OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held Tuesday November 21, 1961
An adjourned regular meeting of the City Council of the City of Chula Vista was held
at 7:00 P.M. on the above date, with the following Councilmen present:
Councilmen McMains, McAllister, Menzel, Smith, DeGraaf
Absent: None
Also present: City Engineer Cole, City Attorney Duberg, City Administrator
Fulwiler, City Planner Fretz, Administrative Analyst Ross,
City Building Inspector Grady
Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of prayer.
~UBLIC HEARING - Protest hearing on proposed Edgemere Annexation
Mayor Menzel advised those present that the hearing on the proposed Edgemere
Annexation could not be held at this time as the notice giving the date of hearing did
not state that the area, if annexed, would become a part of the Chula Vista City School
District. The Mayor announced that the time for the hearing is therefore extended to
December 12, 1961.
RESOLUTION No. 2706 - Rescinding Resolution No. 2691 and setting date for hearing
(Edgemere Annexation)
Offered by Councilman Smith, passed, adopted and approved by the following vote,
to-wit:
AYES: Councilmen Smith, McMains, McAllister, Menzel, DeGraaf
Noes: None
Absent: None
SAFETY OOUNCIL RECOMMENDATIONS
A letter was read from the Safety Council recommending that traffic signals be
installed at Broadway and "D" Street and that a one-way traffic pattern on East Naples
Street between Nacion Avenue and Monserate Avenue be adopted.
A letter was read from the City School District endorsing the Safety Council's
recommendation for traffic signals at Broadway and "D" Street.
Mrs. Paul Leffert and W. J. Higgin spoke in favor of a traffic signal at Broad-
way and "D" Street.
The Administrative Officer was directed to have a traffic count taken to deter-
mine if the traffic signals could be installed with the use of gas tax funds and make
his recommendations at the meeting of December 12th, 1961.
The recommendation for one-way traffic on East Naples Street was referred to the
City Engineer and Administrative Officer for recommendations at the meeting of December
12th, 1961.
PLANNING CO~IISSION RECOMMENDATIONS ON CONDITIONAL USE PERMIT (Thriftimart sign)
A letter was read from the Planning Commission recommending approval of the
Thriftimart application for a conditional use permit to construct a sign 150 square
feet in area on property on the east side of Third Avenue, so~th of "K" Street.
RESOLUTION NO. 2707 - Approving Planning Commission action in granting conditional
use permit to Thriftimart, Incorporated
Offered by Councilman McHains, passed, adopted and approved by the following
vote, to-wit:
AYES: Councilmen McMains, McAllister, Menzel, DeGraaf, Smith

Absent: None
~PPOINTMENT OF MEMBER TO PLANNING COMMISSION
Councilman McMains nominated Sam Piety for appointment to the Planning Conm~ission.
Councilm~n DeGraaf nominated Ross Willhite for appointment to the Planning Commission.
Councilman McAllister nominated C. C. Alley and Hal Morgan for appointment to the Plan-
ning Co~mission. There being no other nominations, it was moved by Councilman DeGraaf,
seconded by Councilman McAllister, and carried, that the nominations be closed. A first
ballot resulted in a tie vote for Mr. Piety and Mr. Willhiteo A second ballot gave Mr.
Willhite a majority vote.
It was moved by Councilman DeGraaf, seconded by Councilman McAllieter, and carried,
that Mr. Ross M. Willhite be appointed a member of the Planning Commission for a four-
year term, said term to expire June 30, 1965.
RESOLUTION No. 2708 - Approving agreement with Leigh Fisher for Brown Field Study~
Offered by Councilman DeGraaf, providing the agreement meets with the approval~?t'i~~~
of the City Attorney, passed, adopted and approved by the ~ollowing vote, to-wit:

RESOLUTION No. 2710 - Accepting lien in lieu of public improvements (Walnut Avenue)

ORDINANCE No. 775 - Amending sections of code pertaining to sales and use tax -
second reading
It was moved by Councilman OeGraaf, seconded by Councilman Smith, and carried,
that Ordinance No. 775 be placed on its second reading, that reading of the text be
waived and the ordinance &dopted. The motion carried by ~he following vote, to-wit:

ORDINANCE No. 777 - Adopting by reference the Uniform Housing Code - second reading
It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and
carried, that Ordinance No. 777 be placed on its second reading, that reading of the
text be waived and the ordinance adopted. The motion carried by the following vote,
to-wit:

ORDINANCE No. 778 - Amending certain sections of the City Code concerning erection of
buildings and adoption by reference of the Uniform Building Code -
1961 edition - second reading
It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and
carried, that Ordinance No. 778 be placed on its second reading, that reading of the
text be waived and the ordinance adopted. The motion carried by the following vote,

ORDINANCE No. 771 - Amending business license ordinance to include trailer court fees -

that Ordinance No. 771 be placed on its second reading, that reading of the text be

The Administrative Officer was directed to have a survey made to determine what
other cities are charging in the way of trailer park fees and report back to the Council
with the understanding that the ordinance just adopted is subject to be changed at a
later date.
~/SCHOOL DISTRICT REQUEST TO CONNECT TO CITY SEWER
Administrative Officer Fulwiler stated he had received a letter from the Super-
intendent of the Sweetwater Union High School District requesting that the District be
permitted to connect their Administration building, which is outside the City limits,
to the City sewer. The Council suggested that the Administrative Officer report to the
District that the Council looks with favor upon their connecting to the City sewer but
because of possible legal complications would advise that they first look into the possi-
bility of annexing to the City.
RESOLUTION No. 2712 - Authorizing the execution of joint petition to include City property
in the South Bay Irrigation District
Offered by Councilman Smith, passed, adopted and approved by the following vote,
to-wit:

OVAL GIVEN TO PARTICIPATION IN GRADING CONTRACT
It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried,
that the Council approve participation of the City in the grading of the School-Park
site to the amount of thirty-five percent (35%) of the cost, the actual agreement to
be drafted and presented for approval at a later date.
~,SAN DIEGO COUNTY TRAFFIC SAFETY COUNCIL REQUEST FOR FUNDS
Administrative Officer Fulwiler stated a request had been received from the San
Diego County Traffic Safety Council requesting that the City participate in this year's
program and contribute $400. The Council suggested that a study be made to determine
just what benefits the City receives from participating in the Safety Council.

CALL FOR BIDS AUTHORIZED ON LIBRARY LIGHTING
It was moved by Councilman McAllister, seconded by Councilman DeGraaf, and carried,
that the City Engineer be authorized to call for bids at the prevailing minimum wage
scale for the library lighting.
~ USE OF CITY CARS
Mr. John Murphy asked for a clarification on the use of City cars by employees and
why certain employees were permitted to take cars home at night. It was pointed out to
Mr. Murphy again that employees on call twenty-four hours a day were permitted to take
city cars home.
IPS IN STREETS
Mr. John Murphy asked if something could be done about the sharp dips in the streets
at certain intersections throughout the City. He specifically mentioned the dip at
Broadway and Parkway. It was suggested by the Council that t~e City Engineer make a
study to determine what can be done to eliminate some of the more hazardous dips in the
City streets.
~/,,MEETING WITH LIBRARY BOARD
The Council met informally with Mrs. Don Chase and Mr.~John Hallman, members of
the Library Board. The problems at hand were discussed and reco~m%ended suggestions to
be considered were listed.
Administrative Officer Fulwiler was asked to provide the suggested rec~endations
to the Library Board and a~k the Board to try to work them into their library policies.
Xhe Board was asked to submit to the Council the policies and procedures now followed at
the library.
ADJOURNMENT
Mayor Menzel adjourned the meeting at 10:00 P.M. until November 28~ 1961 at
7:00 P.M.
