CITY COUNCIL OF THE CITY OF
CH~-LAVISTA, CALIFORNIA
Held Tuesday August 8. 1961
The ~ouncil met in the Council ~hambers at the City Hall on the above date at 7:00
with the following ~ouncilmen present: P.M.
Councilmen Mc/4ains, McAllister, Smith, DeGraaf, Menzel
Absent: None
Also present: Principal Civil Engineer Harshman~ City Attorney Duberg,
Administrative Analyst Ross, City Planner Fretz, Zecreation
Director Jasinek
Mayor Smith led the pledge of allegiance to the Flag, and asked for a moment of
prayer.
STATEMENT: The City Clerk hereby states that he did post within 24 hours
of ad~ourrument, as provided by law, the order of adjournment
of the City Council for the regular meeting of August 8~ 1961
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman McAllister, seconded by Councilman DeOraaf and
carried, that the Council Minutes for meetings of July 11, 18, 25, and August
be approved, copies having been sent to each Councilman.
~'PUBLIC HEARING - Appeal to Planning Commission decision to rezone South side of
"H" St, East of Fourth Ave. to an alley in the middle of the block.
This being the time and place, as advertised, for a public hearing on an appeal
to the decision of the Planning Co~ission in denying applicants a zone change f~
R-3 to C-2 for property on the South side of "H" St. East to an alley in the middle
of the block, Mayor Smith declared the hearing open. Speaking in favor of the rezon-
lng were Bob Gruss, representing J. D. McKinney~ Bill Meyer representing Shell Oil
Co. · Jim Lay representing Dr. M. D. Redding, and Marie Allen representing Damon
Handley and Wm. R. Britton. Speaking in opposition to the rezoning was Elizabeth
Martin representing Jack Hillier. No others wishing to be heard, and the Clerk
having received no written protests, the Mayor declared the hearing closed.
THe report of findings from the Planning Commission were read. It was moved
by Councilman DeGraaf, seconded by Councilman McMains and carried, that the action
of the Planning Co~nission be sustained and the appeal denied. Councilman McAllister
voted
ORDINANCE - Rezoning of Southeast corner of Broadway and "D" Street- First reading
At the request of Attorney Milton Milkes, representing Zoltan Komlos, it was
moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that action
on this ordinance be held over one week pending negotiations between Attorney Milkes
and Mr. Paxton.
j~EXTENSION OF TIME GRANTER FOR SUBMISSION OF PA~KING DISTRICT PETITIONS
Administrative Analyst Ross reported an error has been detected in the amount
of the assessed value of the land owned by the San Diego Gas & Electric Co. which was
figured in ascertaining the total assessed value of all the land included in the
Third Avenue Parking District. With the correct assessment being applied, the =
percentage of total lands validly signed for on petitions in favor of a parking
district, falls below sixty percent. This would mean the Clerk's Certificate
of sufficiency filed with the Council July 11, 1961 was in effect insufficient.
Mr. Ross stated O'Melveny & Myers have been contacted, and they advise that the
Council may grant the proponents of the district until October 11, 1961 in which to
file supplemental petitions.
Gol. Wm. Drew objected to the granting of more time to the proponents because of the
fact signatures on the petition were already sufficient for the holding of a public
hearing, and it was his contention some consideration should be given the opponents
to the District.
Mr. Joseph Carpenito, representing the Parking Co~m~ittee of the Dowatown Assn.
requested that the Council extend the time until October llth for the filing of supple-
mental petitions, in order that the larger district could be formed.
It was moved by Councilman McAllister, seconded by Councilman DeGraaf and Carriad~
that the proponents of Third Avenue Parking District be granted until October 11, 1961
to file supplemental petitions.
~/~BIDS RECEIVED FOR APPRAISAL WORK
Administrative Amalyst Ross stated a bid had been received from John C. Webb
lng to appraise the properties involved in the extension of "E" Street for $1500. and
the properties to be acquired for Parking lots under the parking district for $2500.
or if he received the hid on both Jobs, for a total of $3600.
It was moved by Gouneilman McAllister, seconded by Councilman Menzel and carried,
that the matter be held over one week in order that Gity Attorney Duberg may study
the legality of hiring an appraiser for the parking lots at this time.
NAPLES STREET SCHOOL-PARKPILOT PROJECT
Recreation Director Jasinek submitted and reviewed for the Council a tentative
proposal for division of costs on the Naples Street School-Park Pilot project. Mayor
Smith suggested that the Gouncil study the proposal for at least one week.
PROGRESS REPORT ON METROPOLITAN SEWER PROJECT
Dwight Gore, City representative on the Metropolitan Sewer Committee gave a report
on the meeting before the San Diego City Council pertaining to the proposed supple-
mental agreement to the Metropolitan Sewer proposal. Mr, Gore stated that the dead-
line set for the City's signing the supplemental agreement was August 16th.
It was moved by Councilman McAllister, s~conded by Councilman Menzel and carried,
that action on the matter be held over one week for study.
APPOINTMENT OF MEMBERS TO SISTER CITY COI~ISSION
It was maved by Councilman DeGraaf, seconded by Councilman McAllister and carried,
that Miss Enid Hause and Mrs. Ruth E. Hyde be reappointed members of the Sister City
Commission for a term of four years, said terms to expire June 30, 1965.
O~P, EqUEST ~F MONTGOMERY LOCAL FIRE DISTRICT FORM Ir f UAL AID AGREEMENT
Action on this request held over one week for City Attorney to draft necessary
agreement.
~,_/0FFER TO FILE BRIEFS
A letter was read from B. Bill Muted, 2004 Hornblend St. San Diego,
offering help, without charge, in filing briefs, etc. in the U.S.Supreme Court. The
letter was referred to the City Attorney.
~/REqUEST FOR SIGN
A letter was read from The Freewill Baptist Church requesting per-
mission to install a Church sign on the Southeast corner of Fifth Avenue and "C" St.
directing the way to the Legion Hall where their services are held. The letter was
referred to Administrative Analyst Ross.
· REQUEST FOR ALLOCATION OF PARADE FUNDS
A letter was read from the Junior Ghember of Gu~aerce requesting
that $750. be allocated at this time to meet initial Golden A~iversary Parade costs
and that the remaining $750. budgeted for the event be made available at the conclusion
of the event. It was moved by Councilman DeGraaf, seconded by Councilman McAllister
and carried, that the $750. be allocated as requested.
~/kEqUEST FOR FIFTEEN MILE SPEED LIMIT ON PARKWAY
A letter was read from the Park & Recreation Co~ission requesting
that the speed limit on Parkway be reduced to 15 miles per hour. The request was
referred to Administrative Analyst Ross.
~IVIL DEFENSE PROGRAM
An invitation was extended by the National City VFW to all interested
to attend a Civil Defense program August 16th at 8:00 P.M.

~'DEVELOPMENT OF SCHOOL PROPERTY FOR COMMUNITY USE SUGGESTED
A letter was read from the Park & Recreation Commission asking
for comments from the Council on the idea of developing a piece of School property
at the corner of Hilltop Drive and Murray St. for community usage. The letter was
taken under advisement.
~/~.~REQUEST FOR USE OF STP. EET FOR PARTY
A letter was read from Mrs. Paul Stevens asking permission to
hold a party in the street on Del Mar Avenue in the 800 block on the evening of
August 9, 1961 from 5:00 to 10:00 P.M. It was moved by Councilman DeGraaf, seconded
by Councilman McMains and carried, that the request be granted.
/.~ REQUEST FOR HEARING ON VIOLATION OF ORDINANCE No. 681
A letter was read from E. J. Powell asking that he be granted a
hearing before the Council on the matter of a roof that he had constructed in viola-
tion of Ordinance No. 681, A letter was read from Building Inspector Grady out-
lining the circumstances under which Mr. Powell was in violation of the ordinance
on roofing. It was moved by Councilman McAllister that Mr. Powell be given an
opportunity to be heard by the Council. The motion died for lack of a second. The
other Councilmen were of the opinion all the Council could do would be to amend the
ordinance, which would not help Mr. Powell at this time.
~.~REQUEST TO LECTURE IN CHULAVISTA
A letter was read from Dr. D.P.Villaflores requesting that someone
make arrangements for him to lecture on "The Philippines~ ~truggle & Victory Against
Communism" here in Chula Vista. The letter was referred to the Chamber of Commerce.
~ INVITATION TO LITTLE LEAGUE DANCE
A letter was read from John B. Wilburn, Secty. of the National
Little League of Chula Vista, inviting Councilmen to the Fourth Annual Sluggers Ball
at the Recreation Center, August 12th from 8:30 P.M. to midnight.
REQUEST FOR CLEAN-UP CAMPAIGN
Mr. Dave Jones, representing the Suburban Civic Assn., asked what
means could be taken to get citizens interested in keeping up their homes and yards.
Charles Kopeland pointed out that the Downtown Assn. was starting a campaign on City
beautification. The Secretary of the Chamber of Commerce stated the Chamber has a
beautification Committee and is working up a program for the fall.
PLANNING COMMISSION STUDY ON TREE PROGRAM SUGGESTED
Councilm,n McMains suggested that the Planning Commission study a
program for tree planting in the City. Administrative Analyst Ross stated that City
Planner Fretz has been making such a study, and will be ready with a report in the
near future.
/~DIPS IN STP. F. ETS Councilman McMains asked that the Engineering Department, at their
leisure, make a study of the street dips in the City and try to arrive at an extimated
cost of elevating some of them.
b//LIQuoR LIG~[~E$ Councilman McMains stated that the City has an opportunity to
object before the Alcoholic Beverage Commission before any license is issued for a
liquor establishment within the City, and thought we should do so if it is the desire
of the Downtown Assn. and Broadway Assn. to keep more liquor establishments from
coming into the City. Councilman Menzel asked that the City Attorney check to see
what can legally be done to stop more liquor establishments from coming into the City.

Councilman Mc-Mains suggested that inasmuch as it would be some time
before all the legal steps in the extension of "E" St. to Bonita ~oad could be worked
out, it might be well to use the funds available and continue the widening of Fourth
Avenue to "H" Street. The other Councilmen were opposed to the suggestion,

Administrative Analyst Ross read a letter from ~on Norman represent-
ing Russell Haas, offering to dedicate land across their property for the continua-
tion of First Avenue to Main St. if the City would grade it for an unimproved road.

Mr, Ross was directed to inform Mr. Norman that the Council was not in favor of
such an agreement.
CITY SUED BY UNITED STATES NATIONAL BA~K
City Attorney ~uberg stated that the United States National Bank had sued the
City for a refund of taxes for approximately $25, collected on Safe Deposit boxes.~
It was moved by Councilman Menzel, seconded by Councilman McMains and carried,
that the City Attorney be directed to defend the City in action of the United States
National Bank vs the City.
]j~TIMATED COST FOR FILING BRIEF BEFORE SUPRF. ME COURT
City Attorney Duberg reported that the estimated cost to file a brief before
the United States Supreme Court in Washington would be $400. for the trip to
Washington, and from $250. to $300. for the brief.
