Campbell, purchaser-Ana~t Ross, City planner Scherer Mayor Mansell led the salute to the Flag ORDINANCE No. 532 - Amending ordinance No. 427 -(Truck Routes)- Second reading It was moved by Councilman Rader, seconded by Councilman Smith, and carried, that Ordinance No. 532 be placed on its second reading and that the reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilm-u Rader, DeGraaf, Mansell, Smith Noes: None Absent: Councilman DeWo~fe ~fter reading of the title, it was moved by counci!m~n DeGraaf, seconded by Councilman Smith, and carried, that the Ordir~nce be adopted. The motion carried by the follow- ing vote to-wit: AYES: Councilm-u Rader, DeGraaf, Nansell, Smith Noes: None Absent .- Councilm~ DeWolfe ORDINANCE No. 533 - Amending Nos 158 and 377 (Locati~ sewer mains in streets) Second reading It was moved by Council.man DeGr~a*, seconded by Councilm~n Rader, and carried that Ordinance No. 533 be placed on its second reading, and that the reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith Noes: None Absent: Counc~ lm~n DeWolfe After reading of the title, it was moved by Councilman Rader, seconded by Councilman DeGraaf, and carried, that the Ordinance be adopted. It was moved by Councilman Smith, seconded by Counc~lm~n Rader, and carried, that Ordinance No. 534 be placed on its second reading, and that the reading of the text be waived. The motion carried by the following vote to-wit: AYES: Council,-n Rader, DeGraaf, Nansell, Smith Noes: None Absent: Councilman DeWolfe After reading of the title, it was moved by Councilm~n Rader, seconded by Council,~n DeGree*, and carried, that the Ordinance be adopted. The motion carried by the follow- ing vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith Noes: None obSent: CouncilT_ DeWolfe RDINANCE No. 528 Amending ordinance No. 398 (Definitions) It was moved by Counc~lm~ DeGraaf, seconded by Councilman Smith, and carried that Ordinance No. 528 be held over until the next meeting for further study. Counci/man DeWolfe arrived at this time - 7:10 P.M. ORDINANCE No. 53~ - Establishing position of Street Superintendent for 1911 Act purposes - First reading It was moved by Counc~l,~u Smith, seconded by Counc~l~u Rader, and carried, that Ordinance No. 535 be introduced. The motion carried by the following vote, to-wit: AYES~ Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Ordinance was thereupon read in full. ~//REQUEST FOR TRASH CONTAINERS A letter was read from The Broadway Association of chula Vista requesti~ that ~rash containers be placed on Broadway. It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the letter be referred to the Park & Recreation Co~mission for recommendations. ~/REQUEST FOR "MEMORIAL SQUARE" ON CIVIC CENTER SITE A letter was read from the Chula Vista Junior ~Vomans, Club requesting that the Memorial palm trees be planted around the square bounded by Fourth Avenue, Davidson Street, Guava Avenue, and "The Mall". It was further recommended that the "The Mall" be changed, and the whole area referred to as "Memorial Square". It was moved by ~ouncilman Smith, seconded by Councilman DeGree*, and carried, that approval be granted for planting the palms, and dedicating the area as requested, and that the Park Department be directed to work with the Club Committee for location and /~ting of the trees. REQUEST FOR LEASE ON PARKING LOT BUILDING A letter was read from ~r. M. L. Day requesting a lease of five or more years on the office he occupies on City property at Davidson and church Avenue. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that no decision be made until it has been decided what disposition is to be made of the old Library site on F. Street. ~OUR~Y PARKING TICKET PROGRAM A letter was read from the Chula Vista Downtown Association recomaending that the Council approve the extension of the courtesy parking ticket program as it now stands. It was moved by Councilm~.~ Smith, seconded by Councilm~u DeGraaf, and carried, that the City continue the courtesy parking ticket program in the manner that it is now being handled. ~'"00M~ITTEE TO STUDY CONV~ION OF F. STP~ LIBRARY SITE A letter was read from the Chula Vista Downtown Association stating a six man Committee had been formed to study the possibilities of converting the old Library site into a  mbination park and parking lot. AUDITORS SUBMIT PROPOSAL FOR 1955-1956 Audit A proposal was submitted from Eager & Carroll, Auditors, for auditing the City records for fiscal year 1955-1956. It was suggested the letter be held over until the return LET City Finance Officer Grant from his vacation. T~ OF PROTEST ON BUS SERVICE A letter was read from A. A. '~inthrop, 248 G. Street protesting the poor bus service in chula Vista. It was suggested the matter be turned over to the City Attorney for interpretation of franchise requirements, and that City Administrator %¥ade have a copy of the Winthrop letter sent to the Public Utilities Commission and the San Diego Transit System, together with one of his own, asking for an answer to the comDlaint. Also that Mr. Winthrop be sent a copy of the City Aamlnistrator,s letter. MB~ OF CO.~RCE Presents plan for Conversion of F. Street Library site. Walter P. Davis, Secretary of the Chamber of CoW, merce, presented a sketch for Council consideration, showing a proposed layout for a combination parking lot and park at the F. Street Library site. No action taken. ~ Act Discussion City Attorney M. Campbell advised against small 1911 Act proceedings, as the extra charges would amount to 25 to 40 percent of the cost. The City Attorney was directed to have a decision, at the next meeting, as to whether two small districts have to be contiguous in order to be run as one district. Councilm~u Rader suggested another public hearing be held on the 1911 Act with the Clerk sending notices to all property owners on Broadway, and a notice in the paper inviting anyone interested to come. Date of the hearing was held up pending additional information from the City Attorney. RESOLUTION No. 1761 - Accepting Lots A & B, Country Club Hil~s No. 2 offered by Couno~lwm~ Smith, read in full, passed, adopted and approved by the following vote, to-wit: A~ES: Councilmen Rader, DeOraaf, Mansell, Smith, Dewolfe Noes: None Absent: None RESOLUTION No. 1762 - Authorizing Grant Deed to County of San Diego for additional land. Offered b~ Councilman Smith, read in full, passed, adopted and approved by the following vote~ to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Deed is to read the same as the original grant to the Country for the Court site, with the addition that the exterior design will be accept- able to the City Council. RESOLUTION No. 1763 - Regarding relocation of Federal Housing dwellings within the City of Chula Vista Offered by Counc~lm~ Smith, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None · Ab~sent: None ~UEST FOR TRAVEL E~PENSE Mayor Mansell read a request from Walter P. Davis, civil Defense Director, for a $50. expense allowance to cover a civil Defense meeting in Sacramento. It was moved by Councilman Smith, seconded by Councilm~n Rader, and carried, that ~r. Davis be' authorized to spend $50. of the budgeted Civil Defense travel expense account in order to attend the meeting. The motion carried by the following vote, to-wit: AYES~ Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None ~OlJIq'2'~/' H~I.?H ORDINANCE City Administrator Wade presented a proposed County Health Ordinance providing for a ten percent penalty on those delinquent in obtaining their health permits. The County was desirous of knowing if the City would compl~nt the County Ordinance, should it be adopted. It was moved by Council,~ Smith, seconded by Councilm~ DeWolfe, and carried, that the City Administrator notify the county that the City would be w~l~ng to ~m~nd their Ordinance to comply with that of the County. RESOLUTION No. 1764 - Approvi~ lease between the City and Boys, Club of Ch~,l~ Vista Offered by Councilman Smith, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None The Resolution was approved with the proViso that the tenants be given at least six months to vacate. SHOULDER POLIC~ Discussion centered on the establishment of a policy as to what extent the City should go, at this time, to pave street shoulders. It was moved by Councilman Rader, seconded by Councilman DeGraaf, and carried, that the Council establish a City policy that, proViding curbs and gutters are in, other than new subdivisions, the City will install the shoulders, providing property owners pay for all the materials. Councilman smith voted no, stating the City definitely had a problem, but in his opinion this was not the way to cope with it. RESOLUTION No. 1765 - Transferring Gas Tax funds for E. Street widening project Offered by Counc~lm, n Smith, read in full, passed, adopted and approved by the follow- lng vote to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None RESOLUTION No. 1766 - ApproVing lease agreement with Sweetwater Union High School District for Vista Square B~,tl~tngs Offered by Councilm~n Smith, read in full, passed, adopted and approved by the follow- ing vote, to-wit: AYES: Councilmen Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: Nome This Resolution was passed with the stipulation that all alterations to the buildings be made subject to the approval of the Housing Manager. ID OPENING DISCUSSION Councilman Smith suggested that the policy of opening bids before the Council be changed so that only those bids come before the Council that are so specifically requested. The matter was put over until the next meeting for clarification by the gity Attorney. ~BID A'~AKDED ON TRAFFIC LIGHTS for Broadway and I. Streets City Engineer Floyd presented the following bids for installation of traffic lights at Broadway and I. Streets: Ets-Hokin-Galvan $3211.00 Chula Vista Electric 3980.00 California Electric 3490.00 It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the low bid of Ets-Hokin-Galvan be accepted. CITY ATTORNEY E~CUSED from planning Meeting At the City Attorney's request the Council excused btm from attendance at the meeting of the Planning Commission for October 3, 1955. ROPRIATION FOR E. STREET WIDENING PROJECT City Engineer Floyd stated an appropriation of approximately $7000. would~ be needed for sidewalk and driveway work, testing fees, an additional inspector for four months, and to adjust water and fire hydrants in connection with the E. Street widening project, all of which are not eligible for gas tax monies. It was moved by Councilman Rader, seconded by Councilman Smith, and ca~-~ied, that $7000. be appropriated from unappropriated surplus to cover extra expensea on the E. Street widening project as requested. The motion carried by the following vote to-wit: AYES: Counc~lm~n Rader, DeGraaf, Mansell, Smith, DeWolfe Noes: None Absent: None ~IL FIFTH AVENUE AUTHORIZED ON Councilman Rader recom~.nded oiling portions of Fifth Avenue in the vicinity of the Junior High School in order to give school children a place to walk out of the mud and off the street. Approximate cost would he $150. It was moved by Councilman Rader, seconded by Councilman Smith, and carried, that the street department be directed to oil the East side of Fifth Avenue from F. Street to G. Street, and from the South side of the Junior High School to H. Street. ~VOTE OF THANKS to Police Chief Roberts At the suggestion of Council,m~ Smith a vote of thanks was extended to Police chief Roberts for the school crossing safety program.
