HomeMy WebLinkAboutcc min 1963/06/18 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday June 18, 1963 An adjourned regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Menzel Absent: Councilmen Smith, DeGraaf Also present: City Engineer Cole, City Attorney Duberg, City Administrator Fulwiler, City Planner Fretz Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of prayer. Statement: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the adjourned regular meeting of June 18, 1963. ///'PUBLIC HEARING - Tobias Annexation This being the time and place, as advertised, for a public hearing on the proposed Tobias Annexation, Mayor Menzel declared the hearing open. No one wishing to be heard either for or against the annexation, and the Clerk having received no written protests, the Mayor declared the hearing closed. ORDINANCE No. 844 - Approving Tobias Annexation - First reading It was moved by Councilman McAllister, seconded by Councilmen McMains, and carried, that Ordinance No. 844 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, McMains, Menzel Nees: None Absent: Councilmen Smith, DeGraaf ~,///PuBLIC HEARING - Proposed amendmmnts to Zoning Ordinance No. 398 and Chapter 33 of the Code This being the time and place, as advertised, for a public hearing on proposed amendments to Sections 33.33, 33.36, 33.48, 33.52, 33.53, 33.61, 33.68 and 33.80 of the City Code, Mayor Menzel declared the hearing open. Mr. L. E. Babin, 734 Monterey, spoke in opposition to the proposed amendment to Section 33.48 because the amendment would allow parking in church rear and side yards. Mr. Paul Yeager questioned whether the amendment proposed for Sections 33.33.2 and 33.36.2 prohibiting residential uses in C-1 and C-2 zones would prohibit a person from building an apartment on top of a commercial building and living in it. City Planner Fretz indicated residential use would be prohibited under the new amendment. No others wishing to be heard, the Mayor declared the hearing closed. ORDINANCE No. 845 - Amending zoning ordinance and Chapter 33 of the City Code - First reading It was moved by Councilman MaAllister, seconded by Councilmen McMains, and carried, that Ordinance No. 845 be placed on its first reading, deleting the proposed amendment to Section 33.48 (Yards for Churches and Institutions), and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, McMmins, Menzel Noes: None Absent: Councilmen Smith, DeGraaf i.~EWER SERVICE CHARGE VARIANCES DENIED City Administrative Officer Fulwiler recom~nended that the applications for sewer service charge variances from property owners at 254 through 288-1/2 Ash Avenue, 320 "~' Street, and 402 Oaklawn Avenue (Vistan Apartments) be denied on the grounds the applicants have not shown there exists exceptional circom- stances warranting such variances. RESOLUTION No. 3142 - Granting variance in sewer service charge fee - Dawson's Nursery Offered by Councilman McMains passed and adopted by the following vote, to-wit: AYES: Councilmen McHains, McAllister, Menzel Noes: None Absent: Councilmen Smith, DeGraaf RESOLUTION No. 3143 - Regarding financing APW Project 23-G Offered by Councilman McMains passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Menzel Noes: None Absent: Councilmen Smith, DeGraaf RESOLUTION No. 3144 - Regarding financing APW Project 24-G Offered by Councilman McM~ins passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Menzel Noes: None Absent: Councilmen Smith, DeGraaf ~DAMAGE GLAII~S DENIED It was moved by Councilman McMains, seconded by Councilman McAllister, and carried, that the claim of Alfred and Antonia Welker in the amount of $1,250.50 and the claim of Thomas W. Rolph in the amount of $1,500.00 for fire damage to trees in the 100 block near Del Mar Avenue, be denied. vREqUEST FOR qUITCLAIM DEED - Robinhood Homes, Inc. A letter was read from Attorney Charles Karpinski, representing Robinhood Homes, Inc., requesting that the City execute a quitclaim deed in favor of Robinhood Homes, Inc., to property near the intersection of Telegraph Canyon Road and "L" Street, said property recently having been vacated as a roadway. Administrative Officer Fulwiler explained that it was the original intent of the City that this property revert to Robinhood Homes, Inc., upon being vacated. RESOLUTION No. 314~ - Granting quitclaim deed to Robinhood Homes, Inc. Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Menzel Noes: None Absent: Councilmen Smith, DeGraaf ~APPOINTMENT MA~E TO TRANSPORTATION G~ITTEE Mayor Menzel, stating that the Transportation Co~ittee has requested . that a member of the Council be appointed to their co~ittee, appointed Council- man McMains. ~//BIDS AWARDED ON CITY VEHICLES It was moved by Councilman McAllister, seconded by Councilman McMains, and carried, that the low bids on the following vehicles for fiscal year 1963-64 be accepted: Three police cars Drew Motors $ 5,467.80 One fire dept. car Drew Motors 2,174.60 Three 6-cyl. sedans Drew Motors 5,740.01 One police 6-cyl. sedan Drew Motors 2,007.00 One V-8 four-door sedan Trevellyan 2,977.10 Four l/2~on pick-up trucks Bay Shore Motors 6,124.76 V~'REqUEST FOR AMENDMENT TO BILLIARD ROOM ORDINANCE A letter was read from Henry Bogigian requesting that the Council amend the billiard room ordinance to allow for a two o'clock a.m. closing. He with- drew his former request for a reduction in age limit from 18 years to 16 or 17 years. Mr. BogiEian spoke in support of his written request. The City Attorney was directed to prepare an amendment to the billiard room ordinance extending the hours of operation to 2:00 a.m. for presentation to the Council at the next meeting. Mr. Bogigian was informed that this action should in no way be inter- preted to mean that the ordinance would be adopted on July 2, when it comes up for second reading. ~"P'~qUEST FOR PLACEMENT OF SHAPE BANKS A letter was read from the United Share Fund, ID~., of Capistrano Beach, requesting permission to place share banks in restaurants and other similar places of business for the purpose of collecting funds for their new charitable organization providing help for the under-privileged. It was moved by Council- man Mc~ins, seconded by Councilman McAllister, and carried, that the request be denied. v~HAMBER OF C(~dERCE RESOLUTION ON FLOOD CONTROL CHANNEL A resolution was read fro~ the Chamber of Co..aerce uring that the Council pass a similar resolution rec~en~ing that the flood control channel in Sweet- water Valley be located as near as is engineeringly and econamically feasible to the geographical center of Sweetwater Valley. De~raaf ~/~ FIREWOPd(S DISPLAY AUTHORIZED A letter was read from Fire Marshal Smithey recou~ending that the request of the San Diego Firewo~ks Display Company for permission to give a public fire- works display on the evening of July 4, in Sweetwater Valley Industrial Park, under the sponsorship of the Chula Vista Firemen's Relief Association, be approved. It was moved by Councilman Mc/dains, seconded by Councilman McAllister, and carried~ that the request be granted. STUDY REQUESTED ON WALKWAYS IN VICINITY OF GPEG-ROGERS SCHOOL At the request of Councilman McAllister, City Engineer Cole was directed to check into what provisions are being made for walkways for school children who will be attending the Greg-Rogers school in the fall and who must use Nolan, Napa and Neptune streets to get there.
