OF THE CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday February 20, 1962
An adjoured regular meeting of the City Council of the City of Chula Vista was held
at 7:00 P.N. on the above date with the following Councilmen present:
Councilmen Mcliains, Menzel, Smith, DeCraaf
Absent: Councilman McAllister
Also present: City Engineer Cole, City Attorney Duberg, City Administrator Fulwtler,
Administrative Analyst Ross
Hayor Henzel led the pledge of allegiance to the Flag and asked for a moment of prayer.
STATEMENT: The City Clerk hereby states that he did post within 24 hours of
adjournment, as provided by law, the order o£ adjournment of the
City Council for the adjourned regular meeting of February 20, 1962.
DISCUSSION O~ LIBRARY BOARD POLICY
Copies of the proposed policy statement for the Public Library as submitted by the
Library Board was reviewed by the Council. It was moved by Councilman Smith, seconded
by Councilman DeGraaf and carried, that the line "In no case should any book be excluded
because of the race or nationality, or the political or religious views of the ~riter"
be stricken from the statement.
it was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that
the line "The Library will cooperate with other co0ununity agencies etc." be changed to
"The Library may cooperate etc."
Upon the request of the City Attorney, it was moved by Councilman Smith, seconded
by Councilman HcNains and carried, that the policy statement be referred to the City
Attorney for study and recommendations.
~//RE~UEST FOR APPROPRIATION FOR TIDELANDS FILL SOIL TESTS
City Engineer Cole stated that in order to prepare a time table for installation of
public improvements on the seventy-five acre tideland~ fill, as requested by the Harbor
Comission, it would be necessary to first conduct a soils investigation. Hr. Cole
stated that the estimated cost of such an investigation is $4,000 and recommended that
this amount be appropriated. The Council was of the opinion soil tests on the tidelands
at this time would be premature, it was suggested that the City Engineer might be able
to obtain some historical infoz~ation from National City on their tidelands fill
experiences. It was moved by Councilman Smith, seconded by Councilman DeGraaf and
carried, that no action be taken at this time.
RESOLUTION No. 277~ Approving Electrical Easement to San Diego Gas & Electric Company
Offered by Codncilman DeGraaf, passed, adopted and approved by the following vote,
to=wit:
AYES: Councilmen Degraaf, McMains, Menzel, Smith
Noes: None
Absent: Councilman McAllister
RESOLUTION No. 2777- Giving notice and setting hearing date -1911 Act- Phase VI
Offered by Councilman Smith, passed, adopted and approved by the following vote,
to-wit:
AYES: Councilmen Smith, DeGraaf, HcHains, Menzel
Noes: None
Absent: Councilman McAllister
ORDINANCE No. ?89 - Approving Hilltop Drive Annexation- second reading
It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that
Ordinance No. 789 be placed on its second reading; that reading of the text be waived
and the Ordinance adopted. Tae motion carried by the following vote, to-wit:
AYES: Councilmen DeGraaf, McHains, Menzel, Smith
Noes: None
Absent: Councilman McAllister
ORDINANCE No. 790- Approving Castle Park High School Annexation- second reading
It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that
Ordinance No. 790 be placed on its second reading; that reading of the text be waived
and the Ordinance adopted. The motion carried by the following vote, to-wit:
AYES: Councilmen DeGraaf, Mcliains, Menzel, Smith
Noes: None
Absent: Councilman HcAllister
ORDINANCE No. 791- Authorizing the submission of certain propositions to the Voters
It was moved by Councilman Smith, seconded by Council~an DeGraaf and carried, that
Ordinance No. 791 be placed on its first reading and adopted (Election ordinance)
The motion carried by the following vote, to-wit:
AYES: Councilmen Smith, DeGraaf, HcHains, Henzel
Noes: None
Absent: Councilman NcAllister
~,~'BUSINESS LICENSE FEE WAIVED
City Attorney Duberg stated that in his opinion the license fee for the Nission of
Hope for a Thrift Store at 949 Broadway should be waived, in view of the fact a similar
venture in the City has been granted that courtesy.
It was moved by Councilman Smith, seconded by Councilman HcHains and carried, that
the business license for the Thrift Store at 949~Broadway and to be operated by the
Hission of Hope, be waived, liayor Nenzal stated that the Hission of Hope sheuld furnish
the City with so~e proof that the store is b, ing operated for charity.
i~UEST FOR NODIFICATION OF ORDINANCE No. 670 (Fencing of Swimming Pools)
A letter was reed from Attorney H. J. Solomon~ representing the Winicki Invest~ment
Company, requesting that provisions of ordinance No. 670 be modified, as it ~ould apply
to the fencing of the swiping pool at 580 "G" Street. City Administra~or Fulwiler read
a letter from Building Inspector Grady recommending that the request be denied.
It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that
the request be denied.
Hr. Gene Redlich stated that it was impossible to build a fence around the pool
the way it was located in the area. Hr. Redlich was told to meet with the Building
Inspector ~ho ~ould inform him how he would be able to comply with provisions of
Ordinance No. 670.
~E~gEST TO MOVE STORE BUILDING
A letter was read from J. D. Peters requesting permission to move a store building
from National City to Hadrona Street in the 300 block in Chula Vista. City Ad~inistrator
Fulwiler read a letter from the Building Inspector listing require~ents necessary to
bring the building up to standard. The request was referred to the Planning Co~issio~
for study as to compatibility to the area and recommendations.
L/'~qUEST FO~ LEASE A~E~D~ESr
A letter ~as read from Rohr Corp. requesting that their tidelands agreement of
Hatch 20~ 1959, be a~ended to add 1.418 acres leased in 1945 as a second parcet to be
covered by said lease as of Hatch 1, 1964. The request was referred to the Harbor
Co~isaion.
LAST DATE FOR FILIHGARGUMENTS FOR OR AGAINST PROPOSITIONS
The City Clerk set Hatch 2nd as the last day that he may accept arguments for or
a~ainst the propositions to go on the ballot for the April 10th Hunicipal Election.
qUEST FOR PAPEH BACK EOOKS
Jim Leone, student at Hilltop High School, spoke in favor of having a supply of
paper back books on sale at the public Library for the convenience of students, liayor
Henzel stated that downtown merchants have stated that they will keep on hand a supply
of the books that are in demand.*
