OF THE CITY COUNCIL OF THE
CITY OF CNULA VISTA, CALIFORNIA
Held Tuesday February 25, 1964
An adjourned regular meeting was held in the Council Chambers by the
City Council on the above date at 7:00 P.M. with the following Councilmen
present: Councilmen McMains, McAllister, Menzel, DeGraaf
Absent: Councilman Smith
Also present: City Engineer Cole, City Attorney Duberg, Administrative
Officer Ross, Acti~ Director of Planning Warren
Mayor Menzel led the pledge of allegiance to the Flag and asked for a moment
of silent prayer.
Statement: The City Clerk hereby states that he did post within 24 hours
of adjournment, as provided by law, the order of adjournment
of the adjourned regular meeting of February 25, 1964.
~/~EPORT OF FINDINGS OF PLANNING COmmISSION - Appeal of N. A, Kromydas
A report of findings was submitted from the Planning Co~ission on
the appeal of Nicholas A. Kromydas to action of the Planning Commission deny-
ing him a reduction in front yard setback from fifteen feet to thirteen feet
on property at 782 Melrose Avenue. It was moved by Councilman McMains, sec-
onded by Councilman DeGraaf, and carried that the matter be set for hearing
on-March 10 at 7:00 P.M.
~/~PORT OF FINDINGS OF PLANNING CO}94ISSION - Appeal of Mrs. James Logan
An appeal was read frnmMrs. James R. Logan to certain stipulations
made by the Planning Commission in granting her a variance for a lot split
on property at 88 Hilltop Drive. The Planning Commission report of findings
was submitted to the Council. It was moved by Councilman DeGraaf, seconded
by Councilman McMains, and carried that the matter be set for hearing on
March 10 at 7:00 P.M.
ORDINANCE NO. 879 - Amending dance hall Ordinance No. 738 - Second reading
It was moved by Councilman McMains, seconded by Councilman McAllister,
and carried that Ordinance No. 879 be placed on its second reading, that
reading of the text be waived and the ordinance adopted. The motion carried
by the following vote, to-wit:
AYES: Councilmen McMains, McAllister, Menzel, DeGraaf
Noes: None
Absent: Councilman Smith
~/~ROTEST TO BEER LICENSE AUTHORIZED
City Administrator Ross reported that the application of the La Casita
restaurant at 256 Third Avenue was not for a limited license and it was his
recommendation that the Alcoholic Beverage Control Board be contacted with
the request that only a limited beer license be issued to the La Casita. It
was moved by Councilman DeGraaf, seconded by Councilman McMainl, and carried
that the Alcoholic Beverage Control Board be requested to issue only a lim-
ited beer license to the La Casita and that the City Attorney be directed to
file an official protest on the application for an unlimited license.
NOTICE OF HEARING ON FREEWAY LOCATION
A letter was read from the State Division of Highways giving notice
of a public hearing to be held at 10:00 A. M.~ Monday, March 23, 1964, at
the Ella B. Allen School in Bonita to discuss the proposed freeway location
of Route 282 between Route 281 near Brown Field and Routes 280/285 near Sweet-
water Reservoir.
~{EquEST FOR RESOLUTION PROHIBITING USE OF TOBACCO BY MINORS
A letter was read from Councilman J. O, Lee Soloman of Redondo Beach
urging that the Council adopt a resolution requesting that the League of
California Cities sponsor legislation at the 1965 General Session of the
Legislature to expressly prohibit the use or other consumption of tobacco
in any form by minors. Referred to Administrative Officer Ross.
~PLAqUEST THAT GHARTER AMENDMENT TO PROVIDE FOR Tile ELE~ION OF A HAYOR BE
CED ON BALLOT
Hr, Paul Yeager requested that the Council rescind its action of the
last meeting adopting Ordinance No. 877 which submitted to the electors cer-
tain propositions which would amend the Charter. Mr, Yeager requested that
the matter of electing the Hayor be added to the other propositions for de-
cision by the voters of the City. Mrs. Paul Yeager read a petition signed
by five hundred voters requesting that the matter of electing the Mayor be
placed on the ballot for the coming election. She urged the Council to con-
sider the petition.
Mr. Yeager questioned the legality of Ordinance No. 877 because the
legal publication of the ordinance did not appear to have the same wording
in its entirety as that adopted by the Council. City Attorney Duberg stated
that the original ordinance on file with the City Clerk was the one adopted
by the Council. No action taken by the Council.
~/~YATTORNE¥ AUTHORIZED TO ATTEND CONFERENCE
It was moved by Councilman DeGraaf, seconded by Councilman McMains,
and carried that the City Attorney be authorized to attend the Spring Con-
ference of the City Attorney's Department of the League of California Cities,
at Honterey, April 1, 2 and 3.
ADJOURNMENT
Mayor Menzel adjourned the meeting at 7:40 P.M. until March 3, t964,
at 7:00 P.M.
