OF THE CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday September 5~ 1961
The Council met in the Council Chambers at the City Hall on the above date at
7:00 P.M. with the following Councilmen present:
Councilmen McMains, McAllister, Smith, Menzel
Absent: Councilman DeGraaf
Also present: Associate Civil Engineer Phillips, City Attorney Duberg, City
Administrator Fulwiler, City Planner Fretz, Associate Civil
Engineer Hughes
Mayor Smith led the pledge of allegiance to the Flag and asked for a moment of prayer.
UBLIC HEARING - Allied Contractors Annexation
This being the time and place, as advertised for a public hearing on the proposed
Allied Contractors Annexation, Mayor Smith declared the hearing open. A letter was
read from United Enterprises, Inc. protesting the annexation. No one in the audience
wishing to be heard either for or against the proposed annexation, the Mayor declared
the hearing closed.
ORDINANCE No. 770 - Approving Allied Contractors Annexation- First reading
It was moved by Councilman McAllister, seconded by Councilman McMains and carried,
that Ordinance No. 770 be placed on its first reading, and that reading of the text
be waived. The motion carried by the following vote, to-wit%

~j~D GALL AUTHORIZED FOR TELEGRAPH CANYON SEWER EXTENSION
At the request of City Administrator Fulwiler, it was moved by Councilman McMains
seconded by Councilman McAllister and carried, that the City Engineer be authorized to
call for bids, on an alternate basis, for the extension of Telegraph Canyon Sewer.
~/zPUBLIC HEARING - 1911 Act - Phase III
This being the time and place as advertised, for a public hearing on the installa-
tion of certain improvements under provisions of the 1911 Block Act to certain properties
on "J" Street, Twin Oaks Avenue and First Avenue, Mayor Smith declared the hearing open.
Mr. Fred Watts, 703 First Avenue objected to the requirement that he pay for 75 feet of
shoulder paving. He stated that the City had in the past installed shoulder paving at
no cost to him. Mayor Smith explained that in a few cases in the past, shoulder paving
had been installed by certain City persomnel without the sanction of the Council, but
that it was not the policy of the Council for the City to foot the entire bill for
shoulder paving. No others wishing to be heard, the Mayor declared the hearing closed.
,The Clerk received no written protests.
Pd~SOLUTION No. 2666 - With respect to hearing under Chapter 27, 1911 Act
Offered by Councilman Mc. Mains, passed, adopted and approved by the following vote,
to-wit:

1911'ACT REPORT - Benekos property
City Attorney Duberg stated that he could find nothing in the statutes which allowed
for an extension of time for an individual to comply with provisions of ~hapter 27 of
the 1911 Act, as requested by W.D. Bracy on behalf of W.A. Benekos. Mr. Bracy was
directed to contact the Engineering Department in order to be appraised of what steps
must now be taken on the proposed improvement of the Benekos property under the 1911 Act.
/~UBLIC HEARING - Appeal to Planning Cormnission Decision Denying Application for
rezoning of Farrel Property at 381 "D" Street
This being the time and place, as advertised, for a public hearing on the appeal
of Eleanor Farrel to the decision of the Planning Commission in denying her a zone
variance from R-1 to R-3, Mayor Smith declared the hearing open. At the request of
Ed Culnan the Mayor continued the hearing until November 7th at 7:00 P.M.
C, A, Yates, 66 Glover Cnu~t. protested continuing the hearing. It was moved by
Councilman MaMains and seconded by Councilman Menzel that action to cpntinue the public
hearing be rescinded and the hearing held at this time. The motion failed to carry
by the following vote, to-wit:

''PE ITION FOR WALKWAY
A petition was submitted from residents on Vallecito Way requesting
~ a walkway for school children on the East side of First Avenue from Vallecito Way
to "J" Street. It was the reco~endation of the Engineering Department that the East
side of First Avenue be graded by the Gity from the back curb to a point five feet
Easterly from Vallecitas Way to "J" Street.
It was moved by Councilman Menzel, seconded by Counci]mm~ McHains and carried, that
the City proceed to cut the walkway as recommended by the Engineering Department.
/APpoINTMENT OF MEMBERS TO SAFETY COUNCIL
Councilman McAllister nominated Richard Sanguinetti for reappointment to the Safety
Council. Councilman MaMains nominated James Hayden and William Sumner for appointment
to the Safety Council. Councilman Menzel nominated Carl Stahlhaber for reappointment
to the Safety Council. It was moved by Councilman McAllister, seconded by Councilman
Mc//ains and carried, that the nominations be closed. A ballot was taken with Richard
Sanguinetti receiving two votes and Mr. Hayden, Mr. Stahlheber, and Mr. Semner each
receiving three votes. Messrs. Stahlheber, Hayden and Sumner were declared to be
elected to serve until June 30, 1965. i'The City Administrator,was directed to write
letters to Henry Jahn and Richard Sanguinetti expressing Council appreciation for thei~
service on the Safety Council,
~ID AWARDED ON "K" STREET CULVERT
Associate Civil Engineer Phillips reported having received thirteen bids on the "K"
Street box culvert, the low bid being that of the Isaac Company in the amount of $8,495.
Mr, Phillips stated that the State license of the Isaac Company was not in order, so it
was the recommendation of the Engineering Department that the next lowest bid in the
amount of $8,840. by Pace Construction Co. be accepted. It was moved by Councilman
McMains, seconded by Councilman MaAllister and carried, that the bid of the Pace
Construction Co. in the amount of $8,840, be accepted.
~///INTRODUCTION VISITING INTERNATIONAL STUDENT OF
Mr. A10'Day introduced Mr. Syed Yunus visiting international student from West
Pakistan who is being sponsored by the Chula Vista Rotary Club.
RESOLUTION No, 2667 - Approving Sewer Repalanent Agreement with TraileRancho
Offered by Councilman McAllister, passed, adopted and approved by the following
vote, to-wit:

RESOLUTION No. 2669 - Approving Conditional Use permit for Church at 626 Hilltop Drive

/~REPORT ON REQUEST FOR DIRECTIONAL SIGN
A letter was read from the Planning Commission recommending that the request of
the Faith Freewill Baptist Church for a directional sign on public property at the
Southeast corner of Fifth Ave. and "C" St. be denied, No action taken,
DATE SET FOR HEARING ON AMENDMENT TO ZONING ORDINANGE
A proposed amendment to the Zoning Ordinance was submitted by the Planning Con%mis-
sion for Council study, October 10th at 7:00 P.M, was set as the time for a public
hearing on the proposed amendment,
ROHR DRAINAGE
A letter was read from Rohr Aircraft calling attention to the Council of
the possibility of their property being ~looded in case of a heavy runoff, and holding
the City responsible if damage from this cause should result, No action taken,
~.~,~EE FOR USE OF EUCALYPTUS PA~K
A letter was read from the Park & Recreation Cuu~ission recommending that
an hourly fee of $3,00 be charged to any group desiring to utilize the lighted field at
Eucalyptus Park other than those activities which are sponsored by the Recreation Dept.
It was moved by Councilman McMains, seconded by Councilman Menzel and carried that the
fee schedule recommended by the Park & Recreation Commission be adopted,
/RECLASSIFICATIO~ OF POLICE CLERK
A letter was read from the Civil Service Gom~ission stating that the
Commission had reclassified the position of Junior Clerk held by Mrs, Frances Stringer
to Intermediate Clerk, The Commission suggested that the change be effective July 11,
1961. It was moved by Councilman McAllister, seconded by Councilman McMains and carried
that Mrs, Stringer be paid as an Intermediate Clerk as of July 11, 1961,
- POSITION OF PLAN CHECKER ESTABLISHED
A letter was read from the Civil Service Con~ission recommending that the
Civil Service Rules be amended by adding a new class, No, A 10, entitled "Plan Ghecker"
at a salary range 29. It was moved by Councilman McAllister, seconded by Gouncilman
Menzel and carried, that the classification of Plan Checker be established as requested
by the Civil Service Commission.
~,.w.~,BEER TAVERR AT 246 Broadway
A letter was read from George N, Lewis Jr. stating that the Beer Bar he
plans on opening at 246 Broadway is not to be of the beatnik type, and invited anyone
disturbed about the type of bar that he planned to open, to discuss the matter with him
in order to clarify any misunderstandings.
/UEST FOR USE OF EUGALYPTUS PARK FOR FIESTA
Dick tassel, President of the or, Chamber of Goumlerce, appealed the decision
of the Park & Recreation Commission to deny tham use of the lower part of Eucalyptus Park
for Fiesta parking purposes, and requested that the Council grant them this permission.
It was moved by Gouncilman McAllister, seconded by Councilman McMains and carried, that
the Jr. Chamber of Co~marce be granted the use of Eucalyptus Park West of the ball
diamond for the parking of cars during the Fiesta. The motion carried by the following
vote, to-wit:

%./~REqUEST FOR PERMISSION TO SELL BEER
Mr. Sam Copeland representing the American Legion, stated that a letter was needed
from the City to permit the Legion to sell beer inside the Legion Hall to the general
public for five days during the Fiesta. It was the desire of the Jr. Chamber of Commerce
to sell beer at one booth on the Fiesta grounds. Mayor Smith requested that both
organizations make an official written request for action at the next meeting,

Councilman Mcldains urged that some thought be given to holding a joint meeting
with the Civil Service Commission.

RESOLUTION No. 2620 - Approving special appropriation of $5000 for Golden Anniversary
Offered by Councilman Smith, passed, adopted and approved by the following vote,
to-wit:
AYES: Councilmen Smith, Menzel, McMains, McAllister
Noes: None
Absent: Gouncilman DeGraaf
~..~INVITATION TO MAYOR OF GENERAL ROCA FOR GOLDEN ANNIVERSARY
A letter was read from the Sister City Gommission suggesting that the Council
might like to extend an invitation to Mayor Gadano of General Roca, Argentina to
attend the Golden Anniversary celebration in Ghula Vista at City expense. If this
idea was not favorable, it was suggested that arrangements be made for a letter to
be written by Mayor Gadano to be read at the Golden Anniversary Council meeting.
The Council, not being favorable to expending too much money for this purpose, suggested
that a letter from Mayor Gadano W be read at a Council meeting during the celebration.
~/~BUS LOADING ZONE REQUESTED
City Administrator Fulwiler read a letter from the Greyhound Bus Gompany
requesting that the Council give further consideration of their request for a bus
loading zone on Third Avenue. The City Administrator was directed to write the
Company that the Council is not in favor of a loading zone on Third Avenue.
~/~.~LOOD CONTROL
The Council expressed approval of City Administrator Fulwiler serving as
Chairman of the Advisory Committee for flood control, unless he finds that it will be
taking up too much of his time.
ADJOURNMENT
Mayor Smith adjourned the meeting at ~:25, sine die.
