OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA, CALIFOI~NIA
Held Tuesday July 21, 1964
An adjourned regular meeting was held in the Council Chambers by the City
Council on the above date at 7:00 P.M. with the following Councilmen present:
Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson
Absent: None
Also present: City Engineer Cole, City Attorney Duberg, Administrative Officer
Ross, Director of Planning Warren, Assistant Administrative
Officer Stenberg
Mayor Sparling led the pledge of allegiance to the Flag and asked for a moment
of silent prayer.
Statement: The City Clerk hereby states that he did post within twenty-four
hours of adjournment, as provided by law, the order of adjourn-
ment of the adjourned regular meeting of July 21, 1964.
~/~BLIC HEARING - Phase X,
1911
Block
Act
This being the time and place, as advertised, for a public hearing on
Phase X of Chapter 27 of the 1911 Block Act, Mayor Sparling declared the hear-
ing open. The Clerk read letters of protest from the Metropolitan Land Company
for property at the southwest corner of "E" Street and Woodlawn Avenue; from
Mr. Cora H. Hanson for property at 85 Fifth Avenue, and from Saburo Muraoka for
property at 103, 109 and 113 West Quintard Street.
Mr. Muraoka spoke in support of his letter asking for an extension of
twelve months.
Mr. Ray Halpenny requested a twelve-month extension on the installation
of improvements in front of his property at 670 "F" Street pending development
of the property.
No others wishing to be heard, the Mayor declared the hearing closed.
After discussion, it was moved by Councilman McCorquodale, seconded by
Councilman McAllister, and carried that the property of the Metropolitan Land
Company and Mr. Muraoka be deleted at this time and that the property of Mr.
Halpenny be deleted with the provision that he post a bond assuring the instal-
lation of improvements within twelve months.
RESOLUTION NO, 3456 - With respect to hearing on Phase X of the 1911 Block Act
Offered by Councilman McCorquodale, passed and adopted by the following
vote, to-wit:
AYES: Councilmen McCorquodale, Anderson, McMains, McAllister, Sparling
Noes: None
Absent: None

This being the time and place, as advertised, for a public hearing on the
proposed Loma Verde School Annexation, Mayor Sparling declared the hearing open.
No one wishing to be heard either for or against the annexation and the Clerk
having received no written protests, the Mayor declared the hearing closed.
ORDINANCE NO. 893 - Approving the Loma Verde School Annexation - First reading
It was moved by Councilman McAllister, seconded by Councilman Anderson,
and carried that Ordinance No. 893 be placed on its first reading and that read-
ing of the text be waived. The motion carried by the following vote, to-wit:
AYES: Councilmen McAllister, Sparling, McCorquodale, Anderson, McMains
Noes: None
Absent: None
~PUBLIC HEARING - (continued) Intention to vacate sewer easement in portion of
Telegraph Canyon Road
This being the time and place, as designated, for the continuation of a
public hearing on the proposed vacation of a sewer easement in a portion of
Telegraph Canyon Road, Mayor Sparling declared the hearing reopened. No one
wishing to be heard either for or against the proposed sewer easement vacation
and the Clerk having received no written protests, the Mayor declared the hear-
ing closed.
City Engineer Cole stated that all terms of an agreement with Robinhood
Homes, Inc., for realignment of the sewer have been complied with.
RESOLUTION NO. 3457 - Vacating and closing portion of sewer easement in portion
of Telegraph Canyon Road
Offered by Councilman McCorquodale, passed and adopted by the following
vote, to-wit:
AYES: Councilmen McCorquodale, Anderson, McMains, McAllister, Sparling
Noes: None
Absent: None
ACTION OF APPEAL OF LAWTON AND LIENHARD TO ACTION OF THE PLANNING COMMISSION
DENYING CONDITIONAL USE PERMIT FOR 349 "H" STREET
City Attorney Duberg reviewed his written opinion, on file with the City
Clerk, on the matter of the appeal of Lawton and Lienhard to action of the Plan-
ning Commission in denying their application for a conditional use permit for
property at 349 "H" Street.
It was moved by Councilman McAIlister that the action of the Planning
Commission be overruled and the appeal granted. The motion died for lack of
a second.
It was moved by Councilman McCorquodale, seconded by Councilman Anderson,
and carried that the matter be referred back to the Planning Commission with
the City Attorney's report and with the understanding that the Council is de-
sirous of granting this conditional use permit.
~/REpoRT ON PERMANENT FINANCING OF PARKING DISTRICT
Administrative Officer Ross reviewed his written report on proposals for
financing the Parking District No. 1 on a permanent basis.
It was moved by Councilman McCorquodale, seconded by Councilman McMains,
and carried that the Administrative Officer be authorized to engage the firm
of O'Melveny & Myers for the purpose of preparing an amendment to the 1951
Parking District Act for introduction to the Legislature in January.
It was moved by Councilman McAllister, seconded by Councilman McMains,
and carried that if the amendment to the 1951 Parking District Act receives
favorable action by the Legislature that the Council consider advancing funds
to the Parking District on a permanent basis. Councilman McCorquodale voted no.
It was moved by Councilman McCorquodale, seconded by Councilman McMains,
and carried that an interest rate equal to the best rate obtainable by the City
be added to any funds advanced to the Parking District.
It was moved by Councilman McAllister, seconded by Councilman McCorquo-
dale, and carried that $110,000.00 from the surplus in the Parking Meter Fund
be advanced to the Parking District for reducing their $320,000.00 obligation
to the City. Councilman McMains and Councilman Anderson voted no.
It was moved by Councilman McAllister, seconded by Councilman Anderson,
and carried that $135,000.00 from the surplus in the Parking Meter Fund be
advanced to the Parking District for reducing their $320,000.00 obligation to
the City.
[~ALL FOR BIDS ON FIRE STATION NO. 4 AUTHORIZED
It was moved by Councilman McAllister, seconded by Councilman Anderson,
and carried that the City Engineer be authorized to call for bids at the pre-
vailing minimum wage scale for construction of Fire Station No. 4.
REpORT ON STATE EMPLOYMENT OFFICE SITE
Administrative Officer Ross reported on the matter of the State Depart-
ment of Employment seeking a location for a proposed employment office in the
South Bay area and stated that the Department showed particular interest in
the property owned by the City at the northwest corner of "F" Street and Gar-
rett Avenue. There seemingly not being any private property available which
meets the requirements of the Department of Employment, Mr. Ross asked for
opinions from the Council on the matter of leasing the City property at "F"
and Garrett Avenue to builders who in turn would lease it to the State.
Mr. Frank Whittington, speaking for himself and Myron Dalseth, as build-
ers, stated they would be interested in leasing the land for building the
necessary building for the State with a proposal that the building would revert
back to the City after a period of twenty years if vacated by the State or
would sell to the City at a depreciated value if vacated by the State in five
or ten years.
It was moved by Councilman McMains, seconded by Councilman Anderson, and
carried that the City proceed with leasing of this property at six per cent of
the fair market value, that an up-to-date appraisal be made to determine the
present fair market value and that this information be forwarded to the State.
Mrs. Marie Aland was desirous of knowing if future needs of the City for
the land would permit its being leased to the State and expressed concern that
there would not be a public hearing on the matter.
Mrs. Aland was assured there was plenty of land available for City ex-
pansion in the next twenty years.
ADJOURNMENT
Mayor Sparling adjourned the meeting at 8:50 P.M. until July 28 at 7:00
P.M.
