OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA, CALIFORNIA
Held Tuesday July 23, 1963
An adjourned regular meeting was held in the Council Chambers by the
City Council on the above date at 7:00 PoMo with the following ~ouncilmen
present: Councilmen McAllister, Menzel, Smith, DeGraaf
Absent: Councilman McMains
Also present: City Engineer Cole, Administrative Analyst Ross, C~ty
Planner Fretz
Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment
of prayer.
Statement: The City Clerk hereby states that he did post within 24 hours
of adjournment, as provided by law, the order of adjournment
~ of the adjourned regular meeting of July 23, 1963.
BLIC HEARING - Appeal of J. D. McKin~ey to Planning Co~--ission action
denying him a zone change at Fourth and "H" Street
This being the time and place, as advertised, for a public hearing on
the appeal of J. D. McKinney to the Planning Co.~ission action denying him a
zone change from R-3 to C-1 for property on the southeast corner of Fourth
Avenue and "H" Street, Mayor Menzel declared the hearing open. Attorney
Elias Schiff, representing Mr. McKinney, spoke in support of the appeal and
urged the Council to approve the rezoning. No others wishing to be heard
either for or against the rezoning, the Mayor declared the hearing closed.
The report of findings from the Planning Commission was read to the
Council. Mr. Ray Powell, representing Shell Oil Company, in answer to a
question from Councilman Smith, stated that the Council could be assured
that the Shell Oil Compamy would develop the property if it is rezoned.
City Planner Fretz reviewed the reasons why the Planning Staff and
Co~mmission were opposed to the rezoning.
It was moved by Councilman Smith and seconded by Councilman McAllister
that the Council override the action of the Planning Commission and approve
the zone change. The motion failed to carry by the following vote, to-wit:
AYES: Councilmen Smith, McAllister
Noes: Councilmen DeGraaf, Menzel
Absent: Councilman McMains
RESOLUTION No. 3165 - Accepting tentative map - Princess Crest Subdivision
Offered by Councilman Smith, subject to all requirements of the
Planning and Engineering Departments, passed and adopted by the following
vote, to-wit:
AYES: Councilmen Smith, DeGraaf, McAllister, Menzel
Noes: None
Absent: Councilman McMains
~/.PLANNING CO~94ISSION RECOMMENDATIONS ON AMENDMENT TO ZONING ORDINANCE
City Planner Fretz reviewed the Planning Commission rec~.mendations
for amendments to the zoning ordinance which would amend the definition of
a family and change the minimum floor area per main dwelling unit in an
zone.
ORDINANCE No. ~51 - A ~emporary interim zoning ordinance amending Sections
33.3 and 33.16 of Chapter 33 of the City Code - First
reading and adoption
It was moved by Councilman McAllister, seconded by Councilman DeGraaf,
and carried that Ordinance No. 851 be placed on its first reading, that
reading of the text be waived and the ordinance adopted as an emergency
ordinance. The motion carried by the following vote, to-wit:
AYES: Councilmen McAllister, Menzel, Smith, DeGraaf
Noes: None
Absent: Councilman McMains
ORDINANCE No. 850 - Amending zoning ordinance - rezoning property at Kearney
and Church Streets - Second reading
It was moved by Councilman Smith, seconded by Councilman McAllister,
and carried that Ordinance No. 850 be placed on its second reading, that
reading of the text be waived, and the ordinance adopted. The motion carried
by the following vote, to-wit:
AYES: Councilmen Smith, DeGraaf, McAllister, Menzel
Noes: None
Absent: Councilman McMains
~W/~t~fY ENGINEER AUTHORIZED TO COMMENCE PHASE IX, 1911 BLOCK ACT
City Engineer Cole submitted a list of the properties proposed to be
included in Phase IX of the 1911 Block Act. It was moved by Councilman
Allister, seconded by Councilman Smith, and carried that the City Engineer
be authorized to proceed on PhaselX of the 1911 Act.
~/~'43 ACT PARKING DISTRICT PROCEEDINGS ABANDONED
It was moved by Councilman DeGraaf, seconded by Councilman Smith, and
carried that the proceedings started under the 1943 Parking District Act be
abandoned.
RESOLUTION No. 3166 - Finding competitive bidding on radio equipment impractical
Offered by Councilman Smith, passed and adopted by the following vote,
to-wit:
AYES: Councilmen Smith, DeGraaf, McAllister, Menzel
Noes: None
Absent: Councilman McMains
~/~RED ROSS APPOINTED ADMINISTRATIVE OFFICER
It was moved by Councilman DeGraaf, seconded by Councilman McAllister,
and carried that Mr. Fred Ross be appointed Chief Administrative Officer of
the City to take the place of F. S. Fulwiler, resi~ned, at the salary set
forth in the budget for the Administrative Officer.
"DESIGNATING AUTHORIZED REPRESENTATIVE FOR APW PROJECTS 23-G and 24-G
It was moved by Councilman McAllister, seconded by Councilman Smith~
and carried that Administrative Officer Fred Ross be designated authorized
representative for APW Projects 23-G and 24-G.
LETTER OF RESIGNATION
A letter was read f=om Robert Geyer. tendering his resignation as a
member of the Park and Recreation Commission. It was moved by Councilman
Smith, seconded by Councilman McAllister, and carried that the resignation
be accepted and a letter written expressing the Council's appreciation for
his service while serving on the Co~ission.
~//SAFET~ COUNCIL I~COMI. ffiNDATIONS
A letter was read from the Safety Council, recommending that a "No
Parking' zone be created on that portion of the west side of Third Avenue
from the corner of "J" Street to the northertunost entrance to the Food Basket
Market and that the City take steps to have an elm tree on the southeast
corner of Flower Street and Guava Avenue pruned. The reco~x~endations were
referred to the Administrative Officer for report.
/TE INCREASE RECO~giENDED FOR SANITARY SERVICE
A letter was read from Carl Davidson, 183 "F" Street, recommending
that the Council grant the Chula Vista Sanitary Service their petition for
a rate increase.
,w//~APPRAISAL AUTHORIZED ON SITES PROPOSED FOR CORPORATION YARD
The Council authorized the staff to make preliminary appraisals on
two sites selected for possible use as a corporation yard and to report at
the next meeting.
ADJOURI~IENT
Mayor Menzel adjourned the meeting at 8:15 P.M. until August 6 at
7:00
