OF CHULAVISTA, CALIFORNIA

An adjourned regular meeting was held in the Council Chambers by the City
Council on the above date at 7:00 P.M. with the following Councilmen present:
Councilmen McMains, McAllister, Menzel, Smith, DeGraaf
Absent: None
Also present: City Engineer Cole, City Attorney Duberg, City Administrator
Fulwiler, Administrative Analyst Ross, City Planner Fretz.
Director of Parks and Recreation Jasinek
Mayor Henzel led the pledge of allegiance to the Flag and asked for a moment of
prayer°
~UBLIC HEARING - Appeal of C~orge Manos to Planning Commission action denying
him zone variance at 172 First Avenue
This belng the time and place, as advertised, for a public hearing on the
appeal of ~eorge Manos to the action of the Planning Co~m£ssion in denying him a
zone variance from R-2 to R-3 for property at 172 First Avenue, Mayor Henzel
declared the hearing open. Hr. Bill Manos spoke for his father in support of the
appealo l~. T. L. ~oolsby was of the opinion seven units would be excessive on
one septic tank and expressed satisfaction with the zoning as it now stands. Hr.
Henry ~oedecke expressed opposition to two-~lery units being erected upon the
property but would not oppose single-story buildings. No others wishing to be
heard and the Clerk having received no written protests, the Mayor declared the
hearing closed.
It was moved by Couucilman HcAllister, seconded by Councilman Smith, and
carried, that the action of the Planning Cuum~lssion be sustained and the appeal
denied. Action of the Planning Co~aiss£on granting Hr. Manos a variance to build
a duplex on the property is still valid.
UBLIC HEARING - Appeal of Harry Osboru to Planning Coa=nission action denying
him reduction in lot size at 368 Hilltop Drive
This being the time and place, as advertised~ for a public hearing on the
appeal of Harry Osborn to the action of the Planning Cu..alssion in denying him
a variance for a reduction in lot size to 7,937 square feet in an R-l-B-12 zone,
Mayor Henzel declared the hearing open. Duane Wilson, Attorney representing Hr.
Osborn, spoke in support of Hr. Osborn's appeal and requested that the Council
override the Planning C~ission action subject to Hr, Osborn providing five
off-site parking spaces, building a dwelling with a minimum of 1,400 square feet
and setting the two-car garage at the northeast corner of the lot.
Mr. M. M. Weakland, 362 Hilltop Drive, spoke in opposition to the variance
stating that there were no hardships or exceptional circumstances which would
justify the variance as required in the ordinance. Mr. Osborn and Mr. George
Harvey, Realtor, both spoke in favor of the zone variance. There were no others
wishing to speak and the Clerk received no written protests.
It was moved by Councilman McHains, seconded by Councilman Smith, and
carried, that the hearing be continued for one week in order that the Councilmen
may have time to inspect the property involved.
~/PUBLIC HEARING - ASsessments on 1911 Block Act - Phase VII and VIII
This being the time and place, as advertised, for a public hearing on the
assessments on Phase VII and VIII of the 1911 Block Act, Mayor Menzel declared
the hearing open. No one wishing to be heard either for or against the assess-
ments and the Clerk having received no written protests, the Mayor declared the
hearing closed.
RESOLUTION No. 3107 - Determining that 1911 Act assessments shall be paid in
annual installments

to-wit:

OEDINANCE No. 841 - Increasing speed limit on portion of ~hird Avenue - Second reading
It was moved by Councilman McMains, seconded by Councilman NcAllister, and
carried, that Ordinance No. 841 be placed on its second reading, that reading of
the text be waived, and the ordinance adopted. The motion carried by the follow-
inS vote, to-wit:

It was moved by Councilman McMains, seconded by Councilman Smith,~and
carried, that Ordinance No. 842 be placed on its first reading and that reading
of the text be waived. The motion carried by the following vote, to-wit:

RESOLUTION No. 31~9 - Authorizing institution of condemnation proceedings to
acquire certain rights of way in connection with "E"
Street extension'

RESOLUTION No. 3110 - Accepting grading agreement with Mr, Ferreira for Eucalyptus

RESOLUTION No. 3111 - Approving Greg Rogers School-Park project maintenance
agreement

/OLIcIES RECO~MENDED BY THE PARK AND REC/LEATION COMMISSION APPROVED
Mr. William Jasinek, Director of Parks and Recreation, reviewed policies
recommended by the Park and Recreation Commission which have been submitted for
Council consideration.
After discussion, it was decided to hold over action on recommended policy
No. 1 which deals with trees until it can be given further study.
It was moved by Councilman Smith, seconded by Councilman DeGraaf, and
carried, that the general policy and regulation statements and policy statement
No. 2 and 4 of the Park and Recreation Commission be approved as recommended.
EXTENSION OF TI_ME GR~TED CONTRACTOR ON PU~ING STATION CONTRACT
It was moved by Councilman Smith, seconded by Councilman DeGraaf, and
carried, that the request of Charles E. Milleman, General Engineering Contractor
on the Pumping and Metering stations for the Metropolitan sewer, for a 15~day
extension on the completion date of his contract be approved.
///~URTHER STUDY ON TRAI~SIT NEEDS AUTHORIZED
It was moved by Councilman McMains, seconded by Councilman McAllister, and
carried, that the Mayor's Transit Study Committee be directed to further study
the wants and needs of the people and feasibility of a transit system and report
back to the Council.
%EqUEST FOR LICENSE TO OPERATE BILLIARD PARLOR
A letter was read from Henry Bogigian requesting a license to operate a
billiard parlor at 118 Broadway. It was moved by Councilman DeGraaf, seconded
by Councilman Smith, and carried, that the request be referred to the Administra-
tive Officer and the City Attorney for a report at the next meeting.
~ILLTOP DRIVE TO BE MAJOR STREET SOUTH OF "J" STREET
City Engineer Cole stated that upon talking with Mr. Spears of the County
Road Department, it was learned that the County could not participate in the
improvement of Hilltop Drive south of Oxford Street because it was not classified
as a major street. Mr. Cole suggested that the street be designated as a major
street in order to get County participation in its improvement. The City Attorney
was directed to draw up a resolution for the next meeting designating Hilltop
Drive south of "J" Street as a major arterial street.

Mayor Menzel adjourned the meeting at 8:55 P.M. sine die.
