Held Tuesday, April 13, 1954
The Chula Vista City Council met in the Council Ch~aber at Civic Center
at 7m00 P.M. on the above date with the following Councilmen present.' DeWolfe,
Riesland, Hobel, Halferty, Logan. Also Presmt: City Administrator Floyd,
City Plarmer Wagner, Asst. to the City Engineer, Johnson, Acting City Attorney,
Boyer.
APPROVAL OF MINUTES - City Council.
It was moved by Councilman Rios]and, seconded by Councilman Hobel and unani-
mously carried, that the minutes of the meetings cf March 9, 23 and 29 be ap-
provsd, copies having been mailed to each Councilman.
APPROVAL OF MINUTES - Planning Commission.
It was moved by.Councilman Halferty, seconded by Councilman Hobel and unani-
mously carried, that the minutes of the Planning Commisai~ meeting of March 15
be approved, copies having been mailed to each Councilmm.
PUBLIC HEARING - Annexation of Country Club Park No. 2.
This being the time and place, as advertised, for a public hearing on the
above-mentioned annexation, Mayor DeWolfe declared the public hearing open and
called for protests from the audience. There being no protests, either oral or
written from property owners within the territory proposed to be annexed~ or
otherwise, Mayor DeWolfe declared the public hearing closed.
ORDINANCE NO. 489 - Approving Annexation of Country Club Park No. 2 -
First Reading.
It was moved by Councilman Rieslend, seconded by Councilman Hobel and uaani-
mously carried, that Ordinance No. 489 be placed on its first reading. It was
thereupon read in full.
yAGRE~T - Rental of Public Library.
Mayor DeWolfe stated that it had been originally intended to add on to the
presemt library, but after studies the recommendation was made to build a new
library on the Civic Center grounds. However, since a large bond issue had been
passed by a close majority for a ~wimming pool and recreation center, it was
felt at this time that another bond issue would not be practical. He farther
stated that there was ~othar alternative, that of an agreement with a con-
tractor to build the building on City property, the City to lease the building
from the builder with the option of buying it after a 25 year period.
Councilman Riesland reported that the Library Committee recomaended that
the agreement be accepted.
RESOLUTION NO. 154~ - Agreement for Construction of Public Library
Building, Leased and Sub-Leased.
Offered by Councilman Riesland, read in full, passed, adopted and approved
by the following vote, to-wit:

NOES: None.

It was moved by Councilman Riesland, seconded by Councilman Hobel and unani-
mously carried, that Mr. Boyer be designated as Deputy City Attorney, witb6u%
compensation, for the da~e
PUBLIC HEARING - ~zoning of Shapov Tract and Country Club Villas No. 2.
This being the time end place, as advertised, for a public hearing on the
above-mentioned Szoning, Mayor DeWolfe declared the public hearing open.
There being no remarks or objections, either oral or written, Mayor DeWolfe de-
clared the public hearing closed.
ORDINANCE NO. 490 - Amending Zoning Ordinence to Include Shapov Tract
and Country Club V1llas No. 2 - First Reading.
It was moved by Councilman Hobel, seconded by Councilmen Rieslend end unani-
mously carried, that the ordinance be placed on its first reading. It was
thereupon read in full.
~/FINAL MAP - Miles and Dalseth No. 4 Subdivision - Harold Foster.
It was moved by Councilman Riesland, seconded by Councilman Halferty end
unanimously carried, that the FInA~_ M~p of Miles and Dalseth No. 4 be accepted
upon the execution by the owner of a contract with the City of Chula Vista for
the installation of improvements end the posting of a bond or the deposit of
cash with a Trust Company guaranteeing the performance thereof, which contract
end guaranty shall be first approved by the City Attorney as to form and legality,
end subject to Lots A and B being deeded in fee to the City of Chula Vista.
RESOLUTION NO. 1544 - Approving Agreement for Const~uctic~ of Improvements
in Miles and Dslseth No. 4.
Offered by Councilman Hobel, read in fu~l, passed, adopted and approved by
the following vote, to-wit:
AYES: Oouncilmen Hobel, Riesland, Halferty, Logen, DeWolfe.
NOES: None.
ABSENT: None.
~/TENTATIVE MAP - Country Club Perk No. 3 - Mr. Freelend.
It was moved by Councilman Rieslend, seconded by Councilman Halferty and
unanimously carried, that the Tentative Map of Country Club Park No. 3 be ap-
proved as reca~mended by the Plannt~g Commission and subject to improvements
required by Section 7 of the Subdivision Ordinance.
~/T~I~TATIVE MAP . Kenwood Village No. 4 - Henry Algert.
It was moved by Councilman Hobel, seconded by Councilman Riasland and unani-
mously carried, that the Tentative Map of Kenwood Village No. 4, heretofore ap-
proved by the Planning Commission, be approved subject to check by the Engineering
department and subject to improvements required by Section 7 of the Subdivision
Ordinance.
RESOLUTIC~ NO. 1%46 - Approving Agreement for Construction of Improvements
in W. O. Smith Tract.
Offered by Councilman Riesland, read in full, passed, adopted and approved
by the following vote, to-wit:
AYES: Councilmen Riesland, Hobel, Halferty, Logan, DeWolfe.
NOES: Non~.
ABSENT: None.
~/DISCUSSIO~ - Req~4~ed Payment to Those Desiring to Connect to
Country Club Park TA~mk Line Sewer.
Mr. Johnson, Assistant to the City Engineer, asked that a rate be established
for those wishing to Ceunect to Country Club Park trunk line sewer. After a
general discussion, it was moved by Councilman Rieslend that $15.00 per lo% be
charged. The motion failed for lack of a second.
It was moved by Councilmen Riesland, seconded by Councilmen Halferty~ end
unanimously carried, that the hookup charge on all subdivisions coming in for
annexation not. exceed.$15.00,¥subJect to a review by the City Attorney.

~PLANNING COMMISSI0~ RECOMMENDATION.
The City Clerk read a letter from Mr. Wagner, City Planner, outlining Plan-
ning Commission recommendations on the use of City land for storing metal to
be shipped. It was moved by Councilman Halferty, seconded hy Councilman Hobel
and unanimously carried, that the City Attorney be instructed to draw up a
lease, as indicated in Mr. Buford's letter, for a year, s option at $75.00 per
month, and to negotiate a lease fee, terms of said lease to include "~ burning"
clause, and report back to the Council.
PLANNING CO~giTSSIO~ RECOMMENDATION.
~he City Clerk read a letter from Mr. Wagner, City Planner, outlining Plan-
ning Cmmaission reCommendations that the Council request a hearing on freight
rates. After a general discussion, it was moved by Councilman Halfsrty, sec-
onded by Councilman Logan and unanimously carried, that a letter be written by
the Mayor to the California Public Utilities Co~mission recommending that actic~
be taken to hold a public hearing within the City of Chula Vista to establish an
equalization of freight rates, and offering any assistance necessary.
~LANNING C0~I$$I~ RECO~DATI(N.
The City Clerk read a letter from Mr. Wagner, City Planner, outlining the
Planning Commission' s reecem~adation to protest the design of the proposed
St. overpass over Montgomery ~eeway. After a general discussion, it was moved
by Councilman Halferty, seconded by Councilman Hobel and unanimously carried~
that the City Council advise the State Highway Department that because of the
proposed construction of the overpass, that the Council reCommends that no bids
be let because the City of Chula Vista does not approve of the proposed design.
~TTER - Recommendation on Sewer Easements.
The City Clerk read a letter from Mr. Johnson, Assistant to the City Engineer,
rec~amending that the City not acquire any additional sewer easements which will
present a maintenance problem, but rather, that an alley be obtained. Mr. Boy. r,
a property owner who would be affected, stated that he and other property owners
felt it was unfair of the City to require an alley instead of a sewer easement.
After a general discussion, Mayor DeWolfe recommended that the matter be carried
over to the May llth meeting.
At this point, Mr. Arthur Lynds app. eared before the Council to thank them
for their far-sighteduess in approv~ ~the new Public Library.

The City Clerk read a letter from the Secretary of the California League of
Cities, outlining receamendations of the League Civil Defense Policy Committee.
Mayor DeWolfe recommended that additional copies be obtained and that the matter
be carried over to the next meeting.
~.F-~ TAX REFUND CLAIM.
A claim for refund on over-pa2ment of sales taxes, based upon a recent audit
by the State Board of Equalization, was presented to the Finance Department by
Lee and Leschorn, general contractors. This claim was presented after the 90
day time limit as stated in the City Charter. The claim appeared valid in every
other respect, but was not presented within the proper time. It was moved by
Councilman Hob.l, seconded by Councilman Riealand and unanimously carried, that
the matter be referred to the City Attorney and if the money can be legally re-
funded, that such action be taken.
~/TRANSFER OF LIBRARY APPROPRIATION
City Administrator Yloyd a~ked permission of the Council to transfer $58,000.00
from the Library Fund - Cmpital Outlay to the Sewer Income F~nd for the Naples
St. trunk line sewer. It was moved by Councilman Riesland, seconded by Counci~a~en
Halferty, and unanimously carried, that the City Administrator be authorized to
transfer the above-mentioned fund. The motion was carried by the following vote,
to-wit:
AYES: Councilmen Riss!and, Halferty, Hob.l, Logan, DeWolfe.
NOES: None.
ABSENT: None.
~~ATI~S - Street and Highway Committee - Cha~aber of Commerce
The City Clerk reaa a letter frc~ Walter Davis, Manager of the Ch~ber of
Cc~aerce, outlining certain recommendations made by their Street and Highway
Ccemuittee. It was moved by Councilman Halferty, seconded by Councilman Hobel
and unanimously carried, that each Councilman be give~ a copy of the letter so
that rec~dations may be made at the next meeting.
~/CC~RESP~I~ ~NCE
The City Clerk read a letter from J. R. Goodbody, City Attorney of Coronado
requesting that tb~ City of Chula Vista grant a transfer of territory to the
City of San Diego to create a corridor down the bay. Councilman Logan stated
that, in his opinion, the City of Chula Vista should do everything possible to
stop San Diego from getting the corridor down the bay. After a general dis-
cussion, it was moved by Councilman Halferty, seceded by Councilman Hobel and
unanimously carried, that the Chula Vista City Council is willing to negotiate
and cooperate with Coronado in arriving at the plan of this corridor.

It was moved by Councilman Hobel,seconded by Councilman Logan and unani-
mously carried, that Warrants No. 7943 to 8076 be approved for payment, by the
following vots~ to-wit:

NOES: None.
ABSENT.. None.
ADJOURNMenT
It was moved by Councilman Logan, seconded by Councilman Riesland and unani-
mously carried, that the meeting adjourn until 2:00 P.M., April 14, 1954.
