HomeMy WebLinkAboutcc min 1954/01/19MINUTF~ OF AN ADJOURNED REGULAR ;4EETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTS, California Held Tuesday January 19, 1954 The Council met in the Council Chambers at City Hall on the above date at I:OO~P.M., with the following Councilmen present: Councilmen Halferty, Riesland, Hobel, ~, DeWolfe Absent: C~u~cilman Logan Also present: City Administrator Floyd, City Planner Wagner, City Attorney ~.?. Campbell, City Finance Officer Grant, and Assistant to the City Engineer Johnson $'~ISCUSSION - Amendments to Business License Ordinance City Attorney Campbell reviewed for the Council the amendments to the Business License Ordinance, as recommended by the business license Con~mittee. A delegation representing the outside dry cleaning and laundry businesses, with Edward Brightbard, President of the San Diego Laundry & Dry Cleaners Association as spokesman, protested the $200.00 fee placed on their businesses on the basis of discrimination, and stated they would seek a Court decision before recommending that their members buy a license at that fee, Councilman Halferty wanted it known that he was not the sponsor of the $200.00 fee, as had been reported, and made the motion that the fee be lowered to $75.00 for each outside laundry or dry-cleaners truck. There was no second to the motion. It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the recommendations of the business license Committee be accepted. ORDINANCE No. 486 - Amending business license Ordinance No. 478 - First reading It was moved by Councilman Riesland, seconded by Councilman Hobel, and carried, that Ordinance No. 486 be placed on its first reading. The Ordinance was thereupon read in full. Councilman Logan arrived at this point. RESOLUTIONS Nos. 1499 to 1524, inclusive - Accepting dedication of interest in real property to City~-of Chula Vista (1911 Act) Offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Halferty, Riesland, Hobel, Logan, D~¥olfe Noes: None Absent: None O~qDINANCE No. 485 -Adopting a Fire Prevention Code and establishing a Bureau of Fire Prevention - First reading It was moved by Councilman Hobel, seconded by Councilman Logan, and carried, that Ordinance No. 485 be placed on its first reading. The Ordinmuce was thereupon read in full. ORDINANCE No. 484 - Annexation of Country Club Park No. 1 - Second reading It was moved by Councilman Hiesland, seconded by Councilman Hobel, and carried, that Ordinance No. 484 be placed on its second reading. After the reading of the title, it was moved by Councilman Riesland, seconded by Councilman Hobel and unanimously carried, that the reading of the text be waived. The Ordinance was thereupon adopted by the following vote, to-wit: AYES: Councilmen Halferty, 2iesland, Hobel, Logan, DeWolfe Noes: None Absent: None LETTER FROM CITY ET~PLO~ A letter was read, signed by 57 City employee~ opposing amy changes which would circumvent the established Chula Vista Civil Service procedure and/or the powers of the City Council. It was moved by Councilman Hobel, seconded by Councilman Riesl~nd, and carried, that the Administrative Officer be directed to write a letter to the employees, thanking them for their consideration and thoughtfulness in the matter. ~/~EQUEST FOR CHANGE IN CHICI~N ORDINANCE Mrs. E. E. Leith, 356 I. Street appeared to protest the keeping of chickens by her neighbors in that they were a detriment to her rental property, and asked that the present Ordinance be changed to require chickens be kept at least 75 or 100 feet from any dwelling. Mr. Willism~, owner of the chickens in question, stated he was in strict compliance with the Ordinance as it now stood. This was confirmed by Mr. Grady of the Inspection department. City Attorney M. Campbell stated that as long as the Ordinance was being complied with, there was nothing the Council could do in the matter. It was moved by Councilman Hobel, seconded by Councilman Halferty, and carried, that the discussion be dropped, and that the two parties settle the dispute among themselves. Mayor DeWolfe stated the Ordinance, being a recent one, would not be revised at this time, as it could not be changed to satisfy each individual case throughout the City. POLICE AND FIRE DEPARTMENT ~JAGE STANDARDIZATION It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the matter be put over to the next regular meeting of the Council. PROPOSED CHARTER CHANGE A proposed change to the City Charter was read to the Council with the recommendation by the Civil Service Commission that it be placed on the ballot in April. The change would allow a temporary appointment for a period of not to exceed six months, instead of the present three months° A copy of Special Consulting Attorney Boyer's opinion on the matter was filed with each Councilman. City Attorney M. Campbell concurred with Attorney Boyer's opinion, and did not recommend that the proposed chan~e be put on the ballot. It was moved by Councilman Riesland, seconded by Councilman Hobel, and carried, that the City Attorney be instructed to make further study of the proposed charter change, and give his recommendations at the next stated meeting. DISCUSSION - Rental of Recreation Hall to Lutheran Church City Administrator Floyd reported that the cost to the City for extra janitor serVice in order to rent the Recreation Hall on Sunday would be $15.OO. Mayor DeWolfe stated that in view of the fact that the new Park and Recreation Committee would meet the 3rd Thursday of each month, and their Minutes would be supplied to the Council, and also the Park Superintendent would attend each meeting, it would be wise to refer such requests for use of the building to the Committee for proper scheduling. It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the matter of renting the Recreation Building to the Lutheran Church be referred to the Recreation Committee, to he taken up at their next meeting. ~D.Y~SSION - Master Street Plan M~yor DeWolfe, in discussing the master street plan, felt it was time the Planning Commission came up with a plan something in line with the wishes of the Council for the past two years, when they hired a City Planner at the request of the Planning Commission, to do the necessary work. City Planner Wagner stated that a master street plan could never be completed in six or seven months as was intimated it should have been; that one plan had been developed but was abandoned because of the First Avenue controversy, and that the first of two public hearings had been held on a new plan, with the second hearir~ to be scheduled after the Planning Commission approves the Minutes of the meeting at which the last hearing was heldo It was moved by Councilman ~bel, seconded by Councilman Riesland, and carried, that the Mayor call a joint meeting of the Council and Planning Commission, after the next public hearing on the master street plan by the Plamhing Commission, to discuss problems and wishes of the Council. ~SALE OF PARK LOT IN PACIFIC GROVE It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that a minimum bid of $3500.00 be placed on the City owned Lot in Pacific Grove, and that the buyer put in the drain pipe and quiet title. RF~OLUTION No. 1498 - Calling for bids on Lot in Pacific Grove Offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Halferty, ]tiesland, Hobel, Logan, DeWolfe Noes: None Absent: None //~-~QUEsT FOR USE OF PARK THEATRE A letter was read from Charles Kiss, requesting the use of the Civic Theatre Building in the Park for use by the Gun and Rod Club. it was moved by Councilraan Riesland, seconded by Councilman Halferty, and carried, that the request be referred to the Recreation Commission.
