HomeMy WebLinkAboutcc min 1961/11/14 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday November 14, 1961 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McAllister, Menzel, DeGraaf, Smith Absent: Councilman McMains Also present: City Engineer Cole, City Attorney Duberg, City Administrator Fulwiler, City Planner Fretz, Chief of Police Quinn, Chief Building Inspector Grady Mayor Menzel led the pledge of allegiance to the Flag, and asked for a moment of prayer. APPROVAL OF COUNCIL MINUTES It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the Minutes f~r the meetings of October 10, 17, 31, and November 7th be approved copies ha~img~been sent to each Councilman. RESOLUTION No. 2699 - Determining that it is necessary that certain sewers be constructed ..... in Telegraph Canyon, Hilltop Drive, and "J" Street ~ffered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzel, DeG~aaf Noes: None Councilman McMains Absent: 'l TELEGRAPH CANYON TRUNK SEWER City Engineer Cole stated that due to a misunderstanding, the initial cost per acre for future connections to the Telegraph Canyon trunk sewer for additional engineer- ing and incidental costs should be $203.00 instead of $200.00 as set forth in the agreement. Total cost to Bollenbacher & Kelton would now be $89,579.84 and the City share $76,937.16. Mr. Ray Swaner, representing Bollenbacher & Kelton, approved this change and the City Attorney was directed to incorporate the change into the agreement. RESOLUTION No. 2700- Determining the amount of money certain parcels of property shall pay prior to connecting to sewer in portions of Telegraph Canyom Road, Hilltop Drive and "J" Street Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, Smith, McAllister, Menzel Noes: None Absent: Councilman McMains RESOLUTION No. 2701- Approving the execution of a certain joint powers agreement ~ of 1961 between Otay Municipal Water District and the City Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzet, DeGraaf Noes: None Absent: Councilman McMains AWARDING BID ON TmLEGRAPH CANYON TRUNK SEWER City Engineer Cole reported fifteen bids were received for construction of the Telegraph Canyon Trunk Sewer, the low bid being that of the V.R. Dennis Construction Co. in the amount of $166,517.50. It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the low bid of V.R. Dennis Constructiom Co. be accepted. RESOLUTION No. 2702 - Rescinding Resolution No. 2635 ordering report under special assessment Act - Parking Oistrict No. 1 Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzel, DeGraaf Noes: None Absent: Councilmen McMains RESOLUTION No. 2703- Ordering report under special assessment Act-Parking District 1 Offered by Councilman McAllister, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McAllister, Menzel, DeGraaf, Smith Noes: None Absent: Councilman McMains AIRPORT STUDY CONSULTANT APPROVED City Administrator Fulwiler stated that after conferring with Mr. DeSilva, Consultant hired by the Council to advise them with regard to the acquisition and operation of Brown Field, it was ascertained that another consultant was needed to study the civil utilization and the extent of the City's interest in Brown Field. Mr. Fulwiler stated that Leigh Fisher Association, Inc. submitted a proposal to make the study for a retainer fee of $150. per month, the total amount not to exceed $7,200. City Attorney Duberg stated there were certain terms in the Fisher proposal which he would like clarified before acceptance by the Council. It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that the City Attorney be directed to negotiate an agreement with Leigh Fisher Assn. Inc. as Consultants on acquisition of Brown Field, within the amount quoted. Don Sparling, on behalf of the Mayor's Airport Committee, thanked the Council for action taken, and attempted to clarify certain terms of the Fisher proposal. RESOLUTION No, 2704- Giving notice of proposed Start Annexation Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzel, OeGraaf Noes: None Absent: Councilman McMains Mr. Joel Walton and Jerry Torrance, representing the Sweetwater Valley Civic Association, expressed concern over zoning of the Start Annexation, but were not opposed to the Annexation. 7:45 P.M.. Councilman Smith was excused from the meeting at this time. CIVIL SERVICE RECOMMENDATION APPROVED Upon recommendation of the Civil Service Cozmmission, it was moved by Councilman DeGraaf seconded by Councilman McAllister and carried, that Section 12 of Rule 2, Amended Classification and Compensation Plan, as further amended effective November 1, 1961, be approved. RESOLUTION No. 2705- Authorizing City Administrator to apply for Public Law Funds Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,McAllister,Menzel Noes: None Absent: Councilmen McMains, Smith ORDINANCE NO. 775- Amending Sections of the Code relating to Sales & Use Tax- Second reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 775 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Menzel Noes: None Absent: Councilmen McMains, Smith -2- PROPOSED ORDINANCES REVIEWED BY BUILDING INB~ECTOR Chief Building Inspector Grady reviewed proposed changes in the Code pertaining to the Uniform Building Code, Plumbing Code, Housing Code and Mobilehomes & Trailer Parks. ORDINANCE No. 776- Amend£ng oertain sections of City Code pertaining to Trailer Parks- first reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 776 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Menzel Noes: None Absent: Councilmen McMains, Smith ORDINANCE No. 777- Adopting by reference the Uniform Housing Code- first reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 777 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Menzel Noes: None Absent: Coudcilmen McMains, Smith ORDINANCE No. 778- Amending certain sections of the City Code concerning erection of buildings and adoption by reference of the Uniform Building Code, 1961 edition- first reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 778 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Menzel Noes: None Absent: Councilmen McMains, Smith ORDINANCE No. 779- Amending certain sections of City Code concerning Plumbing and adoption by reference of the Uniform Plumbing Code,1958 edition-first reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 779 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Menzel Noes: None Absent: Councilmen McMains, Smith ~//TRAFFIC ORDINANCE REVIEWED Chief of Police Quinn reviewed changes made to the proposed traffic Ordinance brought about by the new vehicle Code. No action taken. EXTENSION OF TIME ON TIDELANDS LEASE GRANTED Upon the recommendation of Administrative Analyst Ross, it was moved by Council~n DeGraaf, seconded by Councilman McAllister and carried, that ~ames T. Loob be granted a thirty day extension to his tideland use permit for one-half acre located at the Southwest corner of the new seventy-five acre tideland fill. ~RGING COUNCIL TO WORK FOR DOWNTOWN AREA A letter was read from J. Jessop & Sons stating that they are not going to protest the establishment of a parking district in the down- town area, and also urgimg the Council to devote every possible effort to the bettering of the downtown business district. F//LETTER A letter was read from the Chula Vista Ministers' Assn commending OF COMMENDATION the Council on their stand and victory against further liquor licenses being issued in Chula Vista. ,//~qUEST TO ~ONNECT SCHOOL ADMINISTRATION BUILDING TO SEWER City Administrator Fulwiler stated that he has a request from Mr. Rindone requesting permission to connect the Sweetwater Union High School Administration building to the Naples Street Sewer. Action was held over one week so all Councilmen could be present. ~//REqUEST City Administrator Fulwiler stated that the Safety FOR REDUCTION IN SPEED LIMIT Council has recommended that the speed limit be reduced from 65 miles per hour to 35 miles per hour on Telegraph Canyon Road, and that the County be asked to cut the speed limit on the road within the County area. Councilman DeGraaf questioned the need for a reduction in the speed limit rate at this time. ~ITY GAR POOL Mr. John Murphy, 569 Parkway, asked how many City employees were driving City cars home, and if the City had a car pool. City Administrator Fulwiler explained that fifteen employees, on call at all times, presently were driving City cars to and from work. He stated that the City did not have a car pool. BOMB SHELTERS Mr. John Murphy asked how far the City has gone on the matter of bomb shelters. City Administrator Fulwiler explained that the City has no present plans for bomb shelters, but is a member of the Unified Civil Defense District. ~WIDENING OF "G" STREET WES.T OF BAY BLVD. Councilman DeGraaf asked what progress has been made in the proposed widening of "G" Street West from Bay Blvd. to the tidelands. Administrative Analyst Ross stated that the project was now in the planning stage. BURNING OF WEEDS IN CITY ~F/ Councilman DeGraaf asked what service the Fire Department gives, if any, to the burning of weeds from properties within the City. City Administrator Fulwiler explained that the Fire Marshal does inspect and post properties where a fire hazard exists, and that we offer stand-by service by the Fire Department when someone wishes to burn the weeds from their property. ADJOURNMENT Mayor Menzel adjourned the meeting at 9:15 P.M. until November 21st at 7:00 P.M. City Clerk
