HomeMy WebLinkAboutcc min 1961/07/18 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Ohula Vista, California Held Tuesday July 18, 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen Mc-Mains, McAllister, Smith, DeGraaf, Menzel Absent: None Also present: Principal Civil Engineer Harshman, City Attorney Duberg, City Administrator Fulwiler, Administrative Analyst Ross, City Planner Fretz Mayor Smith led the pledge of allegiance to the Flag,, and asked for a moment of prayer. STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of th~ City Council for the adjourned regular meeting of July lb, 1961 RESOLUTION No. 2639- Giving notice of proposed Allied Contractors Annexation Offered by Councilman OeGraaf, passed, adopted and approved by the following vote, to,wit: AYES: Councilmen DeGraaf,Menzel,McMains,McAllister,Smith Noes:~ None Absent: None RESOLUTION No. 2640- Approving recreation agreement between School Districts and City - 1961-1962 Offered by Councilman Menzel, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Menzel,McMains,McAllister,Smith,DeGraaf Noes: None Absent: None RESOLUTION No. 2641- Giving notice to property owners to construct improvements under 1911 Act, and setting date for public hearing-Phase II Offered by Councilman McAllister, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McAllister,Smith,DeGraaf,Menzel,McMains Noes: None Absent: None RESOLUTION No. 2642- Approving repayment diagram for Naples Street Sewer (School District) Offered by Councilman McMains, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMatns,McAllister,Smith,DeGraaf,Menzel Noes: None Absent: None The Council was of the opinion the City ordinaQce dealing with sewer repayment should be amended to set a time limit for developers to submit repay- ment agreements for Council approval. The Mayor suggested that the City Attorney redraft the ordinance to require developers to enter into a repayment agreement prior to installation of sewers if it is their desire to have such an agreement. ~,aEqUEST FOR VACATION OF EASEMENT IN S~AFFER COURT A letter was read from Lyman W. Bruce requesting that the City vacate the utility easement over the rear six feet of Lots 1~ 2~ and 3 and the South six feet of Lot 1 in Shaffer Court Subdivision. Action was held over in order that the City Attorney could draft the appropriate resolution to abandon the easement. ~//REPORT ON NAPLES STREET IMPROVEMENTS Principal Civil Engineer Harshman read his report on installation of certain improvements on Naples Street between the East line of the proposed Virginia Terrace Subdivision to the Westerly line of Seaview Estates No. 4. Mr. Harshman stated questionnaires have been sent to the property owners giving them an opportunity to express their desires in regard to method of improving the street. Action by the Council was held over pending return of the questionnaires. REPORT ON HILLTOP DRIVE IMPROVF/~ENTS Administrative Analyst Ross, in giving a pro,tess report on the requested improving of Hilltop Drive between O~ford Street and Palomar Street. stated that a report would be forthcoming from the ~ounty ~oad Department, to whom the matter was referred by the Board of Supervisors. The City had previously sent the Board a request to take steps to acquire the necessary rights of way to widen and sidewalk the area. ~/R~PORT ON R~UEST TO VACATE PORTION OF ALLEY Principal Civil Engineer Harshman stated a study has shown that it would be feasible to vacate a portion of the alley North of G. Street and West of Church Ave. as requested by H. A. Jackson and Troy Homer, if they would install a box culvert for drainage purposes approved by the City Engineer, and dedicate an easement to the City for maintenance purposes. City Administrator Fulwiler and Mr. Harshman were directed to determine if the passing by the Council of a resolution of intention to vaoate~ would be sufficient evidence to the owners that the Council will complete vacation proceedings if the owners install the box culvert first. ~/~ES APPROVED FOR USE OF ADULT RECREATION CENTER City Recreation Director Jasinek submitted a schedule of fees proposed to be charged for use. of the Adult Recreation Center (Norman Park) as recommended by the Park and Recreation Cou~nission. It was moved by Councilman DeGraaf, seconded by Councilman McMatns and carried, that the schedule of fees be approved as Submitted. ~/PLANNING COMM~SION RECOMMENDATIONS on rezoning 590-594 "D" Street to C~-P, A letter was read from the Planning Commission recou~nending that the property located at the Southeast corner of Broadway and "D" Street be rezoned C-2-P. August let at 7:00 P.M. was set as the time for a public hearin§ on the recommendation. ~EPORT OF FINDINGS ON APPEAL TO PLANNING CO~ISSION DENIAL OF ZONE CHANGE An appeal was read from J. D. McKinney, Wm. Britton and D. C. Handley to the decision of the Planning Co,~ission in denying them a zone change from R-3 to C~2 for the South side of "H" Street between Fourth Avenue and an alley to the East in the center of the block. The report finding from the Planning C~u~ission was read. Mr. G'russ. agent for the property owners submitted a petition bearing the names of twenty-eight property owners expressing approval to the rezoning. August 8th at 7:00 P.M. was set as the date for a public hearing on the appeal. APPROVAL OF CIVIL SERVICE CLASSIFICATION & ~OMPENSATION PLAN - 1961-1962 It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that Rule 2 of the emended classification and compensation plan effective July 1, 1961 to June 30, 1962 be approved. -2- ~//CLASSIFICATION OF CLERK POSITION IN POLICE DEPARTMENT A letter was read from the Civil Service Co~mlssion reporting that the Commission had reclassified the Junior clerk position served by Mrs. Frances Stringer in the Police Department~ to intermediate clerk. It was suggested that the change in classification be effective July 11, 1961, The report was referred to Mayor Smith for study. ~EE~UEST FO~P, ELIEF ON 1911 ACT ASSESSMENT A letter was read from George E. Palmer, 840 First Avenue, requestinE that the cost of the construction of curbs, gutters and shoulder paving in front of his property be assessed on a pro rata basis over a period of years, and that the assessments be added to the tax bill. The request was referred to the City Administrator to determine if there is any way Mr, Palmer's request may be granted, OPINION ON LEGALITY OF PROCEEDINGS ON OTAY GARDENS SOUGHT Mr, Ray Swaner, representing Bollenbacher & Kelton, Subdividers, asked the City Attorney if it was legal for the Planning Commission to consider the Otay Gardens Subdivision map prior to the Councils~ action approving the Resolution of Intention to annex the Allied Contractors Annexation. City Attorney Duberg stated it was legal for the Planning Commission to consider the tentative map prior to action by the Council on the Annexation. .4)ATE SET FOR MEETING WITH CHARTER CO~4ITTEE At the request of City Administrator Fulwiler, the Council agreed to meet with members of the Charter Review Committee at the end of their next Council meeting July 25th, Councilman Mensel urged that the Council in the near future take action to meet Jointly with other co~i~tees, AOJOURNMENT Mayor Smith adjourned the meeting at 8:05 P.M, until July 2§th at 7:00 PM. City Clerk
