HomeMy WebLinkAboutcc min 1962/03/20 MINUTES OF AB ADJOURNED REGULAR HEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday Hatch 20, 1962 An Adjourned regular meeting of the City Council of the City of Chula Vista, California was held at 7:00 P.I4. on the above date, with the following Councilman present: Councilmen McMains, McAllister, Menzel, Smith, DeGraaf Absent: Councilmen - None Also present: City Engineer Cole, City Attorney Duber$, City Administrator Fulwiler, Administrative Analyst Ross, City Planner Frets, Associate Civil Engineer Hughes Mayor Nenzel led the pledge of allegiance to the Flag and asked for a moment of prayer. STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adJourraaent of the City Council for the regular meeting of March 20, 1962. ~I~BLIC HEARING (continued) Phase V, Chapter 27, 1911 Act This being the time and place designated for the continuation of a public hearing on Phase V, Chapter 27 of the 1911 Act, Mayor Henzel declared the hearing open. Associate Civil Engineer Hughes presented slides on the different sections of Phase V where protests have been made by property o~ners. }ir. W.G. Long again asked that his property be deleted from the proceedings because of a portion of his property being condemned by the Spring Valley Sanitation District for sewer purposes. The Council questioned the location, of the proposed sewer, and asked that plats be brought to the next meeting showing the location of the sewer. The public' he~itng on the Woodla~n Avenue block of Phase V was continued until Hatch 2?th at 7:00 P.N. Hr. Hughes explained that the monolithic curb and sidewalk requested by Hr. Paine on the "G" Street side of his property at 398 Broadway would necessitate the removal of several large pepper trees. Object of the monolithic curb was for more parking on public right of way which the attornies have ruled is illegal. Hr. Gale Fick stated that most of the residents of his trailer court on "G" Street used the Broadway entrance. Hr. Ed Culnan requested that careful consideration be given before permis- sion is given to remove' any Pepper trees. No others wishing to be heard on this block of Phase V, the Mayor declared the hearing closed. RESOLUTION....No. 2788- With respect to hearing on Phase V, "G" Street block Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, McMains, McAllister, Menzel Noes: None Absent: None Mr. Hughes showed the plat on Phase V dealing with Flower Street between Jefferson Avenue and Oakla~n Avenue, North side. Hrs. goerke,Jr, esked for a clarification of the financing for the improvements proposed in front of her property. It Was explained that if she wes not able to finance the improvements, a lien would be placed against her property and paid off at the time of sale. No others wishing to be heard on this block of Phase V, the Mayor declared the hearing closed. RESOLUTION Ho~ 2789 - With respect to hearing on Phase V, Flower Street block Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, McMains, McAllister, Menzel Noes: None Absent: None Mr. Hughes showed the plat on Phase V dealing with "F" Street from First Avenue to Hilltop Drive, North side. No one wishing to be heard on this block of Phase V, the Mayor declared the hearing closed. RESOLUTION No. 2790 - With respect W hearing on Phase V, "F" Street block Offered by Councilmen Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, HcAllister, Menzel Noes: Councilman DeGraaf Absent: None Councilman McAllister was excused from the meeting at 7:55 P.M. RESOLUTION No. 2791 - With respect to hearing on Phase V, remaining properties Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraa£, McMains, Menzel Noes: None Absent: Councilman McAllister qlSCUSSION ON SHOULDER PAVING - 700 Block on Church Avenue MU. J. D. Perkins, spokesman for property owners on Church Avenue between "J" Street and Kearney Street stated that the property owners objected to being charged for shoulder paving proposed for the street ~hen they were told at the time they purchased their properties that the street had been paid for. Mrs. Hester Stockton, Elizabeth Harmstea~ end Everett Bonnet were all of the opinion that their properties participated in the cost of paving the street years ago. Councilman ~mith stated that there was no record in the City that showed that property owners on that street participated in the surfacing of the street at any time. The Council indicated that if the property owners would deposit the nominal fee required for shoulder paving materials, the City would be able to go in and completely resurface the entire streat to City specifications. PORT ON "F" ST~ET RAILROAD TRACKS City Engineer Cole reviewed his written reco~endations on the most feasibile approach to the abandooment of the railroad facilities in "F" Street. Mr. Barker, Supt. of the San Diego & Arizona Eastern Railway stated that it was their desire to remove only the rails on "F" Street East of Guava, leaving the ties in the street. Otherwise he wes in mccord with Mr. Cole's recommendations. The Council was agreeable to leaving the tiez in the street. It wa~ moved by Councilman Smith, seconded by Councilman Mctiains and carried, that the Engineer's recommendations be accepted as amended. y CHANGES IN ~ODE ~ERING DRIVEWAY CONSTRUCTION REC(H%iENDED City Engineer Cole reviewed his written recommendations on proposed changes in the code covering the construction of driveways in the City. The City Attorney was directed to draft an ordinance based on the recommendations of the City Engineer and to confer with City Planner Fretz for any recommendations he might have pertaining to driveways. RESOLUTION No. 2792 - Authorizing PL 600 request for 1962-1963 signature Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, McMains, Henzel Noes: None Absent:, Councilman McAllister RESOLUTION No. 2793 - Authorizing special appropriation of $2500 for parking district Consultants Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, McMains, Menzel, Smith Noes: None Absent: Councilman McAllister RESOLUTION No. 2794 - Approving Planning Commission action in granting conditional use permit to J. D. Peters for retail Nursery Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Mc. Mains, Nenzel Noes: None Absent: Councilman McAllister -2- ~ONDITIONAL USE PERMIT DENIED A letter was read from the Planning Director reporting that the application for a conditional use permit to allow D.F.Fields to practice chit,practica et his home at 462 Parkway, was denied by the Planning C~ission. ~LEGRAPH C,M~YON SEWER CHANCE ORDER APPROVED City Engineer Cole stated that the contractor installing the Telegraph Canyon Sewer has requested permission to complete the project as required by the contract without meeting the requirement of 90I compaction in the upper five feet of the trench. The contractor is willing to provide a $15,000 bond to guarantee the pavement patch and trench backfill for a period of two years. The request is being made because of the unexpected pr, longed rainy season. It was moved by Councilman DeOraaf, seconded by Councilman NcMains and carried, that the change order be approved as presented. LECREST ESTATES IMPROVEMENTS Attorney Fred Tellam, representing the dirt engineers on the Ralecrest Estates Subdivision requested that the requirement for installation of sidewalks be waived for the 81 vacant lots in the Subdivision. It was pointed out that sidewalks could be required under the present ordinance when each individual lot was developed. Councilman HcNains was of the opinion sidewalks should be put in on at least one side of Floyd Avenue to accommodate the school ahildren. Councilman Smith recommended that no co~ercial i~provements be allowed in the Subdivision until all the improvement requirements of the entire Subdivision are met. Attorney Tellam was directed to get together with City Attorney Duberg to work out an agreement for presentation to the Council for approval. /~PORT ON PORT AUTHORITY BILL City Attorney Duberg gave a brief resume of the 40 page proposed Port Authority Bill. Mayor Menzel suggested that the Councilmen study the bill for discussion at the next meeting. /~,.,4t~qUEST FOR CITY TO PARTICIPATE IN TREE PLANTING PROGRAM A letter was read from the Downtown Association requesting that the Council participate in their program to beautify Third Avenue from "E" Street to "G" Street. The Association plans on buyin$ 90 trees and requests that the Park Dept. be authorized to plant and care for them ~n Third Avenue. Action was held over one week while the Councilmen study the request. SEAT BELT CLINIC It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the Jr. Chamber of Commerce be permitted the use of the Civic Center Parking lot again on March 24th and 25th for their seat belt clinic, as requested in their letter of March 18th. qUEST FOR SUPPORT OF 1962 FIESTA DE LA LUNA A letter was read from the Jr. Chamber of Conn~erce asking the use of certain City facilities and departments for the forthcoming Fiesta de la Luna. Hr. Dick Cassel, President of the *Jr. Chamber requested a resolution of support of the Fiesta from the Council. Action was withheld for one week. "RE~UESTAFOR VACATION OF PORTION OF TELEGRAPH CAI/YON'ROAD letter was read from A.O. Dieterle requesting that proceedings be initiated to vacate that portion of Telegraph Canyon Road at the Northeast corner of Hilltop Drive and Telegraph Canyon Road which was replaced in use by the realignment of Telegraph Canyon Road in 1958. It was moved by Councilman McMains, seconded by Councilman Smith and carried, that no action be taken. ~ORRECTIOR Councilman Smith stated that he would like to correct his statement at the last meeting where he questioned the meeting of the Police and Firemen Relief Assn. It was not his intention to include Firemen as a part of the Association, but to refer only to the Police Relief Association.
