NaY 24, 1955 The Council met in the Council Chambers at ~e City Hall on the above date at 7:00 P.M. with the following Counc~lm~n present: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Absent: - Nor~ A~eo present: City Administrator Wade, City Finance Officer, Grant, City Attorney M. Campbell, City Engineer Floyd Mayor ManSell led the salute to the Flag. ~0U~l~ CLUB HILLS No. 3 - Tentative map A letter was read f~om the Plann~ C~mission out~.tning their reasons for approving the tentative,map of CountrY Club Hills No. 3 RESOLUTION No. 1720 - Approval of tentative map of Country Club Hills No. 3 Offered by CounoAlm-n ~th, read in full, passed, adopted and approved by th~ following vote, to-wit: AYES: Councilmen Eader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None ~PPLICATION FOR BUSD~SS LICENSE A~D FENCE PERMIT APPROVEO Attorney Albert C. Boyer, representing Mr. H. C. Campbell, stated his client had filed an application with. the City for a Business license for an auto wrec~-g lot at F. Street am1 Bay Blv~-. in,order to expand his present business at E. Street and Bs~ Blvd. Mr. Campbell also filed a request for a permit to erect an eight foot aluminum corrigated fence to enclose the lot at F. ~. and Bay Blvd. Attgrney Boyer asked that the r~quests ~e granted, as in his opinion, his client,s use of the proper~y was in conformance ~ith all reqvir~m~nts of the present zoning Ordinance. It was ~oved by Councilman .~th, seconded by Councilman DeWolfe, and unl~imoue~V carried, that the requests of Mr. Campbell be granted, and that the City Finance Officer be directed to issu~ the business license, and the ~,~Mt~E Inspector be directed to issue a building permit for the fence. Counctlm~u Rader requested that the license ca~-~-~ a no burning clause, but it was pointed out that the City already had an ordinance controlling burning. ~PROvAL OF PO~T OFFICE PLANS After presentation and stud~ by the Council, it was moved by Councilman DeGraaf, seconded by Councilman Rader, and unanimously carried, that the plans for the new Post Office be approved and filed under document No. P-17. DOG FOUND AGE~WA$~T This agrsem~ut was tabled until adoption by the Council of the pay schedule the fiscal year 1955-56. RESOLUTION No. 1721 - Approving sewer repayment contract with Arlo Buford Offered by Counci~m~n DeGraaf, read in full, passed, adopted am1 approved by the following vote, to-wit: AY~S~ Councilman Rader, DeGr~e~ Mansell, Smith, DeWolfe Noes: None Absent: None ORDINANCE No. 519 j AmerCing Smbdivisi.n Ordinance No. 377 . (Pertaining to the po~ting of Bez~e) A letter was read from the Planning Commission recommending %he adoption of this Ordinance at this time, and t~eorporating it in a revised subdivision Ordinance at a later date. It was moved by Councilman DeWolfe, secoaded by Councilman Rader, and unanimously carried, that Ordinance No. 519 be p~ced on ~ts second reading; that the reading of the text be Waived, and the Ordinance ~op~ed. It was adopted ~ the following vote, to-wit: AYES: Councilmen Eerier, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent ~ None CHAN~E A letter was ~ad from the planning Commission recommending that the Council take necessary steps to have the name of National Avenue changed to "Broad~' Hr. J. C. Crain, of the National Avenue Busineasmens, Assn. said the change should be made before the new phone books cc~e out in January, if possible, - The matter was t~ over to the City Attorney to prepare the necessary Resolution to get the proceedings under way with a suggested tentative completion date of September let. ~ OF P. E. MA][ F~R PROPerTY USE INT~ATION A letter was read from the Planning Commission sterling they had denied the request of P. E. May for use of his property at National and F. Streets 'for the purpose ~f diesel tractor r~pai~ and sto~age in an M-1 zone. The Council, at a loss to know wh~ the matter was brought to them, was informed by the City P!annex~ that the Plam~Ang Commission wanted the Council to know the policy of ~hq Commission on such matters. The ~t~ Attorney advised that there was no action the Council co-1~ take unless Mr. May cares to appeal the decision of the Planning Cummission. ~EAL FROM ACTION OF PLANNING CO~frSSION IN DE~YING A ZONE VARIANCE TO C. A. LONG and Z. B. GRAY An appeal from action of the Planning Co~nission den~-g a zone variance to C. A. Long and Zella Gray having bean fi]ed with the City Clerk, Hr. Long and Hrs. Gray appeared and outlined their reasons for the appeal. The variance application called for a real estate office in an R-1 zone on the corner of Fourth Avenue and H. Street. The Council was of the opini°n that if the variance was granted it would open the way for business up and down H. Street. The Mayor,s cc~mtttee on rezoning had planned ~11 of H. Street for R-1 zone. Co,meilman DeWolfe thought to open a wedge for business in that area now, was a little premature. It was moved by Council~n DeGraaf, seconded by Councilman Rader, and unanimously carried, that the action of the Planning Commission in denying the zone variance be affirmed. Councilman DeWolfe declined to vote. ~UEST FOR USE OF EUCALYPTUS PARK FO~ FIESTA A letter was read from the Chula Vista Junior C~mber of Co-=~rce requesting all fees be waived for participants in the coming Fiesta, and that Eucalyptus Park be reserved for exclusive use of the Fiesta during the period of September 26th through October 3, 1955. No action taken. ~OHR~GLAIM FOR TAX REFUND Mr. S. W. Shepard, Secretary of Rohr Aircraft Corp. appeared to anewer an~ questions the Council might have pertaining to the Claim and Demand for refund of Taxa filed with the City Clerk. The City Attorney, having received no cop~ of the dm~d as promised by Rohr, stated the matter would 'have to be tabled until the June ~th meeting. ORDINANCE No. 520 - EstabLishing Truck Routes - First reading It was moved by Councilman Radar, seconded by Coumcilman DeWolfe, -~ unanimously carried, that Ordinance No. 520 be introduced. It was thereupon read in full. ORDINANCE No.. 521 - Regulating c~struct~on of masonry garden walls - First reading It was moved by Councilman Rader, seconded by Counci]~ ~mith, and unanimously .ca~r~ed, that Ordinance No. 521 be introduced. It was thereupon read in ~,11, ~MBURSEMENT TO COUNCILMAN DEGRAAF -~ NALTER DAVIS APPROVED It was moved by Councilw~ .~.ith, seconded by Counctlw~u DeWolfe, and carried, that Councilman DeGr~a~ and Walter Davis Secretary of the ~-~.~er of Commerce be reim~mrsed from the Harbor Fu~d in an ~nount not to exceed $180.00 for Sacramento tripe Tho motion carried by.the following vote, to-wit~ Al'ESi Councilmen Rader, DeGr~, Mansell, Smith, DeWolfe Noes: None Absent: None The ~acrIaento trip was in conJu~cti~ with a bill before the A~bly nn underwater annexations. ~APPROPRIATIoN APPRO¥.:,, for moving Library to new quarters. It was m~ved by Councilman Rader, seconded by Co~cilman DeWolfe, a~d carried, that $500 be learned fr~a the General FU~d to the Library Fu~d, a~d the expenditure to that amount be authorized for moving the Library into its new q~rs. Tae motion carried by the following vote, to-wit: AYES: Co~mcilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None ~AYMENT AUTHORIZED for Special Counsel on Library Investigation It was moved by Councilman DaGraaf, seconded by Councilman Rader, and carried, that $500. be appropriated from unappropriated surp~ for pa~ment to Attorney James Abbey for services r~dered in the Special Library investigation as ~rdered by the Co~mcile The motion carried by .the foll~g vote, to-witI AYES~ CoUnc~lw~n Rader, DeGraaf, Mansell, ~mith, DeWolfe Noes: None Absent I None For ~o~cl~ ~n New L~brary B~ld~ A letter was read from the Chula Vist~ Art Guild suggesting that picture mo,,]~t~g be pla~ on the wa//s of the new Library Building, in order that they might hang their pictures. It was moved by Counct ]~n B~ith, seconded~ by Ceunci~nan DeGra~f, and carried, that the letter be submitted to the Library B6ard for consideration. GIVEN NATIOKAL CITY on Extension of Highway A letter was read from the City planner of National City, together with a Resolution from the National City Planning Co-mission urging suFport in their attempt to get South 43rd Street north of Logan Avenue extended through Greenwoo~ Memcr~*l park properties. It was moved by Councilman ~nith, seconded by Counci~m~n DeGraaf, ~_~ carried, that City Administrator Wade write a letter.supporting the City of National City. //~ ON CUT THROU~ STRAND City Attorney Campbell stated he had received a report frc~ the Arm~ Engineers on a study being made to cut a channel across the south end of the Strand for a new entrance into the Bay. The project was considered not feasible by the Engineers, with the cost es+.tmated at one hundred million do~s, several mi]ItOh of which would have to be berne by the City of C~ula Vista. ~CusSION ON PRIV~S~/T INSTALLATION The City Engineer stated he has constant complaints coming in because people wou/d net put in their sidewalks, curbs and gutters, and asked the Cooncil what policy they wished to follow in demanding that this be done. The City Attorne~ said if fifty percent of the property in a block has been improved, the others can be compelled to improve theirs, or the City may do it and place a lien om the properS. The Council felt people should he encouraged to at least get +_.b~ir curbs and gutters installed mo the City could bui2~ the streets up to the~. Mayor Mansell suggested the City Attorney look up the State law and outline for the Council Just what procedure they can best follow regarding the installation of side#alke, curbs and gutters within the city. ~TE SET FOR PUBLIC HEARING ON BUDGET City Administrator Wadi stated he had formally submitted his proposed budget to the Council for the fiscal year 1955-56, and the date being set for the Public Hearing on the Budget as June 14, 1955. Mayor Mansell stated the Council had worked hard to keep She City tax rate down, and suggested citizens attend the Board of Supervisors Budget meeting to proposed County tax increase. STREET WIDENING PROJECT DISCUSSED Counc~]w~ Rader asked the City Engineer the present status of the E. Street widening project, and why the project has been so delayed. City Engineer Floyd said it is now in the hands of the State Highwa~ Depa~.~ent, and that there was noShing one con]a do to expedite the matter through the State, as .it was Just one of the many projects as far as they were concerned. Counci]w~n Rader asked that ~]] time possible be devoted to the E. Street project in artier to get it Under way before the winter rains start. City Engineer Floyd stated the City could continue with the project Just as soon as the rscom~endations come back from the State. ~.~E~T THAT BAY FRONT BE CLEANED Rt. Ed. Cn~- in ~he audience, asked what stepe had been taken to clean up the water front where salvage operaters have cluttered the area at the foot of F. Street. May~r Mansell stated he would have City Administrator Wade take the matter up with the Chief of PoLice.
