HomeMy WebLinkAboutcc min 1953/10/16MINUTES OF A SPECIAL NEETING of the City Council of the City of Chula Vista, California ~ Held Friday October 16, 1953 The Council met in the Council Chambers at City Hall at 7:00 PoN. on the above date, with the following Councilmen present; Councilmen Riesland, Hobel, Logan Absent: Councilmen DeWolfe, Halferty Also present: City Administrator Floyd, City Attorney Boyer, City Planner ~ Wagner The Council m~t at 7:00 PoN on the above date pursuant to Special Notice mailed to each Councilm~ twenty-four hours prior to the meeting for the purpose of discussing accusations against the Chief-of-Police by the Grand Jury° Ed Hervey, Attorney for Chief NcCollum, was introduced to the Council and stated that the accusations were not just and without fact, and that no Superior Court would allow it to stand, lie pointed out that in his opinion Jurisdiction to remove a Civil Service Officer of the City of Chula Vista was with the Council by virtue of the City Charter, and not the District Attorney's office, or the Grand Jury. If the Chief-of-Police was to be removed, he would have to be removed by the Council through the Civil Service Commission, and not by the District Attorney or Grand Jury. Coancilm~n Hobel did not feel the Council should discuss the merits or demerits of the District Attorney or Grand Jury. He was of the opinion the Chief was doing a ~ood job, and that no action would be taken against him until proven guilty, and that the Council should follow the advi~e of the City Attorney on the ~attero City Attorney Boyer stated there was nothing in the Civil Service Rules that required the Co-unCil to act or not to take action. The Council could make their own charge of incompetence or insubordination, which would have to be proven before the Civil Service Commission if a demand for hearing was made. City Attorney Boyer said no action was required at this time, unless the Council or City Administrator felt that cause for removal under the Charter existed° Walter Davis, speaking as Director of Civil Defense, stated they back up the Chief-of-police one hundred percent. Chief !~cCollum stated he felt his men were getting adequate training, and feels they were well trained as any in the County~ Nrs. Victoria Punton felt the Council should consider what is be~t for the City, and asked that immediate steps be taken to remove Police Chief NcCollum. Hermau Golden Urged the Council to make their c~vn unbiased investigation of the whole affair and act ~ccordingly. Gus B. Calgain, Union Official at Rohr, said they were only interested in seeing that proper justice is brought about. No action was taken by the Council AD JO ~RN~ENT It was moved by CounciLman Hobel, seconded by Councilman Logan, and carried, that the Special L~eeting adjourn sine die.
