OF THE CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday January 30, 1962
An adjourned regular meeting of the Cig:/ Council of the City of Chula Vista
was held at 7:00 P.M. in the Civic Center on the above date with the following
Councilmen present: Councilmen McAllister, McMains, Smith, OeGraaf
Absent: Councilman Menzel
Also present: City Engineer Cole, City Attorney Duberg, City Administrator
Fulwiler, Principal Civil Engineer Harshman, County Supervisors
DeGraff Austin and Robert Dent, Dave Bird, Frank Gibson.
In the absence of Mayor Menzel, Mayor pro-rem McMains presided.
Mayor pro-rem McMains led the pledge of allegiance to the Flag, and asked for a
moment of prayer.
STATEMENT: The City Clerk hereby states that he did post within 24 hours
of adjournment, as provided by law, the order of adjourment
of the City Council for the adjourned regular meeting of
January 30, 1962.
v/~iscussION THE SPRING VALLEY SANITATION DISTRICT
ON
PROPOSED
AGREEMENT
WITH
Attorney Robert Berrey, County Counsel, introduced members of the Board of
Supervisors and others present, and reviewed the problems with respect to the Spring
Valley sanitation. Maps were submitted showing the areas the proposed Spring Valley
District sewer is designed to serve.
A proposed agreement between the City and Spring Valley Sanitation District had
been submitted to the Council, outlining conditions under which the City would permit
the District to construct and maintain a sewer outfall through the City. Attorney
Berrey requested that the proposed agreement be modified so that the District would
be permitted to serve any territory in the Sweetwater Basin which has formed a
sanitation district, or incorporated, provided that agency has reserved rights in
the Metropolitan Sewer.
Councilman Smith emphasized that the City has not contracted with San Diego for
capacity in the Metropolitan Sewer with the sole idea that an area must annex to the
City before being permitted sewer service. He pointed out that the agreement
specifically states that other agencies, districts or municipalities may acquire
capacity rights from the City of Chula Vista, and would not necessarily have to annex
to do SOo
City Attorney Duberg and County Counsel Berrey were excused to redraft the
proposed agreement which was resubmitted for Council approval.
It was moved by Councilman McAllister, seconded by Councilman Smith, and carried
that the amended agreement be accepted, with the deletion of the line pertaining to
that portion annexed to the City of National City.
The agreement was officially approved by Council Resolution No. 2747, adopted
by the City Council at their meeting of January 2, 1962.
