HomeMy WebLinkAboutReso 2022-132 DocuSign Envelope ID:41A356E4-0834-4CC7-88BB-6551F08138CF3 RESOLUTION NO. 2022-132 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING BIDS; AWARDING A CONTRACT FOR THE "CVEATC BRIDGE REPAIR (GGV0241)" PROJECT TO BLUE PACIFIC ENGINEERING & CONSTRUCTION IN THE AMOUNT OF $1,713,727.00; AND APPROPRIATING $2,484,000 FROM UNANTICIPATED REVENUES AND THE GENERAL FUND TO THE CVEATC BRIDGE REPAIR PROJECT (GGV0241) WHEREAS, the pedestrian bridge and guard house at the Chula Vista Elite Athlete Training Center (CVEATC) sustained significant damage after being struck on two occasions by third-party vehicles; and WHEREAS,the City of Chula Vista(City)filed a property insurance claim with its insurer, Lexington Insurance Company(Lexington),for the damage caused to CVEATC pedestrian bridge; and WHEREAS,the City has received partial payments pursuant to its property insurance claim with Lexington; and WHEREAS, after receipt of the initial partial payment, City staff created the CVEATC Pedestrian Bridge Repair Project(CIP GGV0241)for the design and repair of the CVEATC bridge and guard house; and WHEREAS, City has appropriated the initial and subsequent partial payments from Lexington to CIP GGV0241, which has a current available balance of $212,957.28 after completion of the design; and WHEREAS, on May 3, 2022, the City received an additional partial payment from Lexington in the amount of$1,015,924.40 as partial payment for the construction phase of the pro]ect; and WHEREAS, City staff anticipates that additional funds will be received from Lexington in an approximate amount of$1,468,075.60 during the construction phase of the project; and WHEREAS, City staff intends to utilize such additional funds received from Lexington to offset any potential impacts to the General Fund to complete the project; and WHEREAS, City staff anticipates that after receipt of all anticipated additional funds from Lexington, there will be no impacts to the General Fund to complete the project; and WHEREAS, if the anticipated additional funds from Lexington are not received, or not timely received, staff intends to return to the City Council for further consideration of funding for the project to avoid impacts to the General Fund; and DocuSign Envelope ID:41A356E4-0834-4CC7-88BB-6551F08138CF3 Resolution No. 2022-132 Page No. 2 WHEREAS, in order to proceed with the construction phase of the project, staff recommends appropriating the additional partial payment of $1,015,924.40, in addition to $1,468,075.60 from the General Fund, for a total of$2,484,000.00, to CIP GGV0241 to cover the anticipated costs of the construction phase of the project; and WHEREAS, Chapter 2.56 of the Chula Vista Municipal Code authorizes the City to contract for public works; and WHEREAS, on December 17, 2021, the Department of Engineering and Capital Projects solicited bids for the "CVEATC Bridge Repair (GGV0241)" project in accordance with Chula Vista Municipal Code section 2.56.160.A; and WHEREAS, on February 9, 2022, the Director of Engineering and Capital Projects received six (6) sealed bids for the "CVEATC Bridge Repair (GGV0241)"project; and WHEREAS, the apparent low bid for the project was submitted by Blue Pacific Engineering & Construction in the amount of$1,713,727.00; and WHEREAS, staff has determined that the bid submitted by Blue Pacific Engineering & Construction is responsive in all material respects to the bid specifications/requirements and that Blue Pacific Engineering & Construction is the lowest responsive and responsible bidder; and WHEREAS, staff recommends awarding the contract to Blue Pacific Engineering Construction in the amount of$1,713,727.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it: 1. Accepts bids for the "CVEATC Bridge Repair(GGV0241)" project. 2. Awards the public works contract for the "CVEATC Bridge Repair (GGV0241)" project to Blue Pacific Engineering & Construction in the amount of$1,713,727.00. 3. Appropriates $1,015,924.40 in unanticipated funds from Lexington Insurance Company and $1,468,075.60 from the General Fund, for a total of$2,484,000.00, to CIP GGV0241 for the construction phase of the project.
