RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A SECOND AMENDMENT TO A
LICENSE AGREEMENT WITH BLINK NETWORK, LLC TO
IMPLEMENT UPGRADES OF EXISTING ELECTRIC VEHICLE
INFRASTRUCTURE AT FIVE CITY PARKING LOTS
WHEREAS, in 2012, the City of Chula Vista (City) and EcoTality (later Blink Network,
LLC) entered into a license agreement (“License Agreement”) to install 33 electric vehicle (EV)
chargers at five locations within the City; and
WHEREAS, these first-generation EV chargers operate at 2G service and cellular carriers
have begun discontinuing 2G service; and
WHEREAS, under the proposed second amendment to the License Agreement, Blink
Network, LLC (Blink) would upgrade these EV chargers to second-generation models at no cost
to the City; and
WHEREAS, the proposed second amendment to the License Agreement would increase
revenues due to the City for the operation of the EV chargers; and
WHEREAS, the proposed second amendment to the License Agreement would have an
initial term of five (5) years, and could be renewed for up to five (5) additional one-year periods;
and
WHEREAS, staff recommends that the City Council adopt a resolution approving the
Second Amendment to the License Agreement between the City and Blink.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
that it approves the Second Amendment to the License Agreement between the City of Chula Vista
and Blink Network, LLC, in the form presented, with such minor modifications as may be required
or approved by the City Attorney, a copy of which shall be kept on file in the Office of the City
Clerk, and authorizes and directs the City Manager or designee to execute same.
