REGULAR MEETING OF THE CITY COUNCIL OF THE CITY
of Chula Vista, California
Held Tuesday May 1, 1962
An adjourned regular meeting of the City Council of the City of Chula Vista,
California was held at 7:00 P.M. on the above date with the following Councilmen
present: Councilmen McMains, McAllister, Menzel, Smith, DeGraaf

Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of
prayer.
V' PRESENTATION OF TRAINING CERTIFICATES
Mayor Menzel presented certificates to Carl Roth J.~, Herman Roland, Vernon
Irwin, Leo Dalton, and Erman Lenihan Police Officers for having successfully
completed a course with the Commission on Peace Officers Standards and Training.
~../-PUBLIC HEARING (continued) Proposed rezoning of portion of Muraoka Annexation
This being the time and place, as designated, for the continuation of a public
hearing on the proposed rezoning of a portion of the Muraoka Annexation, Mayor Menzel
declared the hearing open. Mr. Saburo Muraoka, Roy Muraoka and Mr. Small spoke
in favor of the proposed rezoning. Mrs. Hubert Hawk and Mr. Harold Patay, rep-
resenting the Castle Park Civic Association spoke in opposition to the proposed rezon-
lng. A letter was read from the Sweetwater Union High School District protesting the
proposed rezoning. No others wishing to be heard either for or against the rezoning
the Mayor declared the hearing closed.
ORDINANCE No. 796- Rezoning a portion of the Muraoka Annexation- first reading
It was moved by Councilman DeGraaf, seconded by Councilman Smith and
carried, that Ordinance No. 79~, be placed on its first reading and that reading of
the text be waived. The motion carried by the following vote, to-wit:

The Clerk was directed to notify Mr. Harold Patay of the time and place of any hear-
ing which might be held in conjunction with an application for location of a trailer park
on the Muraoka property.
~ RECOMMENDATIONS ON GLUE SNIFFING
City Administrator Fulwiler reported a letter had been received from the
County P(robation Dept. recommending that the Council adopt an ordinance covering
glue sniffing. No action taken.
~.. BID AWARDED ON GANGWAY, FLOAT AND PILING FOR SMALL BOAT FACILITY
It was moved by Councilman Smith, seconded by Councilman McMains and
carried, that the low bid of Johnson Western Constructions in the amount of $2,985'
for construction of the gangway, float, and pilings for the small boat facility be
accepted.
RESOLUTION No. Z818- Approving Special Appropriation of $Z985 for floating Dock and Pier
Offered by Councilman Smith, passed, adopted and approved by the following
vote, to-wit:

RESOLUTION No. Z$19- Approving Planning Commission action in granting conditional
Use permit~ for service station at Northwest corner of

City Engineer Cole stated that the plat submitted by the American Oil Co. for
their service station at Fourth Ave. and "E" St. did not show driveways in accordance
with City standards. It was moved by Councilman Smith, seconded by Councilman
DeGraaf and carried, that the conditional Use permit for a service station at Fourth Ave.
and "E" St. be approved only if all requirements of the Planning and Engineering
departments are met. The motion carried by the following vote, to-wit:

RESOLUTION No. ZSZ0- Authorizing Mayor to sign Mutual Aid Agreement with
Imperial Beach

ORDINANCE No. 793- Approving Aland Annexation- second reading
It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried
that Ordinance No. 793 be placed on its second reading; that reading of the text be
waived and the Ordinance adopted. The motion carried by the following vote, to-wit:

ORDINANCE No. 794- Rezoning portion of South side of Center St. - second reading
It was moved by Councilman DeGraaf, seconded by Councilman McA/lister and
carried, that Ordinance No. 794 be placed on its second reading; that reading of the
text be waived and the Ordinance adopted. The motion carried by the following vote,
to -wit:

~.-~EQUEST TO MOVE DUPLEXES INTO CITY DENIED
Requests were received from Edwin O. Olson asking permission to move two
Navy Housing duplexes from San Diego to 698 Flower St. City Administrator Fulwiler
stated that with nineteen items necessary to bring the duplexes up to City standard, the
staff could not recommend to the Council that the duplexes be allowed in the City.
A representative of Consolidated House Movers urged that the Council grant
the request to move the duplexes. It was moved by Councilman DeGraaf, seconded by
Councilman McMains and carried, that the request be denied.
~.,./REQUEST TO MOVE DWELLING INTO CITY APPROVED
A letter was read from Fred Luxton requesting permission to move a house from
La Mesa to East Naples and Oleander Streets in Chula Vista. A letter was read from
the Building Inspector recommending that the relocation be approved, subject to compliance
with his list of requirements necessary to bring the dwelling up to standard.
It was moved by Councilman Smith, seconded by Councilman McAllister and
carried, that permission to move the dwelling into the City from La Mesa be granted
subject to all requirements of the Building Inspector.
,PHASE I OF TIDELANDS DEVELOPMENT ACCEPTED
City Engineer Cole stated that work had been completed by the contractor on
Phase I of the tidelands development, and recommended that it be accepted. It was moved
by Councilman Smith, seconded by Councilman DeGraaf and carried, that Phase I of the
tidelands development be approved as recommended by the City Engineer.
~/MAINTENANCE OF SEWER LATERALS
A report was submitted by City Engineer Cole recommending that the City no
longer maintain sewer laterals in the City. Action was held over on week while the
Councilmen study the recommendations of the City Engineer.
RESOLUTION No. 2824- Requesting Board of Supervisors to make tidelands study
Offered by Councilman DeGraaf, passed, adopted and approved by the following
vote, to-wit:
AYES: Councilmen DeGraaf, McMains, McAllister, Menzel, Smith

~[PPOINTMENT TO SAN DIEGO BAY COMMITTEE
Mayor Menzel stated that in his opinion two Councilmen should be appointed to
represent the City on the San Diego Bay Committee. Councilman Smith nominated
Councilman McMains, and Councilman DeGraaf to serve on the Committee. There being
no other nominations, it was moved by Mayor Menzel, seconded by Councilman McAllister
and carried, that Councilman McMains and Councilman DeGraaf be appointed members
of the San Diego Bay Committee. Mayor Menzel recommended that these members be
charged with the responsibility of carrying out the wishes of the Council while serving
~ {kc~gr~rr%i~tee submitting reports to the Council from the Committee and to refer
back to the Council any major policy decisions for ratification by the Council.
It was moved by Councilman Smith, seconded by Councilman McMains and carried, that
these recommendations of the Mayor be accepted. Councilman McAllister abstained
from voting.
RESOLUTION No. Z8Z5- Approving revised improvement agreement-Halecrest Sub:
Offered by Councilman DeGraaf, passed, adopted and approved by the following
vote, to-wit:

EQUEST FOR USE OF TIDELANDS FOR FIREWORKS DISPLAY
A letter was read from the Chula Vista Firemens' Relief Assn. requesting
permission to use a portion of the tidelands at the foot of "G" St. for the display of
fireworks on July 4th. It was moved by Councilman McMains, seconded by Councilman
DeGraaf and carried, that the request be granted, subject to approval of the Harbor
Commis sion.
//REQUEST FOR WAIVER OF LICENSE FEE
A letter was read from the National City Chamber of Commerce asking that
the license fee of $Z5.00 be waived for two members of the Southwest Survey Co.
who will be in Chula Vista a few days to question housewives on their shopping habits.
City Attorney Duberg stated that a license was not needed for this type of business.
It was moved by Councilman Smith, seconded by Councilman McMains and carried, that
the license fee be waived as requested.
~ / REQUEST FOR ABANDONMENT OF ROAD EASEMENT
A letter was read from Mr. Willis Ridhardson requesting that the City abandon
the ;roadway easement from the East twenty ~f~e~ .~ Lots 8 and 9 of Block R of Harbor-
side Unit No. Z. The letter was referred to the ~anning Commission.
L,~ROADWAY ASSOCIATION REQUEST
A letter was read from the Broadway Assn. requesting that the double traffic
line proposed to be painted down the middle of Broadway between "H" and "I" Streets
not be painted at this time. Also that a pedestrian cross walk be considered across
Broadway in front of the new Chula Vista ~hopping Center. No action taken.
~/~AN DIEGO BAY COMMITTEE
A letter was read from the San Diego Bay Committee reporting
on their meeting of April Z6th.
~/~NVITATION TO MEMORIAL SERVICES
Mr. George W. McNeely, representing South Bay Veterans Co-
ordinating Council, invited members of the Council to attend Memorial services at
Glen Abbey at 10:00 A.M. on May 30th.
~,//PRoTEST TO AMBULANCE FEES
Mrs. Michael stated that she wanted the Council to be aware of
what were , in her opinion, exo~tant fees for ambulance service in the City. In
October, 1960 The Bay Cities Ambulance Service picked up two small boys, carried
them six or seven blocks and charged $51.00. It was pointed out to Mrs. Michael
that the standard fee charged by all companies seemed to be SZZ. 00 per person per
trip, plus miscellaneous fees. It was suggested that it be ascertained what fees were
charged when the City granted the ambulance service a subsidy and determine if they
have advanced their fees since that time.
/'USE OF CIVIC CENTER PARKING LOT FOR CARNIVAL
Councilman McMains stated that he has had numerous calls criticizing the
Council on reversal of their stand on the use of the Civic Center parking lot for a
carnival, and also to the closing of several streets in conjunction therewith. Under
the circumstances Councilman McMains stated he is not in favor of opening the Library
and City Hall for Fiesta exhibits.

Mrs. Janice Ste~, Librarian, stated that she did not feel a carnival was compatible
with Library operation. Postmaster Stahlheber expressed concern over the tremendous
traffic problem that will be created by the presence of the carnival, and the closing of
certain streets in the area. City Administrator Fulwiler was directed to obtain informa-
tion and report on just exactly what uses the Fiesta Committee has planned for City
buildings during the Fiesta.
]/~EQUEST FOR ORDINANCE ON BUILDING DETER/ORATION
Councilman McMains stated that it had been brought to his attention that a vacant
house at 555 "D" St. was considered a fire trap because of its deteriorated condition
and the dry weeds ~rowing around it. He suggested an ordinance which would prevent
this type of deterioration, from remaining.
~,8~UDY ON USE OF RUBBISH FOR FILL SUGGESTED
Councilman McMains stated that the tidelands report by the Engineering firm of
Fogg, Florer & Smith referred to the use of rubbish as a possible means to fill some of
the tidelands area, and suggested that we look into this possibility. The matter was
referred to the City Engineer and City Administrator.
//DEVELOPMENT OF HILLTOP
DRIVE
Councilman McAllister was of the opinion the City should hold off
on any further development of Hilltop Drive in the vicinity of Oxford and Quintard Sts.
until something can be worked out with the County, so that the entire street can be
developed. City Administrator Fulwiler stated he would contact Dave Spears, County
S..~urveyor and Road Commissioner, to see if something can be worked out.
~'//GOVERNOR BROWN TO SIGN PORT BILL
Mayor Menzel having read an account in the newspaper stating that
Governor Brown would be in Chu!a Vista on May 8th to sign the port bill, Councilman
McAllister asked what the Council planned to do if anything. The Council was of the
opinion nothing could be done at this time as long as they had not even been officially
informed that the Governor would be in the City. Mr. Robert Lennox stated that invita-
tions would be in the mail this week.
REQUEST THAT ONE-WAY SIGN BE ~~.~.~"
Councilman DeGraaf suggested that the one-way sign on the alley between the
Library and~ostoffice be removed as no one seemed to pay any attention to it. It was
suggested that we remove the one-way sign and place two "Do not enter" signs on the
alley. No action taken.
REQUEST TO DETERA4INE IF STREET DEDICATED
Councilman DeGraaf questioned the Planning Commission action
dismissing an application for an area variance at 97 "D" St. due to the Attorney's opinion
that the lot was on a dedicated street. It waa~ (2~lmcilman DeGraaf' s opinion that the
street was not dedicated. The Planning Director was directed to determine whether the
forty foot strip which was interpreted to have been dedicated is really dedicated for
/ street purposes.
REPORT ON CONTROL OF ADVERTISING DISPLAY AND SIGNS
City Administrator Fulwiler, in response to a letter received from Edward Lane
protesting the use of a stage coaeh for advertising purposes by a neighbor in his front
yard set-back, stated that the City does not have an ordinance which prohibits the use
of this type of display.
BONITA VALLEY QUESTIONAIRE
Councilman McMains questioned whether the staff should devote the
time to filling out a lengthy questionnaire sent to the City by Bonita Valley residents
interested in annexing to the City. Councilman McAllister was of the opinion the
questionnaire should be filled out. Councilman McMains asked that if it is filled out,
that we request from them the total assessed value of the property proposed for
annexation. City Planner Fretz stated that we now have that figure.
APPOINTMENTS TO FILL UNEXPIRED TERMS OF OFFICE
Councilman McMains was of the opinion that something should be
done to prohibit the appointment, by gov. e~rning bodies, of someone to fill the unexpired
term of someone resigning from office, the person appointed plans on running for that
office at the next election.
ADJOURNMENT Mayor Menzel adjourned the meeting at 10:05 P.M. sine die.
