HomeMy WebLinkAboutcc min 1963/04/09 MINUTES OF A REGULAR MEETING OF THE CITY COUNCI%, OF THE CITY OF Chula Vista, California Held Tuesday April 9, 1963 A regular meeting of the City Council of the City of Chula Vista, California was held on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Menzel, DeGraaf Absent: Councilman Smith Also present: City Engineer Cole, City Attorney Duberg, City Administrator Fulwiler, Assistant Planner Warren Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of prayer. Statement: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the regular meeting of April 9, 1963. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Mc/dains, seconded by Councilman DeGraaf and carried, that the Council Minutes for meetings of March 12, 19, 26, and April 2nd be approved~ copies having been mailed to each Councilman. UBLIC HEARING (continued) Valley Annexation No. 2 This being the time and place, as designated for the continuation of the public hearing on the proposed Valley Annexation No. 2, Mayor Menzel declared the hearing open. A letter of protest was read frnm Mrs. Mary F. Morrison. No one wishing to be heard either for or against the annexation, and the Clerk having received no other written protests, the Mayor declared the hearing closed. The protest of Mrs. Morrison constituted a majority protest. RESOLUTION No. 3082- Finding a majority protest to the proposed Valley Annexation No. 2 Offered by Councilman McAllister, approved and adopted by the following vote, to-wit: AYES: Councilmen McAllister, Menzel, McMains Noes: None Absent: Councilnu~n Smith Abstaining Councilman DeGraaf ,/'~0UNTY AGREEMENT ON EXTENSION OF FIRST AVENUE City Administrator Fulwiler, having reported that he had received from the County a proposed agreement for joint participation of the County and City in the extension of First Avenues was directed to have the agre~ment in order for presenta- tion to the Council at the next meeting. ~/,.PUBLIC HEARING - Zoning portions of Accent Subdivision This being the time and place as advertised for a public hearing on the proposed permanent zoning of portions of Accent Subdivision to R-l, R-3, C-l, and M-l, Mayor Menzel declared the hearing open. No one wishing to be heard either for or against the proposed zoning, and the Clerk having received no written protests, the Mayor declared the hearing closed. After discussion, it was moved by Councilman DeGraaf, seconded by Councilman McMains and carried, that the hearing be reopened and continued until April 16th in order to give the subdividers time to appear and explain what plans they have for developing that portion of the Subdivision to be zoned R-3. /WHITTINGNAMHEIGHTS____ - Approving final map It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that the final map and improvement plans of Whittlngham Heights Subdivision be accepted upon the exexution by the owner of a contract with the City for the installation of improvements and the posting of a bond guaranteeing the performance thereof, which contract and bond shall be first approved by the City Attorney as to form and legality and subject to all reconmlendations of the Engineering and Planning Departments, RESOLUTION Nc. 3083- Approving Improvement Agreement- Whittingham Heights Subdivision Offered by Councilman McMains, approved and adopted by the following vote,to-wit: AYES: Councilmen McMains, McAllister, Menzel, DeGraaf Noes: None Absent: Councilman Smith ,PLANNING COMMISSION FINDINGS ON APPEAL OF GEORGE MANOS TO ZONE VARIANCE DENIAL A report of findings of the Planning Commission on the appeal of George Manos to action of the C~ission in denying him a zone variance at 172 First Avenue was read to the Council. Mr. Bill Pianos, speaking on behalf of his father's appeal, urged that the Council set the matter for public hearing. It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that May 7th at 7:00 P.M. be set as the time for a hearing of the appeal. ~REqUEST FOR EXCESS DRIVEWAY City Engineer Cole stated that developers of the Huroaka Mobile° home Trailer Park have requested an excess width driveway and entrance to %~elr trailer park. The Wldth requested is forty feet. It was the Engineer's recommendation that the request be granted. RESOLUTION No. 3084- Approving excess width driveway to Muroaka Mobtleheme Trailer Park Offered by Cduncilman DeGraaf, approved and adopted by the following vote, to-wit: AYES: Councilmen DeGraaf, HcNains, HcAllister, Henzel Noes: None Absent: Councilman Smith RESOLUTION No. 3085- Accepting Deed to real property for sewer purposes- Huroaka Offered by Councilman DeGraaf, approved amd adopted by the following vote,to-wit: AYES: Councilmen DeGraaf, McMains, McAllister, Menzel Noes: None Absent~ Councilman Smith RESOLUTION No, 3086- Accepting easement for sewer purposes-Muroaka Offered by Councilman DeGraaf, approved and adopted by the following vote, to-wit: AYES: Councilmen DeGraaf, McMains, McAllister, Menzel Noes: None Absent: Councilman Smith RESOLUTION No. 3087- Authorizing execution of grant of right-of-way from San Diego Gas and Electric Company Offered by Councilman HcHains, approved and adopted by the following vote,to-wit: AYES: Councilmen McMains, McAllister, Menzel, DeGraaf Noes: None Absent: Councilman Smith ,~,/BID,~ AWARDED ON FIRE gqUIPMENTcityAdministrator Fulwiler reported on Purchasing Dept, Bid No, 11-196Z-63 for purchase of miscellaneous fire equipment, and stated that four different firms submitted a total bid of $6,451,80 for the various items. It was rec~ended that the total bid be accepted, It was moved by Councilman MeMains, seconded by Councilman McAllister and carried, that the bids for miscellaneous fire equipment~? outlined by the Purchasing Dept, be accepted, RESOLUTION No, 3088- Approving special appropriation of $6~461,00 for fire equipment Offered by Councilman McAllister, approved and adopted by the following vote, to-wit: AYES: Councilmen HcAllister, Menzel, DeGraaf, Mcltains Noes: None ~bsent: Councilman Smith ~/'REPORT ON ASSEMBLY BILL No, 1364- Entry and Inspection of Housing City Attorney Duberg, in reviewing his written opinion on Assembly Bill No. 1346 pertaining to entry and inspection of housing, concluded that the amendment would be unwieldy in its practical application and would serve no useful purpose, It was his recommendation that the bill be opposed, It was moved by CouncilmaniDeGraaf, seconded by Councilman McMains and carried, that the recommendations of the City Attorney be accepted, -2- KESOLUTION No. 3089 - Opposing Assembly Bill No. 1364 Offered by Councilman DeGraa£, approved and adopted by the following vote, to-wit: AYES: Councilmen DeGraaf, McMains~ McAllister, Menzel Absent: Councilman Smith RESOLUTION No. 3090 - Authorizing execution of encroachment permit for Frank Ferreira Offered by Councilman McMains, approved and adopted by the following vote, to-wit: AYES: Councilmen McMains, NcAllister, Menzel, DeGraaf Noes: None Absent: Councilman Smith It was suggested that the Building Inspector be informed of Council action on the ierreira development so that when application is made for a building permit, the Inspector will be able to see that Council wishes are complied with. P~ESOLUTION No. 3091- Regarding APW G Project on condemnation Offered by Councilman DeGraaf, approved and adopted by the following vote, to-wit: AYES: Councilmen DeGraaf, McMains, McAllister, Menzel Noes: None Absent: Councilman Smith ADJOURNMENT Mayor Menzel adjourned the meeting at 8:15 P.M. until April 16th at 7:60 P.M. ~City Clerk
