HomeMy WebLinkAboutcc min 1955/01/18MINUTES OF A REGULAR ADJOUP~ MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday January 18, 1955 The City Council of the City of Chnl~ Vista met in the Council Chamber at Civic Center on the above date at 7:00 P.M. with the following Councilmen present: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Also present: City Administrator Floyd, Principal Civil Engineer Johnson, City Attorney Merideth Campbell ~'~ISCUSSION ON LIBRARY Attorney DeWitt Higgs, representing the builders of the new Library stated there were no Charter provisions or State laws prohibiting the lease- option form of contract, and that not only was it legal, but a highly desirable form of financing public buildings used extensively by State, County, and City agencies. Both Attorney Fletcher, who drafted the Library contract, and Arthur Lynds, representing the builders, stated their files were open to the Council or anyone they might appoint to study the matter. Councilman Rader asked if it would be possible to pay the Contract off at any time, or if it had to run the full twenty-five years. Mr. Lynds stated if the Council saw fit to pay cash within a reasonable time, his company would be glad to sit down and negotiate toward that end. Mayor Mansell was of the opinion the people generally were not opposed to a new Library, but the manner in which it was financed. He felt the lease-option agreement was Just a manner to circumvent the wishes ca a two-thirds majority of the people. Mayor Mansell read statistics on the present Library, and Mrs. Stewart City Librarian, expl-~ned the inadequacy of the present Library. In answer to a query from Councilman Smith, City Attorney Campbell stated the City has a free and clear title to the old Library site, and that it could he sold, but suggested negotiating with the School District on the contract attached to the Deed. Councilman ~mith recommended the contract be reviewed by the Attorney and if it is possible to dispose of the old Library site and pay cash for the new Library, the people should be so appraised and allowed to express their opinions. ORDINANCE No. 510 - Amending Business Ordinance No. 505 It was moved by Councilman Rader, seconded by Councilman DeWolfe, and carried, that Ordinance No. 510 be introduced. The motion ca~A~ied by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Ordinance was thereupon read in full. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGree?, Mansell, Smith, DeWolfe Noes: None Absent: None ORDINANCE No. 5~ - Amendin4~ Firearm~ ordinance No. 503 It was moved by Counc~l,~n DeGraaf, seconded by Councilman DeWolfe, and carried, that Ordinance No. 508 be adopted, and that the headin~ only be read. The motion carried by the following vote, to-wit: AYES: Noes: Absent: Councilmen Rader, DeGraaf, Mansell, Smith, DeWoLfe None None ORDINANCE No. 499 - Regulating storage of merchandise on Sidewalks-First reading It was moved by Counc41-mn Rader, seconded by Councilman DeGr-=*, and carried, that Ordinance No. 499 be introduced. The motion carried by the following vote, to-wit~ AYES: Councilm~n Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Ordinance was thereupon read in full. Councilman Rader stated he was opposed to the Ordinance in its present form, as he co~.l~ see no acute need for it at the present time. John Angel, National Avenue Merchant, spoke against the Ordinance and asked the Council to com~ider width of sidewalks when considering the 0~dinance again, and to regulate the size of signs. ~PORT ON E~ECTRIC RATE INCREASE City Administrator Floyd stated the City of San Diego had engaged Counsel for the hearing on February 2nd to determine if the San Diego Gas and Electric Company is entitled to a rate raise on electricity. I~ it is determined at that time that a raise is Justified~ the Cities will have until April to file protests. ~NG OF SPECIAL AUDITOR AUTHORIZED It was moved by Councilman Smith, seconded by Councilm~ Rader, and carried, that Mayor Mansell hire one of the four outside auditors he had contacted to audit the City books for the last five years, and that an amount not to exceed Five thousand Doll.ws be appropriated from unappropriated surplus to cover the cost. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None ~IVIL SERVICE COMMISSION RECOMMENDATIONS APPROVED A letter was read from the Civil Service Commission recommending that Section 12 of Rule II of the Civil Service Rules be amended by adding the position of Supervisor of Youth Center as Class C-12 at salary Range 16. The prescribed compensation to he based on a ~11 time month with a normal work week of 40 hours. It was moved by Counc~ lm~n Smith, seconded by Councilman-Rader, and unanimously carried that Section 12 of Rule II be amended as recommended by the Civil Service Commission. The motion carried by the following vote,to-wit~ AYES: Councilmen Rader, DeGr~.~*, Mansell, Smith, DeWolfe Noes: None Absent: None TO SU D S ON ORDmA Mr. Lloyd Lee, representing the San Diego Building Contractors, requested that a co~ittee be appointed to study the Subdivision Ordinance with the thought in mind of eliminating some of the red tape and especially the requirement that a Bond be posted prior to the approval by the Council of final maps. M~yor Mansell appointed Councilman DeWolfe, Councilm~u Smith, and Principal En~inser Johnson to serve on the C~ttee. ON LO D SP nmS John J. Murphy, 56P Parkway complained that loud speakers in Trailer Courts on National Avenue were still causing a disturbance for surrounding residents, and asked that an Ordinance be passed prohibiting such nuisances. Mayor Manse11 said the Council would take it under advisement, and if necessary pass a nuisance ordinance. ~REQUEST FOR NEW FOOTING ORDINANCE Mr. John Freeman, 643 E. Manor Drive stated that the present City requirements for a footing for a new fence were not rigid enough, and once more asked that a new ordinance be adopted calling for a fourteen inch footing. Mayor Mansell stated the matter would be investigated. ~BRARY BOARD APPOINTMENT None of the Councilmen having a name to submit for replacement of Mrs. Hall on the Library Board, it was suggested that the Library Board be asked to rec~end someone for membership on the Board. APPOINTMENT OF MEMBERS TO THE PLANNING CO~2SION Councilm~u Rader submitted the name of Lee A. Raitt~ and Jack H. Perrine was recommended by the Planning Commission for membership on the Commission. No other names were submitted. It was moved by Councilman DeGraaf, seconded by Councilman ~m~th, and carried, that Jack H. Perrins be appointed a member of the Planning Commission, the term to expire June 30, 1955. It was moved by Councilm~u Rader, seconded by Councilman Smith, and carried, that Lee A. Raitt be appointed a member of the Planning Commission the term to expire June 30, 1955. ~ RESIGNATION FROM PLANNING COMMISSION ~ITHDRAWN Mr. Henry Farris, from the a,,d~ ence, withdrew his resignation from the Planning C~m~ission. OINTM~IT OF MEMBER TO HARBOR 00~SION Councilm~ DeGr~=f stated he had contacted all members of the Harbor Commission, and they indicated they were willing to continue serving on the Cemm~esion, with the exception of Richard Turgon, who had moved from the City. Councilwmu DeGraaf submitted the name of Ronald E. Landells to replace Mr. Turgon. No other names were submitted. It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that Ronald Landells be appointed to fill the unexpired term of Mr. Turgon, said term expiring June 30, 1955 It was moved by Councilman DeGr~a~, seconded by Councilman ~mith and carried, that the resignations of Members K~ester, Stocker, Hall, and Dillion not be accepted, ~d that they be so notified. ~PPOINT~ OF N~I~S TO THE REC~ATION C0~ISSION The name of John Anderson was submitted by Councilman Rader and the name of William Rathmann by Councilman Smith for membership on the Recreation Commission. No other ~mes were submitted. It was moved by Councilman Rader, seconded by Councilman DeGraaf, and carried, that Mr. John Anderson be appointed a member of the Recreation Commission, the term to expire June 30, 1955. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that Mr. William Ratbm~un be appointed a member of the Recreation Commission, the term to expire June 30, 1955 ORDINANCE No. 509 - Authorizing Manager and Chief-of-Police to designate traffic control regulations. It was moved by Councilman Rader, seconded by Councilman DeWo~fe, and carried, that Ordinance No. 509 be introduced. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Ordinance was thereupon read in ~ull. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGr~a~, Mansell, Smith, DeWolfe Noes: None Absent: None NEW 'ST~a~T EMPLOYEES AUTHORIZED It was moved by Councilman Rader, seconded by Counci/man Smith and unanimously carried, that the City Administrator be authorized to hire four additional laborers for street maintenance work. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that funds be transferred from unappropriated surplus to cover the wages of the new men. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None C~O0~CIL DIRECTIVE ON STREET DEPAR~T Co%u~cilman Rader stated it was his opinion the patch work on the streets was not being done properly and that each patch should be tacked. It was pointed out that certain street employees were not following orders and were doing the work as they pleased. It was moved by Councilman Rader, seconded by Councilman Smith, and carried, that a directive from the Council on duwn be issued to the effect that anv employee who willfull.v neglects to carry out orders as directed, is subject to ~mmediate suspension. Councilman Rader recommended that Mr. Lynn Love be appointed street foreman. It was pointed out by Mr. Johnson that such a move would have to go through Civil Service, with an examination being conducted. It was suggested the matter be tabled until it is seen what results are obtat-ed from the Council directive to the department. RESOLUTION No. 167~ - Providing for payment to Mayor Mansell of an allowance not to exceed $100.00 per month Offered by Councilman Smith, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Smith, DeWolfe Noes: None Absent: None Mayor Mansell declined to vote. ~--LETTERS OF APPRECIATION AUTHORIZED It was moved by Councilman DeGr~-~, seconded by CouncilmAn Smith, and carried, that the Clerk write letters of appreciation to those members of the various Commissions who have resigned. · PPOINTMENT OF ASSISTANT DIRECTOR OF CIVIL D~'ENSE Upon recommendation of Walter Davis, Chamber of Commerce, it was moved by Councilman Smith, seconded by Councilm~n DeWolfe, and carried, that Mr. Edgar B. Cu/nan be appointed Assistant Director of Civil Defense. ~SSION GRANTED MAYOR MANSELL TO LEAVE THE STATE It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that the Mayor be permitted to leave the State for a period of approximately one week commencing January 22, 1955. COrrESPONDENCE A letter was read from Mr. M. S. Hooper suggesting a loud speaker system be installed in the Council Chamber, and that the City purchase from the School District the F. Street Ball Park site. Councilman DeGraaf suggested the City might negotiate an exchange of some kind with the School District for property they wish to acquire in Vista Sq,,-re Housing. The letter was ordered filed. A letter was read from the San Diego County Fair Association inviting the City to enter an exhibit in the 1955 Fair. It was referred to the Chamber of Commerce. ~ING WITH RECREATION CO~ISSION SET It was suggested the Council meet with the Recreation Commission at their meeting to be held Thursday January 20th, to discuss the new Recreation Building now nearing completion. INVITATION_~ KIWANIS CLUB Council.mu DeGraaf extended an invitation to the Councilm~u, City Administrator, and City Attorney to attend their meeting T~esday, January 25th.
