Smith, DeGraaf Absent: None Also present: li~y Engineer Cole, City Attorney Duberg, City Administrator Fulwiler, Administrative Analyst Ross, Associate Civil Engineer Hughes Hayor Henzel led the pledge of allegiance to the Flag and asked for a moment of prayer STATENENT: The City Clerk hereby states that he did post within 24 hours of adJouroment, as provided by law, the order of adJouroment of the City Council for the adjourned regular meeting of February 27, 1962 ~i~BLIC NEARIHG - Chapter 27, 1911 Act I~provement - Phase IV This being the time and place, as advertised, for a public hearing on Phase IV of Chapter 27, 1911 Act improvoments, Hayor Henzel declared the hearing open. No one in the audie'nce wishing to be heard either for or against the proposed i~prove- merits the Mayor declared the hearing closed. A letter was read from Hr. Joseph Baker, 541Hclntosh Street, asking that he be granted & six month extension of time in ~d~ich to install improve~ents in front of his property. City Administrator iulwiler explained that in the past, the City has financed improvements in hardship cases, end placed a lien on the property to guarantee repayment to the City. RESOLUTION No. 2782 - With respect to hearing under Chapter 27, 1911 Act Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Mcltains, McAllister, Menzel Noes: None Absent: None RESOLUTION No. 2778- Giving notice of proposed Valley Annexation Offered by Councilman DeGraaf, passed, adopted and apprdved by the following vote, to-wit: AYES: Councilmen DeGraaf, McNains, McAllister, Menzel, Smith Noes: None Absent: Hone RESOLUTION No. 2779- Giving notice of propesed Aland Annexation Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, NcMains, NcAllister, Henzel Noes: None Absent: None RESOLUTIO~ No. 2780- Adopting and sub~itting a budget for State allocated Funds- (Engineering) Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, McHains, McAllister, Menzel, Smith Noes: None Absent: None RESOLUTIOH No. 2781- Approving special appropriation of $2,350 for Radio Equipment Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, HcMains, HcAllister, Henzel Noes: None Absent: None RESOLUTION No. 2783 - Regarding relocating of U.S.Naval Housing dwellings Offered by Conncil~an McN~ins, passed, adopted and approved by the following vote~ to-wit: AYF~: Councilmen McM~ins, McAllister, Menzel, Smith, DeGraaf Noes: None Absent: None ~?REqUEST FOR RI/ZONING A letter was read from the Seaview Property Ovners Assn. asking that the Council express their feelings either for or against a proposal to rezone the North side of East Naples Street~ between Nation Avenue and Monserate Street, to R-3 and the South side of the same street to C-IP. The City Attorney stated that according to the code, a request of this type~ would have to first be presented to the Planning Co~ission. The letter wes referred to the Planning Co~ission. ~L~TTER OF ENDORSEMENT A letter was read from the Womans Society Christian Service o£ the First Methodist Church endorsing the action of the Council as to the selling or usage of Alcoholic Beverages in or about our City Parks and Recreational areas. ~ROTEST TO LIQUOR LICENSE A copy of a letter sent to the Dept. of Alcoholic Beverages Control from the Chula Vista Church of Christ was read. The letter protested the issuance of a license for a liquor store at 231 Fourth Avenue. Dr. Lloyd Ellis of the Church of Christ, asked that the Council support their protest to the Alcoholic Beverage Control Board. It was moved by Councilman NcNains~ seconded by Councilm~n Smith and carried~ that the Council go on record as being opposed to a liquor store at 231 Fourth Ave. and that the City Attorney check to see if the promises were legally posted~ and take the necessary steps to make known the Council's opposition. V/PARKING PROBLElt ON ARIZONA STREET Mr. James Bailey stated that Arizona Street East of Broadway is a twenty foot easoment, a~d is constantly blocked by patrons of Value Village who park in the easoment. The matter was referred to City Administrator Fulwiler for investigation. Mr. Niek Slijk, N~nager oi the Chamber of Co~aerce, announced that there would be a meeting and lecture on Urban Affairs at 8:00 P.M. on March let in the Council Chambers. ~.~$TUD¥ ON ALLEY Ii~ROVEHENTAUTHORIZED It was moved by Councilman McHains, seconded by Councilman Smith and carried, that the staff make a study and recoa~aendattons to the Council en the most feasible way to improve the alleys in the City. ~/SALE OF NEWSPAPERS qUESTIONeD Councilman NcMains questioned the legality of newspapers being dispensed from coin operated machines chained to light posts, when shops on the Avenue must pay a business license to sell newspapers and also a license for coin operated coke machines. City Attorney stated that this matter has been referred to him and is now under investigation. , COUNTY REQUEST FOR THREE-FOURTHS OF LIQUOR LICENSE REVENUE OPPOSED It was moved by Councilman McPlains, seconded by Councilman Smith and carried, that the City Administrator contact our legislators and express the Council's opposi- tion to the County's request to the Governor and members of the Legislature for three-four$~I' (3/4) of the liquor license revenue now allocated to the cities, and also to notify u~ when the matter comes up in Committee. MAINTEHANCE OF RAILROAD CROSSING PROTECTIVE DEVICES It was moved by Councilman Smith, seconded by Councilman Mclialns and carried, that the City Administrator contact the President of the Public Utilities Commission and express the Council's objection to a requirement which would require the City to pay the maintenance costs of railroad crossin~ protective devices. -2- ~,/LIBRARY POLICY City Attorney Duberg suggested that the Library Board meet with him and together they will redraft the Library policy for presentation to the Council for approval.
