* for specific items listed on the agenda - Three minutes* for items NOT on the agenda (called to speak during Public Comments) - A group of individuals may select a spokesperson to speak on their behalf on an agenda item, waiving their option to speak individually on the same item. Generally, five minutes are allotted per person, up to a limit of 30 minutes, although the limits may be adjusted. Members of the group must be present. *Individuals who use a translator will be allotted twice the amount of time. GETTING TO KNOW YOUR AGENDA Agenda Sections: CONSENT CALENDAR items are routine items that are not expected to prompt discussion. All items are considered for approval at the same time with one vote. Councilmembers and staff may request items be removed and members of the public may submit a speaker slip if they wish to comment on an item. Items removed from the Consent Calendar are discussed after the vote on the remaining Consent Calendar items. PUBLIC COMMENT provides the public with an opportunity to address the Council on any matter not listed on the agenda that is within the jurisdiction of the Council. In compliance with the Brown Act, the Council cannot take action on matters not listed on the agenda. PUBLIC HEARINGS are held on matters specifically required by law. The Mayor opens the public hearing and asks for presentations from staff and from the proponent or applicant involved (if applicable) in the matter under discussion. Following questions from the Councilmembers, the Mayor opens the public hearing and asks for public comments. The hearing is closed, and the City Council may discuss and take action. ACTION ITEMS are items that are expected to cause discussion and/or action by the Council but do not legally require a Public Hearing. Staff may make a presentation and Councilmembers may ask questions of staff and the involved parties before the Mayor invites the public to provide input. CLOSED SESSION may only be attended by members of the Council, support staff, and/or legal counsel. The most common purpose of a Closed Session is to avoid revealing confidential information that may prejudice the legal or negotiating position of the City or compromise the privacy interests of employees. Closed sessions may be held only as specifically authorized by law. Council Actions: RESOLUTIONS are formal expressions of opinion or intention of the Council and are usually effective immediately. ORDINANCES are laws adopted by the Council. Ordinances usually amend, repeal or supplement the Municipal Code; provide zoning specifications; or appropriate money for specific purposes. Most ordinances require two hearings: an introductory hearing, generally followed by a second hearing at the next regular meeting. Most ordinances go into effect 30 days after the final approval. RECOMMENDED ACTION: Adopt a resolution approving audit services amendment between City and LSL for Fiscal Years 2020/21 and 2021/22. 2021/06/15 City Council Page 4 of 13 5.7.Approval of Extension of 100% Clean Energy Sales Agreement with Shell Energy Report Number: 21-0079 Location: Civic Center Library, South Library, Public Services South (Building B) and Discovery Park Department: Economic Development Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. Notwithstanding the foregoing, the activity qualifies for an Exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act State Guidelines. RECOMMENDED ACTION: Adopt a resolution approving a Continuation Agreement extending the term of the parties’ Energy Service Agreement for electricity commodity purchases through June 30, 2024; and authorizing the City Manager to execute all necessary documents. 5.8.Consideration of Participation in CALeVIP Program for Electric Vehicle Chargers at City- Owned Parking Lots Report Number: 21-0071 Location: City Parking Lot Number 2 at Landis Avenue and Davidson Street or Civic Center Library Parking Lot Department:Economic Development Environmental Notice: The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities), Section 15303 class 3 (New Construction or Conversion of Small Structures), and Section 15061(b)(3). RECOMMENDED ACTION: Adopt a resolution authorizing the acceptance of up to $720,000 in incentive funding through the San Diego County Incentive Project of the California Electric Vehicle Infrastructure Project (CALeVIP) and approving an agreement with Zero Impact Solutions and Zero Impact Builders to install electric vehicle infrastructure at City-owned parking lots. 5.9.Contract: Approve Emergency Contract Change Orders with Sancon Technologies, Inc for the Corrugated Metal Pipe Rehabilitation Inside the Right- of-Way Project (CIP Nos. DRN0205/DRN0212); and Transfer $350,000 in Transnet Appropriation Report Number: 21-0069 Location: 855 Energy Way Department: Engineering Environmental Notice: The Project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities), Section 15302 Class 2 (Replacement or Reconstruction), and Section 15061(b)(3) of the California Environmental Quality Act State Guidelines. 2021/06/15 City Council Page 5 of 13 RECOMMENDED ACTION: Adopt a resolution approving emergency contract change orders and transferring funds to DRN0205 (4/5 Vote Required). 5.10.Department of Housing and Urban Development Planning Documents: 2020-2024 Citizen Participation Plan, 2020-2024 Five-Year Consolidated Plan and the 2021-2022 Annual Action Report Number: 21-0050 Location: This item includes both services and capital improvement projects. The service programs have no specific geographic location. The two capital projects include Alpine Avenue Sidewalk Project and Lancerlot Park Playground Equipment located on “K” and Colorado. Department: Development Services Environmental Notice: The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities), Section 15302 Class 2 (Replacement or Reconstruction), Section 15303 class 3 (New Construction or Conversion of Small Structures), Section 15304 Class 4 (Minor Alterations to Land), and Section 15061(b)(3). Under NEPA, the activity is exempt pursuant to Title 24, Part 58.34(a)(2)&(3) of the Code of Federal Regulations and pursuant to the U.S. Department of Housing and Urban Development Environmental Guidelines. RECOMMENDED ACTION: Adopt a resolution (1) approving the 2020-2024 Citizen Participation Plan, 2020-2024 Five- Year Consolidated Plan and the 2021-2022 Annual Action Plan for the U.S. Department of Housing and Urban Development Block Grant Programs; (2) authorizing the City Manager or her designee to execute any and all HUD documents related to the grants; (3) authorizing the City Manager or her designee to execute agreements with each subrecipient; and, (4) establishing new Capital Improvement Project Number PRK0338 entitled Lancerlot Park Playground and appropriating funds thereof. 5.11.Contract: Award of Tree Maintenance Contract to West Coast Arborists, Inc. Report Number: 21-0085 Location: Open Space Districts & Community Facilities Districts Department: Public Works Environmental Notice: The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities) and Section 15304 Class 4 (Minor Alterations to Land). RECOMMENDED ACTION: Adopt a resolution awarding a contract for open space tree maintenance services to West Coast Arborists, Inc. in an amount not to exceed $2,500,000 for the up to five-year term of the contract. 2021/06/15 City Council Page 6 of 13 5.12.Authorization to Accept Dedications of Land in Accordance with the Agreement Regarding Otay River Valley Restoration between Chula Vista and HomeFed Corporation approved by City Council on May 17, 2016 Report Number: 21-0084 Location: Otay River Valley Department: City Manager Environmental Notice: This action was adequately covered in previously adopted Mitigated Negative Declaration (MND), IS-15-006. In addition, the action qualifies as a Class 25 Categorical Exemption pursuant to California Environmental Quality Act State Guidelines Section 15325. RECOMMENDED ACTION: Adopt a resolution authorizing the City Manager to acquire the PA 20 parcel and to accept subsequent offers of dedication under the Agreement Regarding Otay River Valley Restoration between Chula Vista and HomeFed Corporation. 5.13.Post Employment Health Plan for eligible public employees in the Unclassified Middle Management/Professional, Confidential Middle Management/Professional, Unclassified Confidential, and Confidential Classified groups Report Number: 21-0093 Location: No specific geographic location Department: Human Resources Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. (First Reading) 2021/06/15 City Council Page 9 of 13 8.3.Public Hearing to Consider Various Actions for the Financing, Development and Operations of a Resort Hotel, Convention Center, Parking Structure and Related Public Improvements on and Adjacent to Parcel H-3 within the Chula Vista Bayfront Master Plan Report Number: 21-0055 Location: Parcel H-3 of the Chula Vista Bayfront Master Plan Area Department: Development Services Environmental Notice: The Director of Development Services has reviewed the proposed approvals for compliance with the California Environmental Quality Act (CEQA) and has determined that the activities involved with such approvals were covered in previously adopted Environmental Impact Report UPD#83356-EIR-65B/SCH#2005081077, and the addendums thereto. The proposed City Council actions are merely a step-in furtherance of the original project for which environmental review was performed. No circumstances have arisen triggering any supplemental or subsequent CEQA analysis requirements. Accordingly, no further environmental review is required for this item. RECOMMENDED ACTION: Conduct a public hearing, consider all testimony presented and adopt resolutions A) Authorizing the execution and delivery of the Chula Vista Bayfront Convention Center Facility Lease, Sublease Agreement, Project Implementation Agreement, Mutual Lease and Sublease Enforcement Agreement, Amendment No. 1 to the Amended and Restated JEPA Agreement, and Bond Purchase Agreement in connection with the issuance of Chula Vista Bayfront Facilities Financing Authority Revenue Bonds and authorizing the execution of necessary documents and certificates and related actions and B) Acting as the legislative body of the Bayfront Project Special Tax Financing District, authorizing the execution and delivery of a Project Implementation Agreement, Bond Purchase Agreement, and Loan Agreement in connection with the issuance of revenue bonds and authorizing the execution of necessary documents, certificates and related actions. 9.ACTION ITEMS The following item(s) will be considered individually and are expected to elicit discussion and deliberation. 9.1.Interim Urgency Ordinance: Prohibition of Uses in Conflict with Land Use Amendment and Rezoning Initiation IR19-0026 Report Number: 21-0082 Location: Approximately 50 acres located west of I-5 and east and south of the main office and distribution buildings on the Collins Aerospace/United Technology Company Campus Department: Development Services & Economic Development Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. In addition, notwithstanding the foregoing, the activity qualifies for an Exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act State Guidelines. 2021/06/15 City Council Page 10 of 13 RECOMMENDED ACTION: Pursuant to Government Code 36937 and a 4/5 vote of the City Council , this interim urgency ordinance shall take effect and be in force on the evening of its passage and shall remain in effect for 90 days. Two one-year-extensions to the interim urgency ordinance may be implemented following a public hearing and 4/5 vote of the City Council pursuant to CVMC 19.12.060 through 19.12.080. Staff recommends City Council adopt the ordinance. 9.2.Grant Agreement Approval: Community Congregational Development Corporation Report Number: 21-0068 Location: Norman Park Senior Center, 270 F Street Department: Community Services – Parks and Recreation Environmental Notice: The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities), Section 15302 Class 2 (Replacement or Reconstruction), Section 15303 class 3 (New Construction or Conversion of Small Structures), and Section 15304 Class 4 (Minor Alterations to Land). RECOMMENDED ACTION: Adopt a resolution approving the Grant Agreement between City and Community Congregational Development Corporation (CCDC) for renovations at the Norman Park Senior Center. 9.3.Campaign Contributions: Ordinance Regarding Campaign Contributions and Possible Reassignment of Districts After Fundraising Has Begun Due to Redistricting Location: No specific geographic location Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.
