CALL TO ORDER A regular meeting of the Sustainability Commission of the City of Chula Vista was called to order at 5:57 p.m. in Conference Room B-111 located in Building C, City Hall, 276 Fourth Avenue, Chula Vista California. 2. ROLL CALL Secretary Rodriguez called the roll. 3. CONSENT CALENDAR (Items 3.1-3.2) 3.1 APPROVAL OF REGULAR MEETING MINUTES OF MARCH 14, 2022 Moved by Vice Chair Korgan Seconded by Chair Matthias Commission approved minutes pending wording be changed under item 6.1 to reflect that city staff requested the public comments received. Yes (4): Commissioner Guevara-Gluyas, Vice Chair Korgan, Chair Matthias, and Commissioner Richeson Result:Carried (4 to 0) 3.2 WRITTEN COMMUNICATIONS Moved by Commissioner Richeson Seconded by Commissioner Guevara-Gluyas Commission approved absences Yes (4): Commissioner Guevara-Gluyas, Vice Chair Korgan, Chair Matthias, and Commissioner Richeson Result:Carried (4 to 0) 4. PUBLIC COMMENTS One public comment received by Carolyn Scofield 5. ACTION ITEMS 5.1 REVIEW AND APPROVE THE CITY OF CHULA VISTA'S PROPOSED SINGLE -USE PLASTICS BAN PER ACTION 1.12 AND 1.13 OF THE RECENTLY APPROVED WASTE REDUCTION STRATEGIC PLAN (CHULA VISTA'S ROAD PLAN TO ZERO WASTE) Environmental Services Manager Medrano went over the draft ordinance for the Single -Use Plastics Ban and what is being proposed. Some of the proposed language is to limit the distribution of disposable foodware which includes straws and utensils and to ban the distribution of single use carry out plastic bags. The ordinance would allow for waivers under special circumstances that may be requested by the providers with undue hardships. Medrano continued by sharing the background of how the ordinance was created. The Sustainability Commission formed a committee to look at the language in anticipation of the ordinance and the language that was developed with assistance of the Surfrider Foundation. His presentation was followed by question from commissioners which included questions about an education campaign for businesses and what is the timeline for the ordinance to be enforced. It was requested that 2 language be added for food that is delivered through a delivery service provider such as UberEats or DoorDash, and Medrano explained that state law already exists that cover this. There was also a question regarding the waiver and what will be requested form a business requesting one. Finally, it was requested that the language of single -use water bottle be updated to include all type of single- use bottled drinks. Moved by Commissioner Richeson Seconded by Commissioner Guevara-Gluyas Motion to recommend council approve the Single -Use Plastic Ban ordinance and recommend council to include education, outreach, and community engagement regarding the ordinance. Yes (4): Commissioner Guevara-Gluyas, Vice Chair Korgan, Chair Matthias, and Commissioner Richeson Result:Carried (4 to 0) 5.2 REVIEW AND APPROVE CHANGES TO CHULA VISTA MUNICIPAL CODE CHAPTER 8.25 ADDING DEFINITIONS AND REQUIREMENTS RELATED TO EDIBLE FOOD GENERATORS, EDIBLE FOOD RESCUE ORGANIZATIONS AND SELF -HAULERS TO FURTHER ASSIST COMPLIANCE WITH SB1383 REGULATIONS Environmental Services Manager Medrano went over the changes to the municipal code chapter 8.25 and the definitions that were added in order to be in compliance of the law. Food rescue and reporting requirements for both generators and food rescue organizations and the term self -hauler have been added and included in the regulation. Commissioners raised concerns over how this will be enforced and who will do the data collecting and reporting. Moved by Commissioner Richeson Seconded by Chair Matthias Motion to approve the amendments and further recommends that one, the data collection efforts are critical to the process and two, data collection efforts be specific and provides sufficient required information to make the program effective and comply with state law. Yes (4): Commissioner Guevara-Gluyas, Vice Chair Korgan, Chair Matthias, and Commissioner Richeson 3 Result:Carried (4 to 0) 5.3 APPROVE ONLINE VOTE TALLY FOR ANNUAL SUSTAINABILITY CHAMPION AWARDS There was no presentation for this item, only the voting results were presented to the commission. STAFF COMMENTS Environmental Services Manager Medrano provided an update on the organic waste collection program and requested that an email previously sent to the chair addressing the recyclables be shared with the commission. Chief Sustainability Officer Gakunga shared that the first van for the community shuttle program was delivered and that an anticipated launch date sometime in May. Deputy City Attorney Silva briefly went over the memorandum he prepared for the commission regarding commission communications and identified some limitations, the biggest being the Brown Act. 11 7. CHAIR'S COMMENTS Chair Mathias thanked city staff, vendors and volunteers who participated in South Bay Earth Day. Next the chair had a question regarding live video streaming of commission meetings for residents that would like to participate during the meetings but are not able to physically attend. She concluded by inviting everyone to volunteer at the next Creek to Bay event which is scheduled for the 23rd of April. 8. COMMISSIONERS' COMMENTS None 9.
