CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday June 13, 1961
The Council met in the Council Chambers at the City Hall on the
above date at 7:00 P.M. with the following Councilmen present:
Councilmen McMains, McAllister, Smith, DeGraaf, Menzel
Absent: None
Also present Principal Civil Engineer Harshman, City Attorney
Duberg, City Administrator Fulwiler, City Finance
Officer Grant, City Planner Fretz, Administrative
Analyst Ross
Mayor Smith led the pledge of allegiance to the Flag, and asked for a
moment of prayer.
Statement: The City Clerk hereby states that he did post within 24
hours of adjournment, as provided by law, the order of
adjournment of the City Council for the regular meeting
of June 13, 1961.
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman McMains, seconded by Councilman Menzel
and carried, that the Council Minutes for the meetings of May 9, 16, 23,
and June 6th be approved, copies having been sent to each Councilman.
]//,~UBLIC HEARING- Proposed Muraoka Annexation
This being the time and place, as advertised, for a public hearing
on the proposed Muraoka Annexation, Mayor Smith declared the hearing open.
No one in the audience wishing to be heard either for or against the
annexation, and the Clerk having received no written protests, the Mayor
declared the hearing closed.
ORDINANCE No. 765- Approving Muraoka Annexation- First reading
It was moved by Councilman McAllister, seconded by Councilman DeGraaf
and carried, that Ordinance No. 765 be placed on its first reading and that
reading of the text be waived. The motion carried by the following
vote, to-wit:
AYES: Councilmen McAllister, Smith,DeGraaf,Menzel,McMains
Noes: None
Absent: None
~/×PUBLIC HEARING - Interim Zoning of Muraoka Annexation
This being the time and place, as advertised, for a public hearing on
the proposed R-l, R-3 and C-2-P interim zoning of the proposed Muraoka
Annexation~ Mayor Smith declared the hearing open. No one in the audience
wishing to be heard either for or against the proposed, interim zoning
and the Clerk having received no written protests, the Mayor declared the
hearing closed.
ORDINANCE No. 766- Approving interim zoning of Muraoka Annexation- First
reading
It was moved by Councilman McAllister, seconded by Councilman Menzel
and carried, that Ordinance No. 766 be placed on its first reading and that
reading of the text be waived. The motion carried by the following vote,
to-wit:
AYES: Councilmen McAllister, Smith,DeGraaf,Menzel,McMains
Noes: None

~,~JBLIC HEARING - Budget for fiscal year 1961-1962
This being the time and place, as advertised, for a public hearing
on the proposed budget for the fiscal year 1961-1962, Mayor ~mith
declared the hearing open.
Elmer 3orensen, Public Relations Consultant to the Chula Vista Police
Relief Assn. once more urged the Council to grant ten percent salary
raises to members of the Police and Fire Departments. Others ppeaking in
favor of salary raises for Police and Firemen were Mrs. Mary McKiernen,
Syd Hall, Dan Putnam, Louis Alberts, George McNeeley, Mrs. Ruth Walker,
and Captain Matthias Taylor.
Mr. Otto Hahn~ Business representative of the American Federation
of State, County and Municipal Employees gave a presentation on behalf of
the Miscellaneous employees of the City, and left with the Council his
written document covering salary proposals for the fiscal year 1961-1962.
No others wishing to be heard, Mayor Smith declared the hearing closed.
RESOLUTION No. 2620-Approving Tentative Map of Robinhood No. 8
Offered by Councilman McAllister, passed, adopted and approved by
the following vote, to-wit:
AYES: Councilmen McAllister, Smith,DeGraaf,Menzel,McMains
Noes: None
Absent: None
RESOLUTION No. 2621-Approving Tentative Map of Virginia Terrace
Offered by Councilman McMains, passed, adopted and approved by
the following vote, to-wit:
AYES: Councilmen McMains,McAllister, Smith, DeGraaf,Menzel
Noes: None
Absent: None
~./~ENTATIYE MAP OF HALECREST SHOPPING CENTER
City Planner Fretz submitted the tentative map of Halecrest Shopping
Center No. 1 with the Planning Commission recommendations of approval.
It was moved by Councilman DeGraaf, seconded by Councilman McMains
and carried, that approval of the map be held up until a time when the
developers are able to substantiate its need.
RESOLUTION No. 2622- Determining the necessity for construction of off-
site sewers to service C.V.Elementary School at
East "J" Street
Offered by Councilman DeGraaf (with the stipulation that the
reimbursement period extend,for ten years) passed, adopted and approved
by the following vote, to-wit:
AYES: Councilmen DeGraaf,Menzel,McMains,McAllister, Smith
Noes: None
Absent: None
ORDINANCE No. 764-Rezoning certain property West of Broadway from H. St.
to L. St. - second reading
It was moved by Councilman McMains, seconded by Councilman DeGraaf
and carried, that Ordinance No. 764 be placed on its second reading;
that reading of the text be waived and the Ordinance adopted. The motion
carried by the following vote, to-wit:
AYES: Councilmen McMains,McAllister, Smith,DeGraaf,Menzel

~//REPORT ~N RESPONSIBILITY OF CITY TO PROVIDE ENTRANCE TO YOUNG PROPERTY
City Attorney Duberg, reporting on the request of H.S.Young that the
City provide him with an entrance to his lot on upper East "J" St., stated
that if it has been determined that the Young lot has been damaged by the
City tearing up his driveway, then the City is liable but at this time
there is no basis on which to determine that the lot was damaged by the
City, so in his opinion it is not the responsibility of the City to furnish
Mr. Young with an entrance to his property° No action taken.

RESOLUTION Noo 2623-Adopting & submitting budget for expenditure of
Gas Tax funds
Offered by Councilman Menzel, passed~ adopted and approved by the
following vote~ to-wit:
AYES: Councilmen Menzel,McMains,McAllister~Smith,DeGraaf
Noes: None
Absent: None
~rSo Robert DeWitt~ 142 San ~arcos Place~ requested a variance in
the parking ordinance which would allow her and her three neighbors
living on the San ~arcos Place cul-de-sac to park their cars at an angle
rather than parallel to the curb. The cul-de.sac being on a steep
incline~ the request was made in the interest of safety. The matter was
referred to the City Administrator for study.
~LTERNATE APPOINTED TO DISASTER COUNCIL
Councilman ~enzel requested that an alternate representative be
appointed to represent the City at the San Diego Disaster Council meet-
ings at times when the regular representative is unable to attend0
~ayor Smith appointed Councilman DeGraaf as alternate representative to
the San Diego Disaster Council.
~ATE SET FOR P~E-H~ARING ON 1911 ACT ASSESSMENT
Due to a technical error~ Principal Engineer Harshman requested
that a date be set for a re-hearing on the 1911 Act Assessment for the
property at 840 First Avenue.
It was moved by Councilman Mc~ains~ seconded by Councilman DeGraaf
and carried~ that July llth at 7:00 otclock PoMo be set as the time for
a public hearing on the matter°
