December 22~ 1953 The Council met in the Council Chambers at City Hall at 7:00 P.M on the above date with the following Councilmen present: Councilmen Halferty, Riesland, Hobel, Logan Absent: Couneiluan DeWolfe Also present: City Administrator Floyd, City Attorney Boy-r, City planner Wagner, Assistant to the City Engineer Johnson In the absence of Mayor DeV~olfe, Mayor pro-tern b~lferty presided. ~PPb~LIC t~ARING - South Bay Development Co. Zone Variance appeal. This being the time and place as advertised for the public hearing on the South Bay Development Company Zone Variance appeal, Mayer pro-tom Halferty asked City Planner Wagner to read the original application for the variance, as submitted to the Planning Commission by the South Bay Development Company and the report from the Planning Commission setting forth its reasons in support of its decision to deny the variance. After reading of the application and report, Attorney Richard Crake, representing the South Bay Development Company, gave in detail the reasons for the appeal. Others spe~king in favor of the variance were R. L. Wallace, Travis ~ierce, Harry Wainscot, Anne Balky, and J. W. Sheets, all occupants of the project and prospective purchasers. There was no one in the audieuce who spoke in opposition to the zone variance, with the exception of brief remarks by Planning Commissioners Drew and Smith. The Council heard evcNyone who wished to be heard on the subject. The Council thereupon discussed thc matter at length, and felt that to uphold the appeal from th~ decision of the Planning Commission would tend to break down throughout the City all standards set up in the zoning ordinance, and set a precedent whereby othera would seek the same privilege.. It was felt no undue hardship would be inflicted upon the present occupants Gae to the zoning ordinance. It was moved by Councilmau Hobet, seconded by Councilman Riesland, and carried, that the appeal be denied, and the decision of the Planning Commission upheld for the reason that the Council is unable to make the findings as set forth in Subdivision B, Section 16 of Ordinance No. 398, as amended. RESOLUTION No. 1493 - Dedicating portion of Lot A-Chula Vista Manor for drainage Easement Offered by Councilman Hobel, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Riesland, Hobel, Logan, Halferty Noes: None Absent: Councilman DeWolfe ADJOURN}~NT It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the meeting adjourn to 3:00 P.~i.
