OF THE CITY COUNCIL OF THE CITY OF
Chula Vista, California
Held Tuesday - November 17, 1953.
The Council met in the Council Chambers at City Hall at ~:30 PoMe
on the above date, with the following Councilmen present~
Council~en~ DeWolfe, Riesland, Logan and Halferty
Absent~ . Council.~u Hobel
Also present~ City Attorney Boyer, City A~mtuistrator Floyd, City Planner
W%~er, City Finance Officer Grant, Assistant to the City

V/DISCUSSION - SWI~NG POOL & ~ BONDS
. Attorney Boyer informed the Council that they must adjourn to the
24th of November at 7:00 P.M. for adoption of the Resolution inviting sealed
bids for Recreational facilities Bonds and asked the Council to determine how
and when the bonds are to be sold. Mr. Boyer read a letter from O'Melveny
and Myers recommending the bonds mature $20,000 each year for the first 15
years, then $15,000 each year for the next 5 yearse The recommended date for
opening the bids was December 17, at 7:00 P.M.
After discussion it was moved by Council.~, Halferty, seconded by
CounCilmart Logan, and carried, that the bonds be amortized over a 20 year
period in the manner recommended by O'Melveny and M~ers, and that t~e date for
opening the bids be set at December 17, 1953, at 7:00
MI?~ AND DALSETH SUBDIVISIO~N NO. 3 - Request for extension on improvement
contract.
City Attorney Albert Boyer stated that Mr. Miles had ree~sted an
extension of t~ on his contract with the City for construction of improve-
ments in Miles and Dalseth Subdivision No. 3.
It was moved by Oouncil.~n Halferty, seconded by Councilman Logan,
and c~rried, that the extension be granted to June 30, 1954, subject to the
approval of the bonding company.
'DISCUSSION - SOUTH BAY SUBDIVISION NO. 1
City Planner Wagner reported that the improvements in South Bay Sub-
division No. 1 have not been completed but the owners are planning to petition
the Planning Commission to allow them to sell off half lots a~t half duplexes.
Attorney Boyer stated that the Union Title Insurance Co. is liable
for the i~provements up to the amount of their trust, as the contractor de-
poeited funds with it sufficient to cover the cost of /,nprovements, in lieu of
a bond. Mr. Johnson reported that the Title Compang had not been authorized by
the City Engineer to repay an~ of the deposit as of this date. The Council
felt the matter should be looked into and the City's'intereste protected. No
action taken.
REQUEST ~ NATIVITY SCENE IN PLAZA
Mrs. Howard Jones, representing the ASsociation of Christian ~o~en,
asked permission to erect a Nativity scene in the Plea~ between F and Center
Streets' d~ing the Christmas season and to have a musical prograa around it for
about one half hour on December 11..
I~ ~as ~oved by Councilman Halferty, seconded by CouncJl~-~ R~es]--~,
and carried, that the police be instr4cted to assist in handling traffic during
the program scheduled for §~30 reM.,' December 11, 1953.
RESOLUTION NO. 1482 - Accepti~ proposal of Lawrence Thompson to render
special assessment services on 1911 Act.
After reading and discussion, the Administrative Officer was instructed
to contact Mr, Thompson and attempt to negotiate a better contract.
DISCUSSION 191~ ACT
a~ Attorney Boyer inquired if the Council was desirous of including
any ofthe County area on the East side of Hilltop Drive in the City's 1911
A~t districts It was moved by Councilman Rieeland, seconded by Councilman
Logan, and carried, that no County territory be included in the 1911 Act District,
b. Attorney Boyer inquired if it was the Councills desire to assess
to the School District all improvements constructed adjacent to school property.
It was explained that if the District did not pay its assessment, the City would
have.to advance the money and would then have a cause of action against the
Distm-i%t for reimbursement.
It was moved by Councilman Riesland, seconded byCouncilman Halferty,
and carried, that the school district be assessed for the improvements con-
structedadJacent to their property u~Mer the 1911 Act. Mr. Boyer suggested
that someone contact Dr. Lauderbach and appraise him of the Council's action.
c. Attorney Boyer stated that the Railroad bed on Third Avenue and
"F" Street was wi%bin the 1911 A~t District and that they wo~ld like out of
the District in order that they might do their own paving. The Coemcil indi-
cated ~a~ i~ preferred to have'the Railr6~d in the District but not if its
inclusion might effect a m~Jority protest.
PLANNING COMMISSION M~ER-LONGWORTH - REPLACEMENT CONSIDERED
Mayor DeWolfe asked that each Councilman bring two names to the next
meeting from which a replacement for Member Longworth, resigned, might be chosen.
ORDINANCE NO. 481 - Adopting Chapters 3 and 4 of Title 7 of the Government Code
as Plopping Ordinance of chula Vista - second reading.
It was moved by Ceuncilm~n Logan, seconded by Councilman Riesland,
and carried, that the Ordinance be placed on its second reading. After the
reading of the title it was moved by Councilw~n Logan, seconded by Councilman
Halferty, and carried, that the reading of the text be waivedo The ~rdinance
was thereupon adoptedby the following cote, to-wit~

ORDINANCE NO. 477 -Regulating interference with Television and Radio Rece~cion -
Second Reading .
A letter was read from~Ney Landry, F.C.C., requesting permission to
appear before the Council to explafn the need for sttC~ an Ordinance as No. 477.
It was suggeste~ that, in the absence of Counci~n Hobel, the second reading
be postponed until the next meeting and that AdmAnistrative Officer Floyd con-
tact Mr. Landry and that he be present.

It was moved by'Counci]w~n Halferty, seconded ~y Counc~]m-n Logan,
and car%'led, that Ordinance No. 482 be placed on its second reading. After the
reading of the title, it was moved ~y Councilman Riesland, seconded by Council-
man Halferty, .and carried, that the reading of the text be waived. The Ordinance
was thereupon adopted by the followln~ vote, to-wit~
