HomeMy WebLinkAboutcc min 1961/09/26 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday September 26, 1961 The Countil met in the Council Chambers at City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Menzel Absent: Councilmen DeGraaf, Smith Also present: Principal Civil Engineer Hars~an, City Attorney Duberg, City Administrator Fulwiler, Chief of Police Quinn Mayor Menzel led the pledge of allegiance to the Flag, and asked for a moment of Prayer. STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Council for the adjourned regular meeting of September 26, 1961 ~PUBLIC HEARING - Buford Annexation This being the time and place, as advertised, for a public hearing on the pro- posed Buford Annexation, Mayor Menzel declared the hearing open. No one in the audience wished to be heard either for or against the annexation. There were no written protests received by the Clerk. Civil Engineer Harshman read his report on the request of Mr. Buford that the City take over the operation and maintenance of the Castle Park Junior High School pumping plant, after a solution has been worked out to bring it up to City standards. Mr. Buford stated he was willing to go along with the engineers' recommendation as outlined in the report. It was moved by Councilman McAllister, seconded by Councilman McMains, and carried, that the hearing be continued until October 10th at 7:00 P.M. ORDINANCE No. 771 - Amending No. 505 - Trailer Court fees - second reading Action on this ordinance was held over until October 10th at 7:00 P.Mo ~,~ Ordinance - Approving construction of fall-out shelters in front and side yards- first reading Action on this proposed ordinance was held over until November 7th %/ PROPOSED TRAFFIC ORDINANCE DISCUSSED The Councilmen having had further time to study the proposed traffic ordinance were asked to submit any questions they might have to Police Chief Quinn who was present to answer all questions. Further discussion on the ordinance was put off until the meeting of November 7th. LAW CHANGE ON PAYMENT IN EXTRADITION CASES City Administrator Fulwiler stated that word was received from District Attorney Don Keller, calling attention to the change in the Penal Code, whereby expenses of a city officer designated as a State Agent in extradition cases shall be paid from city funds, the city to be reimbursed by the State Controller at a later date. Mr. Fulwiler recoma,ended the establishment in the Police budget of a rotating fund in the amount of $1000. to take care of such cases. Action was held up until a full Council is present. ATTORNEY REPORT ON REQUEST OF C. E. NORCROSS TO MOVE PLANTS · ity Attorney Duberg stated that the Council can not bind another Council by giving Co ED Norcross advance notice that he will be allowed to remove plants from City right-of-way if and when the City might widen Hilltop Drive. Mr. Norcross had requested that he be given permission to plant rare plants in front of his place at 895 Hilltop Drive, and be allowed to remove them when the street is widened. City Administrator Fulwiler was directed to notify Mr. Norcross of the City Attorney's findings. AUTHORIZATION GIVEN TO ATTEND LEAGUE CONFERENCE It was moved by Councilman MeMains, seconded by Council=mn McAllister and carried, that the following be authorized to attend the League of California Cities Conference in San Francisco: Councilmen DeGraaf, McAllister, Menzel, McMains; Planning Commissioners Stewart, Adams, Guyer, Stevenson, Weakland, and Planning Director Fretz; also Sister City Co~nissioner Spencer Menzel, City Administrator Fulwiler, City Finance Officer Grant, and City Attorney Duberge ~.w~REcREATION DIRECTOR AUTHORIZED TO ATTEND CONFERENCE It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that Recreation Director Jasinek be authorized to attend the League of California Cities Conference in San Francisco, and that the Finance Officer be directed to transfer sufficient funds necessary for the trip in accordance with provisions set forth in Resolution No. 2624. ~-~/~XPENSE ACCOUNT FOR LEAGUE CONFERENCE It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that each person authorized to attend the League Conference be allowed an expense account not to exceed $150. NAME FOR EAST NAPLES PARK-SCHOOL APPROVED It was moved by Councilman Mc. Mains, seconded by Councilman McAllister and carried, that the name "Gregg Rogers Park and School" be approved, as recommended by the Park and Recreation Commission, for the Park-School on East Naples Street. SFJ~LL BOAT LAUNCHING RAMP A letter was read from the Harbor Go~uission reco~nendir~g that the Council direct the Engineering personnel to proceed with the preparation a~ plans and specifications for a small boat launching facility. It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that the recommendations of the Harbor Co~mission be approved, and the Engineering Department directed to submit their plans when completed. DATE SET FOR CLEAN-UP WEEK Mrs. Bergman, member of the Conservation & Litter Committee of the Ghula Vista Garden Club stated that the Club has taken on a city clean-up project in anticipation of the c%~y's Golden Anniversary celebration. She asked that a date be set for clean-up week and the use of two or more trucks for use with Boy Scouts who planned on cleaning off vacant lots and parkings. It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that October 7th through the 14th be designated as clean-up week, and that the City Administrator be authorized to handle the details pertaining to use of any City equipment and personnel. REPORT ON AMBULANCE SERVICE FEES City Administrator Fulwiler, in reporting on the subsidy of $3.50 per call which the City pays the local ambulance service for each call made in response to a request for service by the Police Department, stated that Chula Vista and San Diego were the only agancies in the area which pay such a subsidy. Councilman Smith, at a previous ~eeting nad questioned the obligation of the City to pay the subsidy, when the persons picked up also were charged and paid a fee° City Administrator Fulwiler stated that due to the fact that the ambulance service is available to the City on a 24-hour basis, seven days per week, the fee is perhaps justified. The Council took no action. ~'6~STER CITY PLAQUE City Administrator Fulwiler presented for Council approval, the plaque that has been prepared by the Sister City Commission to send to our Sister City, General Roca, Argentina° The Council expressed approval of the plaque. SPECIAL COUNSEL APPROVED FOR 1911 ACT PROCEEDINGS At the request of City Attorney Duberg, it was moved by Councilman McMains, seconded by Councilman McAllister and carried, that the law firm of O'Melveny & Myers be retained as Special Counsel for 1911 Act proceedings. ADJOURNMENT Mayor Menzel adjourned the meeting at 8:40 PoMo until October 3rd at 7:00 P.M. City Clerk
