SPEAKER TIME LIMITS: The time allotted for speakers may be adjusted by the Mayor. - Five minutes* for specific items listed on the agenda - Three minutes* for items NOT on the agenda (called to speak during Public Comments) - A group of individuals may select a spokesperson to speak on their behalf on an agenda item, waiving their option to speak individually on the same item. Generally, five minutes are allotted per person, up to a limit of 30 minutes, although the limits may be adjusted. Members of the group must be present. *Individuals who use a translator will be allotted twice the amount of time. GETTING TO KNOW YOUR AGENDA Agenda Sections: CONSENT CALENDAR items are routine items that are not expected to prompt discussion. All items are considered for approval at the same time with one vote. Councilmembers and staff may request items be removed and members of the public may submit a speaker slip if they wish to comment on an item. Items removed from the Consent Calendar are discussed after the vote on the remaining Consent Calendar items. PUBLIC COMMENT provides the public with an opportunity to address the Council on any matter not listed on the agenda that is within the jurisdiction of the Council. In compliance with the Brown Act, the Council cannot take action on matters not listed on the agenda. PUBLIC HEARINGS are held on matters specifically required by law. The Mayor opens the public hearing and asks for presentations from staff and from the proponent or applicant involved (if applicable) in the matter under discussion. Following questions from the Councilmembers, the Mayor opens the public hearing and asks for public comments. The hearing is closed, and the City Council may discuss and take action. ACTION ITEMS are items that are expected to cause discussion and/or action by the Council but do not legally require a Public Hearing. Staff may make a presentation and Councilmembers may ask questions of staff and the involved parties before the Mayor invites the public to provide input. CLOSED SESSION may only be attended by members of the Council, support staff, and/or legal counsel. The most common purpose of a Closed Session is to avoid revealing confidential information that may prejudice the legal or negotiating position of the City or compromise the privacy interests of employees. Closed sessions may be held only as specifically authorized by law. Council Actions: RESOLUTIONS are formal expressions of opinion or intention of the Council and are usually effective immediately. ORDINANCES are laws adopted by the Council. Ordinances usually amend, repeal or supplement the Municipal Code; provide zoning specifications; or appropriate money for specific purposes. Most ordinances require two hearings: an introductory hearing, generally followed by a second hearing at the next regular meeting. Most ordinances go into effect 30 days after the final approval. Anyone may request an item be removed for separate consideration. 5.1.Waive Reading of Text of Resolutions and Ordinances RECOMMENDED ACTION: Approval of a motion to read only the title and waive the reading of the text of all resolutions and ordinances at this meeting. 5.2.Consideration of Requests for Excused Absences 5.3.Annual Budget: Update List of Unclassified City Position Titles Report Number: 22-0161 Location: No specific geographic location Department: Finance Environmental Notice: The activity is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. RECOMMENDED ACTION: Adopt an ordinance amending Chula Vista Municipal Code Section 2.05.010 to add the unclassified position titles of Chief Information Security Officer and deleting the position titles of Real Property manager and Smart Technology Officer. (Second Reading and adoption) (4/5 Vote Required) 2022/06/07 City Council Agenda Page 3 of 8 5.4.Contract Award and Appropriation: Awarding a Public Works Contract to Blue Pacific Engineering & Construction for the Chula Vista Elite Athlete Training Center (CVEATC) Bridge Repair Project and Appropriating Funds for That Purpose Report Number: 22-0168 Location: 2800 Olympic Parkway, Chula Vista, CA 91915; Wueste Road Entrance Department: Engineering Environmental Notice: The Project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the California Environmental Quality Act State Guidelines. Notwithstanding the foregoing, the Project was adequately covered in previously adopted/certified Environmental Impact Report, EIR 89-11 and Supplemental Environmental Impact Report, SEIR 89-11 for the Olympic Training Center RECOMMENDED ACTION: Adopt a resolution approving a contract with Blue Pacific Engineering & Construction for the CVEATC Bridge Repair project (CIP GGV0241) and appropriating funds for the construction phase of the project (4/5 Vote Required). 5.5.Grant Applications: Authorize the Submittal of Two Active Transportation Program Grant Applications, and State the City's Assurance to Complete the Projects Report Number: 22-0166 Location: F Street between Bay Boulevard and Broadway; westerly and parallel to Bay Boulevard between E Street and Lagoon Drive within the railroad corridor for the Coronado Branch Line Railroad. Department: Engineering Environmental Notice: The activity qualifies for an Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 (Existing Facilities); Section 15303 (New Construction or Conversion of Small Structures); Section 15304 (Minor Alterations to Land); Section 15183 (Projects Consistent with a Community Plan or Zoning); and Section 15061(b)(3). RECOMMENDED ACTION: Adopt a resolution authorizing the submittal of two Active Transportation Program - Cycle 6 grant applications for the F Street Promenade - Phase 1 and Bayshore Bikeway from E Street to Lagoon Drive projects, and state the City's assurance to complete the projects. 5.6.City Employment Benefits: Adopt Amendments to the Memoranda of Understanding with Collective Bargaining Groups Regarding Employee Benefits Report Number: 22-0114 Location: No specific geographic location Department: Human Resources Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. 2022/06/07 City Council Agenda Page 4 of 8 RECOMMENDED ACTION: Adopt a resolution approving amendments to memoranda of understanding (MOUs) regarding the addition of Juneteenth as a hard holiday, a Post Employment Health Plan, and the option to cash out vacation, compensatory time, and sick leave, if applicable for the following bargaining units: Association of Chula Vista Employees (“ACE”); Chula Vista Mid-Managers/Professional Association, SEIU Local 221 (“MM/PROF”); Non-Safety Local 2180, International Association of Fire Fighters, (“Non-Safety IAFF”); Chula Vista Peace Officers Association (“POA”); and the Western Council of Engineers (“WCE”). 5.7.Donation Acceptance & Appropriation: Accept Donations to be Used for the Costs Associated with Parks & Recreation Facilities and Programs Report Number: 22-0163 Location: Norman Park Senior Center, 270 F Street Department: Community Services – Parks & Recreation Environmental Notice: The activity is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. RECOMMENDED ACTION: Adopt a resolution accepting donations from multiple sources in the amount of $4,250 to be used for costs associated with Parks & Recreation facilities and programs, and appropriating funds for that purpose (4/5 Vote Required). 5.8.Senate Bill 1383: Amendments to Chula Vista Municipal Code Chapters 8.24 (Solid Waste) and 8.25 (Recycling, Organic Waste, and Edible Food Recovery) to Ensure Compliance with Senate Bill 1383 Mandates Report Number: 22-0124 Location: No specific geographic location Department: Economic Development Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. Notwithstanding the foregoing, the activity qualifies for an Exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act State Guidelines. RECOMMENDED ACTION: Place an ordinance on first reading amending various sections of Chula Vista Municipal Code Chapters 8.24 and 8.25 to ensure compliance with Senate Bill 1383 regulations. (First Reading) 2022/06/07 City Council Agenda Page 5 of 8 5.9.Coastal Development Permit Waiver: Receive a Report on the Issuance of a Coastal Development Permit De Minimis Waiver for Demolition of 215 Bay Boulevard Report Number: 22-0175 Location: 215 Bay Boulevard Department: Development Services Environmental Notice: The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities) and a Common Sense Exemption Section 15061(b)(3). RECOMMENDED ACTION: Receive a report and accept the Development Services Director’s determination regarding the issuance of a Coastal Development Permit De Minimis waiver for the demolition of the existing structure at 215 Bay Boulevard. 5.10.Housing and Urban Development (HUD) Action Plan Amendment: Amend the HUD 2021/2022 Annual Action Plan, the Sub-Recipient Agreement with SBCS for Emergency Shelter Operations and Approve an Agreement with Clean the World for Mobile Shower Services Report Number: 22-0181 Location: No geographic location. Department: Development Services Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act (“CEQA”) State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. Notwithstanding the foregoing, the activity qualifies for an Exemption pursuant to Section 15061(b)(3) of the CEQA State Guidelines. RECOMMENDED ACTION: Adopt a resolution amending the HUD Annual Action Plan to reallocate $1,418,000 in ESG-CV funds for staff outreach services, homeless emergency shelter operations, and mobile shower services and authorize the City Manager to execute agreements with SBCS Corporation and Clean the World Foundation, Inc. and make further revisions as needed. 6.PUBLIC COMMENTS The public may address the Council on any matter within the jurisdiction of the Council but not on the agenda. 7.PUBLIC HEARINGS The following item(s) have been advertised as public hearing(s) as required by law. 2022/06/07 City Council Agenda Page 6 of 8 7.1.Regional Transportation Improvement Program: Adopt the TransNet Local Street Improvement Program of Projects for Fiscal Years 2022/23 through 2026/27 Report Number: 22-0159 Location: No specific geographic location Department: Engineering Environmental Notice: The activity is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required RECOMMENDED ACTION: Conduct the public hearing and adopt a resolution approving the proposed TransNet Local Street Improvement Program of Projects for Fiscal Years 2022/23 through 2026/27. 8.ACTION ITEMS The following item(s) will be considered individually and are expected to elicit discussion and deliberation. 8.1.Art Gallery: Naming of the City Building Located at 50 North Fourth Avenue as “Casa Casillas,” In Honor of Chula Vista Resident and Artist, Paula Casillas Report Number: 22-0179 Location: 50 North Fourth Avenue, Chula Vista Department: Community Services- Library Environmental Notice: The proposed Project has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the Project qualifies for a Categorical Exemption pursuant to State CEQA Guidelines Section 15301 Class 1 (Existing Facilities) and Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Thus, no further environmental review is required.
