HomeMy WebLinkAboutcc min 1963/12/10 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday December 10, 1963 A regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McAllister, Menzel, DeGraaf Absent: Councilmen McMains, S~ith Also present: City Engineer Cole, City Attorney Duberg, Administra- tive Officer Ross, Assistant City Planner Warren Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment of silent prayer. Statement: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the regular meeting of December 10, 1963. APPROVAL OF COUNCIL MINUTES It was moved by Councilman McAllister, seconded by Councilman DeGraaf, and carried that the Council minutes for the meetings of November 12, 19, 26, and December 3 be approved, as mailed. .~BLIC HEARING - Rezoning of one lot south of Madrona and 150 feet east of Third Avenue and establishing a five-foot building line This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-3 to C-1-P of one lot on the south side of Madrona Street, 150 feet east of Third Avenue and on the establishment of a five-foot building line, Mayor Menzel declared the hearing open. No one wishing to be heard either for or against the proposed rezoning and the Clerk having received no written protests, the Mayor declared the hearing closed. ORDINANCE NO. 868 - Rezoning lot on Madrona Street, east of Third Avenue - First reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and carried that Ordinance No. 868 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,McAllister, Menzel Noes: None Absent: Councilmen Smith, McMains UBLIC REARING - Prezoning of Allen-Cromer Annexation This being the time and place, as advertised, for a public hearing on the proposed prezoning of the Allen-Cromer Annexation to R-1-A (Single Family one acre), Mayor Menzel declared the hearing open. Hr. Garth Knapp, property owner in the annexation, protested the proposed R-1-A zoning, stating that when he was approached to annex his property to the City, he was assured that the zoning would remain as it was. He asked that the annexation be withdrawn unless the half acre lot zoning is retained. Mr. R. M. Allen, property owner in the annexation, stated that be- cause of the topography of the annexation, most of his property would be suited for the R-1-A zoning but agreed most of the Knapp property would lend itself better to half acre lot zoning. It was his contention that road frontage of a lot was more important than area requirements. Mr. Stephen Gassaway, speaking for the Sweetwater Valley Civic Asso- ciation, stated that the association does not oppose development of half acre lots in the area but would prefer that the area be zoned R-I-A, as proposed, temporarily with the hope the developers will develop the area as much as possible with a buffer zone of acre lots between any half acre lots which might be developed and those acre lots which are already developed. No others wishing to be heard either for or against the proposed prezoning and the Clerk having received no written protests, the Mayor de- clared the hearing closed. Mr. Knapp was assured that the zoning proposed was temporary and will be reconsidered by the Planning Commission and City Council for permanent zoning at the C/uae the subdividers submit a subdivision map for development of the area, ORDINANCE NO. 869 - Approving prezoning of Allen-Cromer Annexation - First reading and adoption It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and carried that Ordinance No. 869 be placed on its first reading, that reading of the text be waived and the ordinance adopted as an emergency ordinance. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, HcAllister, Menzel Noes: None Absent: Councilmen Smith, McMains ORDINANCE NO. 863 - Approving Allen-Cromer Annexation - Second reading It was moved by Councilman DeCraaf, seconded by Councilman McAllister, and carried that Ordinance No. 863 be placed on its second reading, that reading of the text be waived and the ordinance adopted. The motion carried~ by the following vote, to-wit: AYES: Councilmen DeGraaf, HcAllister, Menzel Noes: None Absent: Councilmen Smith, Hc2iains ~PuBLIC HEARING - Prezoning Small Annexation This being the time and place, as advertised, for a public hearing on the proposed prezoning of the Small Annexation to R-3, Mayor Henzel clared the hearing open. No one wishing to be heard either for or against the proposed prezoning and the Clerk having received no written protests, the Mayor declared the hearing closed. Councilman DeGraaf expressed dis- satisfaction to the R-3 zoning. There being no second to the motion of Councilman McAllister to place the ordinance on its first reading, action was held over one week. ORDINANCE NO. 867 - Rezoning property at northwest corner of Woodlawn and 'F" Street - Second reading There being no second to the motion of Councilman DeGraaf to adopt the ordinance, action was held over one week. APPOINTMENT OF HEMBER TO LIBRARY BOARD Held over one week for action by full Council. REPORT ON NEGOTIATIONS FOR HURAOKA PROPERTY Administrative Officer Ross reported that negotiations on the acqui- sition of street right of way at the intersection of Broadway and Parkway resulted in an offer by Hr, Muraoka to dedicate twenty-four feet of his property north of the centerline of Parkway for the full length of his prop- erty for $1,300.00, the City to install at City expense the curbs, gutters, sidewalks and shoulder paving. Mr. Ross recommended that the offer be ac- cepted because further litigation on acquisition of the property for the widening of Parkway would probably be more costly to the City. Appropria- tion of the $1,300.00 was held over one week for action by a full Council. AHVETS AUTHORIZED TO SOLICIT FOR DISCARDED ITEMS IN CITY Administrative Officer Ross having checked with the AMVETS Post No. 5 of San Diego on their request to solicit for discarded items in Chula Vista, recommended that the Council approve the request and waive the solicitors' fees with the understanding that Al/VET personnel will do the soliciting in the City after having filed with the Police Department. It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and carried that the request of the AMVETS for soliciting in the City be granted, providing the organization uses only AMVETS who are registered with the Police Department. Also that the solicitation fees be waived. Mrs. Anne Hedenkamp expressed opposition to allowing any more organi- zations soliciting in the City for discarded items. A letter was submitted from the Planning Co~ission recvmending that four lots on Otay Lakes Road in Bonita Bel-Aire Subdivision be rezoned from R-l-B-20 to R-3-D-B-4. It was moved by Councilman McAllister, seconded by Councilman DeGraaf, and carried that January ? at ?:00 P.M. be set as the time for a public hearing on the proposed rezoning. RESOLUTION NO. 3268 - Approving Change order No. 2 - Gas Tax Project 42, Unit 2 Offered by Councilman DeGraaf, passed and adopted by the following vote, to-wit: A~ES: Councilmen DeGraaf, McAllister, Henzel Noes: None Absent: Councilmen Smith, McMains P~$OLUTION NO. 3269 - Approving street improvement agreement between the City and Frank Ferreira Offered by Councilman HcAllister, passed and adopted by the following vote~ to-wit: AYES: Councilmen McAllister, Menzel, DeGraaf Noes: None Absent: Councilmen Smith, McMains RESOLUTION NO. 3270 - Accepting, dedicating and naming property for street purposes - Bonita Road Offered by Councilman McAllister, passed and adopted by the following vote, to-wit: AYES: Councilmen McAllister, Menzel, DeGraaf Noes: None Absent: Councilmen Smith, McMains /~EVENTH DAY ADVENTIST CHURCH GRANTED PERMISSION TO SOLICIT FOR CHRISTMAS Administrative Officer Ross stated a request has come in from the Seventh Day Adventist Church for permission to carry on Christmas caroling and a solicitation program in the City from December 11 through December 29, 1963. They request that any fees be waived. It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and carried that the request be granted. EqUEST OF AMBULANCE SERVICE TO BE ADDED TO POLICE CALL LIST A letter was read from the Crawford Ambulance Service, 864 Broadways requesting that the Council direct that they be placed on the City police call list. Referred to Administrative Officer Ross for report at the next meeting. /~'SUPPORT GIVEN TO RESOLUTION OF SOUTH BAY HIGHWAY ASSOCIATION A resolution was read from the South Bay Highway Association addressed to the State Division of Highways, urging that they initiate the necessary action to commence construction of Highway No. 241, starting at the Border and its first phase to be continued to Highway 280 and Highway 94 at the earliest possible date. It was moved by Councilman DeGraaf, seconded by Councilman McAllister, and carried that the Council expressas itself in support of this resolution. ADJOURNMENT Mayor Menzel adjourned the meeting at 8:05 until January 17, at ?:00 P.M. City Clerk
