HomeMy WebLinkAboutcc min 1953/11/24MINUTES OF A REGULAR ADJOURFgD M~TING OF TH~ CITY COUNCIL OF THE CITY OF Chula V~sta, California Held Tuesday. - November 24, 1953 The Council met in the Council Chambers at City Hall at 7:00 P.M on the above date with the following Councilmen present: Councilmen DeWolfe, Riesland, Logan, Halferty Absent: Council-~ Hobel Also presentl City Administrator Floyd, City Attorney Boyer, City planner Wagner, City Finance officer Grant, Assistant to the City Engineer Johnson ORDINANCE No. 477 - Regulating use o~ devices which interfere with Radio and Television reception. It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the Ordinance be placed on its second reading. Before the reading Mr. Ney Landry, Engineer Federal Communications Commission, stated they were interested in the passage of this Ordinance in order to improve reception in the area, and felt regulation of minor disturbances should be kept on a local level for expedient enforcemente A memorandum was read from Councilman Hobel setting forth a suggested addition to Section 1 of the Ordinance, as it might affect Hellarc Welders and high cycle Generators. Mr. Landry expl-~ued that specific rules already set up by the Federal Communications Comm~-~sion take care of the Welders and Generators so that the suggested addition would serve no particular purpose. The Council decided to adopt the Ordinance as originally read, and have Councilman Hobel call Mr. Landry, who expressed a willingness to explain why he felt the suggested addition unnecessary. It was moved by Councilman Riesland, seconded by Councilman H~lferty, and carried, that the reading of the text be waived. The Ordinance as originallt submitted was thereupon adopted by the following vote, to-wits AYES: Councilmen* Riesland, Logan, Halferty, DeWolfe Noes Nons Absent: Councilman Hobel ORDINAMCE No. 483 - Providing for issuance of Bonds in amount of $375,000.00 First Reading It was moved by Councilman Riesland, seconded by Counc~l--n Halferty, and carried, that Ordinance No. 483 be placed on its first reading. It was thereupon read a~d discussed in full. RESOLUTION No. 1483 - Directing publication of notice inviting sealed bids for $375,ooo.0o approved AYES~ Noes~ Abeent~ Offered by Counctlm=~ Logan, read in full, passed, adopted and by the following vote, to-wit: Councilmen Riesland, Logan, Halferty, DeWolfe None Councilm=~ Hobel ORDINANCE No. 478 - Business License Ordinance It was meved by Councilman Riesland, seconded by Councilman Halferty, and carried, that 0rdi~n-.e ~o. 47§ be placed on its first reading. After readi~ the title, it was moved by Councilman Riesland, seconded by Counci~--~ Halferty, and carried, that the reading of the text be waived. The Ordinance was thereupon adopted by the following vote, to-wit: AYES: Councilmen Riesland, Logan, Halferty, DeWolfe Noes: None Absent I Councilm~n Hobel ~DISCUSSION - Appointment of fiscal agents for payment of Bonds City Attorney Boyer stated that O'Melveny & Myers highly recommended the Use of fiscal agent in the San Diego, Los Angeles, and in the ~ast for payment of the Bomde, as it should materially assist in obtaining more favorable bids for the Bonds. City Attorney Boyer wins of the op~-~ on the cost would be appro4~m-tely ten cents per coupon for the collection service. As a matter of information it was suggested~ that Mr. Goodrich, Manager of Securities Dept. of the Bank of America be contacted and asked to submit a contract on the cost of collecting for the City. mW~0LUTION Mo. ]J~82 - Accepting proposal of Lawrence Thompson - 1911 Act Offered by Councilm~ Riesland, read in full, passed, adopted and approved by the following vote, to-wit: AYES~ Councilmen Riesland, Logan, Halferty, DeWolfe Noes~ None Absent: Counc~lm~u Nobel Mayor DeWolfe stated that he and City Administrator Floyd had renegotiatedwith Mr. Thompson am1 managed to get Mr. Thompson to reduce his fee from 2% to 1 3/4% of the final construction cost. Resolution No. 1484 -Dedicating Lot A in Millan Manor for street purposes. Offered by Councilman Riasland, read in ~11, passed, adopted and approved by the following vote, to-wit~ AYES~ Councilmen Riesland, Logan, H~l*erty, DeWolfe Noes ~ None Absent: Council~n Hobel DISCUSSION OF REPLACEMENT FOR LONGWORTH ON PLANNING CO~SSION Because all Councilmen did not have names to present for consideration as a replacement for Mr. Longworth, it was decided to put the matter over to the next regular meeting. DISCUSSION - Annexation of portions of SWeetwater Valley Thomas Huntington appeared before the Council requesting that he be notified should an~ action be contemplated in dividing and annexing a portion of Sweetwatar Valley. It was his desire to be annexed to the City of chula Vista rather than National City, should annexation be necessary. Mr. Huntington was advised that proceedings had not started on the annexation of any portion of the valley, and that he most certainly would be notified when and if they did. DATE SET FOR ~.":A'ING WITH RECREATION COMMISSION A letter was read from. Mr. Lewis, Recreation Director, requesting a Joint meeting of the Recreation Commission a~ Adult Advisory Council, with the Council. The Council decided to call the meeting for ?:30 P.M. November 30th, in the Council Chamber~, and suggested that City Administrator Floyd instruct Mr. Lewis to bring in figures on the cost and operation of the Recreation building and program. CORR~POND~NC~ A letter was read from the Chula Vista Women's Club asking permission to plant with Ice plant a proposed cut on the South end of Eucalyptus park. The Council instructed the City Administrator to acknowledge receipt of the letter and to inform the Club that the City planned to use dirt available from the 1911 Act Street Improvement Project now under way to fill the Iow areas of the Ball Park. Consequently it will be some time before the cut on the South end would be made. It is planned to perfect the areas for small picnic grounds when the Job is completed. Another letter from the same Club offered to plant one small garden or walk-w~7 at the new Recreation Center. The Council instructed the City Administrator to inform the Club that a professional landscape architect would dc the major planting at the Center, but if their Club wished to assu~e the responsibility of any small portion of the project, they were more than welcome to do so. Cit~ Attorney Boyer read a letter from the Metropolitan Water Dist[-ict advising the Council that it m~ht elect to declare its intention to pay out of Municipal funJ~S the amount of tax which would otherwise be levied upon property within the City for the year 1954-1955. No action was tahene City Attorney Boyer read a letter he had written to O'Melveny & Myers regarding proposals on the 1911 Act as specified by the Council at the November l?th meeting, and asked the Council,s final approval before sending the letter. The Councilmen were of the opinion that the proposals they made were correctly stated in the letter. ~/AUTHORIZATION TO SUE WRIGHT ON EFFLUENT CONTRACT Assistant to the City Engineer Johnson informed the Council that Mr. Wm. Wright was $600.00 behind in his payments as per contract with the City for effluent from the sewer plant, and requested that they authorize the City Attorney to file suit for the amount due. Mayor DeWolfe offered to contact Mr. Walter Xramee, Assistant General Freight Agent of the Santa Fe Railway to find out if Mr. Wright is in arrears on his lease with them, and acquaint them with the City's plan to sue Mr. Wright. It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that City Attorney Boyer be instructed to take such steps as are necessary, including filing suit, to collect the delinquent payments of $600.00 due under the contract. DISCUSSION on new City Attorney City Attorney Boyer stated that he had spoken to Attorney Merideth Campbell of National City and Paul Engstrand of La Mesa, and both were interested in the positi°n of City Attorney of Ch,,l~ Vista and would like to discuss the matter with the Council. Councilwm, Halfsrty thought the Council should investigate the feasibility of hiring a firm of Attornies with a Junior partner who might take care of the City business. City Attorney Boyer stated that under the Charter an individual must hold the official position of City A~torneye It was moved by Councilman Riesland, seconded by Counc~lm!~ Halferty, and carried, that the City A~m~uistrator be instructed to advertise in Western Cities Magazine for a full time City Attorney, salary open, in order to obtain a list of eligible attornies to interview. ~OTEST ON I~W BUSINESS BICEI~E OI~-N~-'E Mr. Thom=a Huntington, owner of the Vogue and_ Seville Theatres in Chula Vista protested the new business license ordinance as it applied to fees on admission tickets. He stated the Federal Tax was responsible for the closing of miw theatres, and the removal of it was being strom~ly cousidered in Washing%on. Because of the proposed action in Washington, he felt it most certainly was no time to impose an additional City tax. DISCUSSION ON FRINGE A~ Councilman Halferty stated that the City should move once mere to protest any development in the County on the City's borders, and take every means possible to get County Standards raised so that they are comparable to those in the City. He suggested that a r~presentative of the City be present at every County planning Commission meeting. Councilman Riesland rem-~ked that he felt the answer to the problem ia for the City to extend service into the County area in order to make annexa- tion to the City desirable. He sUggested that the fringe area matter be brought up at the 'next League of California Cities meeting, and at the Mayors meeting. It was moved by Councilman Halferty, seconded by Councilman Logan, and carried, that the Beard of Supervisors and County planning Commission be kept constantly aware of the wishes of the City as to City Building restrictions, and ask that the Resolution to that effect, passed on October 8, 1953, be given constant consideration.
