HomeMy WebLinkAboutcc min 1962/11/20 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday November 20, 1962 An adjourned regular meeting of the City Council of the City of Chula Vista, California was held on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Menzel, Smith, DeGraaf Absent: None Also present: City Engineer Cole, City Attorney Duberg, City Administrator Fulwiler, City Planner Fretz, Administrative Analyst Ross Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of prayer Statement: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the adjourned regular meeting of November 20, 1962. BLIC HEARING - Bonita Village Annexation This being the time and place, as advertised, for a public hearing on the proposed Bonita Village Annexation, Mayor Menzel declared the hearing open. Mr. Stephen Gassawa~ representing the Sweetwater Valley Civic Association, spoke in support of the proposed Bonita Village Annexation, providing that fire protection agreements are worked out, the annexation is prezoned, architectural controls are established, and action is taken to consider requests of two property owners desiring exclusion from the annexation. Lt. Commander John Thomas verbally protested the annexation, and asked that his letter of protest be read. Mr. Clifford Harman asked that his property be excluded from the annexation. Mrs. John Thomas spoke in opposition to their property being included in the annexation. Mr. Thomas, speaking again, asked that the Council direct the City Attorney to see if it is legally possible to exclude his entire property from the annexation° If this is not possible, it would be his wish that all possible of his property be excluded. It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that the hearing be continued one week, in order to determine what can be worked out in regard to excluding a portion of the Thomas property. The Clerk was directed to have the ordinance prezoning the Bonita Village Annexa- tion on the agenda for the next meeting. BLIC HEARING - Intention to close portion of Otay Lakes Road This being the time and place, as advertised, for a public hearing on the proposed closing of a portion of Otay Lakes Road, Mayor Menzel declared the hearing open. No one wishing to be heard, either for or against the closing, and the Clerk having received no written protests, the Mayor declared the hearing closed. RESOLUTION No. 2960- Ordering the vacation of a portion of Otay Lakes Road Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, McMains, McAllister, Menzel Noes: None Absent: None RESOLUTION No. 2961~ Giving notice of intention to close a portion of Telegraph Canyon Road Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, McMains, McAllister, Menzel Noes: None Absent: None ~F~EPORT ON ALLEY REQUEST OF COMMUNITY CHURCH OF GODD City Administrator Fulwiler, in reporting on the offer of the Co~m~unity Church of God at 456 Fifth Avenue, to dedicate four feet of their property for alley pur- poses and improve one half of the alley with black top, told the Council that investigation showed that property owners across the alley from the Church were not interested in developing the alley. Mr. Fulwiler stated the Council's adopted policy was that all permanent alleys be improved with concrete as recommended by the City Engineer. After discussion as to the type and amount of surfacing the Church should be required to install, it was moved by Councilman Smith, seconded by Councilman McMains and carried, that the deed of dedication be ready for acceptance by the Council at the next meeting, and the Church be required to improve the entire twenty foot width of alley adjoining their property with asphaltic concrete. ~RDINANCE Ko. 815- Establishing supplemental "D~ Zone- Second reading It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that Ordinance No. 815 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McMains,McAllister,Menzel,Smith,DeGraaf Noes: None Absent: None ORDINANCE No. 816- Interim zoning of Grout Annexation- Second reading It was moved by Councilman McMains, seconded by Councilman DeGraaf and carried, that Ordinance No. 816 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McMains,McAllister,Menzel,Smith,DeGraaf Noes: None Absent: None ORDINANCE No. 817- Limiting Sales & Storage in C-1 Zone- Second reading It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that Ordinance No. 817 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,DeGraaf,McMains,McAllister,Menzet Noes: None Absent: None RESOLUTION No. 2962- Approving Improvement Agreement-Bonita Bel-Aire Subdivision Offered~y Councilman McAllister, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McAllister,Menzel,Smith,DeGraaf,McMains Noes: None Absent: None RESOLUTION No. 2963- Authorizing Mayor to execute agreement with H & S Construction Co. regarding water installation at Bonita Bel-Aire Subdivision Offered by Councilman McMains, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMains,McAllister,Menzel,Smith,DeGraaf Noes: None Absent: None LETTER OF RESIGNATION A letter was read from Fred N. Mahoney tendering his resignation as a member of the Library Board. It was moved by Councilman McMains, seconded by Councilman Smith and carried, that the resignation be accepted and the City Administr~ tor directed to write a letter of appreciation for his service. ~/BOYS' CLUB REQUEST FOR WAIVER OF BUSINESS LICENSE A letter was read from the Boys' Club of Chula Vista requesting that the Council waive the business license fee for selling Christmas trees on their property commencing December 7tho It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the request be granted. -2- BER RECOMMENDATION ON CO~ISSIONER FOR PORT DISTRICT A letter was read from the Chamber of Commerce submitting the name of James V. Glasgow for consideration by the Council for appointment as Commissioner to the Unified Port District. Mayor Menzel asked that other names be submitted by individuals or organizations for Council action at the next meeting. ESTION ON ORDINANCE No. 817 - Sales & Storage in C-1 zone Mrs. Mary Anderson asked how the Ordinance No. 817 would affect her news stand at Third Avenue and Center Street. City Administrator Fulwiler read the new Ordinance to her, and stated she may be subject to make application for a conditional use permit. City Administrator Fulwiler was directed to work with Mrs. Anderson on the matter. CONNECTION OF PROPOSED SOUTH BAY FREEWAY WITH CITY STREET of Councilman Cole was directed to make At the suggestion DeGraaf, City Engineer a preliminary investigation and report on the feasibility of extending one of the City streets to connect with the Southerly terminus of the proposed South Bay Freeway. MEETING WITH LIBRAR~ BOARD The Council met for discussion with Library Board Members Hallman, Dudderar, Ault, and Schwarz. Mayor Menzel reviewed the duties of the Library Board as outlined in the Charter. Chairman Hallman stated the Board was in favor of requiring students to wear the minimum dress required in School while attending the Library° He stated the Board would like to encourage a joint discussion by the School Board, Library Board and Council on use of School library facilities by students after hours, and in order to obtain some coordination between use of the School library and the Public library. The Library Board is also anxious to get an idea of what is to be available in the way of funds for library use, and to what extent the Council intends to improve library facilities. Mayor Menzel suggested that the Board go to work immediately on rules on dress~ey feel should be worn by students to the Library;in order for the Council to approve them and put them to %se after the holidays. Also that possibly a Committee could be appointed to come up with some ideas as to a joint effort by the School Districts, the City, and the Library Board on Library use. It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that the Director of Curriculum for the City School District, and the High School District be appointed as associate members of the Library Board. It was suggested that the appointments be directed to the Superintendents of both School Districts. The Council was favorable to the Board suggestion that the cataloging section be moved upstairs, and that t~e Board contact local firms to see if a book lift can be built more economically than the price previously quoted. Councilman McMains suggested that consideration be given once more to the moving of the check out desk to the front door. City Administrator Fulwiler reported that he now had three applicants for the position of City Librarian, and suggested that we readvertise for more applicants. It was moved by Councilman Smith, seconded by Councilman McMains and carried, that the City Administrator be directed to readvertise for applications for the position of City Librarian.
