HomeMy WebLinkAboutcc min 1964/11/10 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday November 10, 1964 A regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Director of Planning Warren~ Assistant Administra- tive Officer Stenberg Mayor Sparling led the pledge of allegiance to the Flag and asked for a moment of silent prayer. Statement: The City Clerk hereby states that he did post within twenty-four hours of adjournment, as provided by law, the order of adjournment of the regular meeting of November 10, 1964. ~/~SENTATION OF SERVICE AWARD Mayor Sparling presented to Captain M. S. Taylor the City's thirty-five- year service award pin and certificate of commendation for faithful service as a member of the Chula Vista Police Department. HESO~UTION NO. 3547 - Proclaiming Farm-City Week Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McMains, McAllister, Sparling, McCorquodale Noes: None Absent: None APPROVAL OF COUNCIL MINUTES It was moved by Councilman McAllister, seconded by Councilman Anderson, and carried that the Council minutes for the meetings of October 20 and 27, 1964, be approved, copies having been sent to each Councilman. ~PJABLIC HEARING - Setbacks for south side of Naples Street between Monserate and Osage Avenues This being the time and place, as advertised, for a public hearing on the proposed e~tablishment of a fifty-foot setback for property on the south side of Naples Street between Monserate and Osage Avenues, Mayor Sparling declared the hearing open. No one wishing to be heard either for or against the proposed set- back and the Clerk having received no written protests, the Mayor declared the hearing closed. ORDINANCE NO. 906 - Approving fifty-foot setback on south side of Naples Street between Monserate and Osage Avenues - First reading It was moved by Councilman McMains, seconded by Councilman Anderson, and carried that Ordinance No. 906 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None ~/PUBLIC HEARING (cor~inued) - Intention close of East Street to portion Naples This being the time and place, as designated, for the continuation of the public hearing on the proposed closing of a portion of East Naples Street in Seaview Estates No. 1 Subdivision, Mayor Sparling declared the hearing reopened. No one wishing to be heard either for or against the proposed closing and the Clerk having received no written protests, the Mayor declared the hearing closed. RESOLUTION NO, 3548 - Ordering portion of East Naples Street vacated Offered by Councilman McAllister, passed and adopted by the following vote, to-wit: AYES: Councilmen McAllister, Sparling, McCorquodale, Anderson, McMains Noes: None Absent: None ,BLIC HEARING - Rezon±ng south side of "H" Street between Madison Avenue and San Diego & Arizona Eastern Railroad This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-i~ R-2 and R-3 to C-2 of property on the south side of "H" Street between Madison Avenue and the San Diego & Arizona Eastern Railroad, Mayor Sparling declared the hearing open. A letter was read from Mrs. Lillian M. Stone requesting that her property at 516 and 518 ~effarson Avenue be rezoned at this time from R-2 to R-3. Plan- ning Director Warren was directed to notify Mrs. Stone that she must make appli- cation to the Planning Commission in order to rezone her property. No one wish- ing to be heard either for or against the rezoning~ and the Clerk having received no other written communications on the matter, the Mayor declared the hearing closed. After discussion, it was moved by Councilman McCorquodale, seconded by Councilman McMains~ and carried that the portion of the south side of "H" Street between Woodlawn and the railroad track be excluded from the rezoning. ORDINANCE NO~ 907 - Approving the rezoning of the south side of "H" Street between Oaklawn and Y~xtiSom~ Avenues - First reading It was moved by Councilman McCorquodale, seconded by Councilman McMains~ and carried that Ordinance No. 907 be placed on its first reading and that read- ing of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McCorquodale, Anderson, McMains, McAllister, Sparling Noes: None Absent: None ORDINANCE NO~ 905 - Amending Article 1V of the City Code - combining duties of Personnel Clerk with those of Personnel Officer - Second reading It was moved by Councilman McMains, seconded by Councilman McCorquodale, and carried that Ordinance No. 905 be placed on its second reading, that reading of the text be waived~ and the ordinance adopted° The motion carried by the fol- lowing vote, to-wit: AYES: Councilmen McMains~ McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None ~/~ECEMBER 1 SET AS TIME FOR HEARING ON AI~ENDFiENT TO ZONING ORDINANCE - Day Nurseries A letter was submitted from the Planning Commission recommending that day nurseries be permitted in R-3 and C-1 zones. It was moved by Councilman McAllister, seconded by Councilman McMains, and carried that December 1 at 7:00 P.M. be Set as the time for a public hearing on the matter. ECEMBER 1 SET AS TIME FOR HEARING ON REZONING PORTION OF "F" STREET A letter was submitted from the Planning Commission recommending that the south side of "F" Street from a point 310 feet west of Fourth Avenue extending to Garrett Avenue and the area bounded by Fourth Avenue, Third Avenue, Center Street and Madrona Street be rezoned from M-1 and C-2 to C-1 and R-3 and that certain setbacks be established. A letter was read from the San Diego Gas & Electric Company requesting that a ten-foot setback be maintained on Fourth Avenue for a distance of 100 feet south of "F" Street. No action taken. It was moved by Councilman McMains, seconded by Councilman McAllister, and carried that December 1 at 7:00 P.M. be set as the time for a public hearing on the matter. -2- RESOLUTION NO, 3549 - Approving conditional use permit for Hogan & McCray - 648 Third Avenue Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO. 3550 - Appropriating funds and authorizing contract between City and State - 701 Program - Planning Consultants Offered by Councilman McMain$, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO, 3551 - Amending agreement with Chula Vista Sanitary Service Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, Sparling, McCorquodale Noes: Councilmen McMains, McAllister Absent: None RESOLUTION NOv 3552 - Prohibiting parking and standing on a portion of West Bay Boulevard Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO. 3553 - Authorizing an agreement with Gordon Pettit and appropriating funds to participate in cost of Bonita Village sewer instal- lation Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO. 3554 - Approving encroachment permit - Sosna Investment Company Offered by Councilman McAllister, passed and adopted by the following vote~ to-wit: AYES: Councilmen McAllister, Sparling, McCorquodale, Anderson, McMains Noes: None Absent: None RESOLUTION NO. 3555 - Giving notice of intention to vacate portion of Toyon Lane - hearing date set for December 8 Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson~ McMains~ McAllister~ Sparling, McCorquodale Noes: None Absent: None RESOLUTION NO. 3556 - Regulating parking on "F" Street Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None -3- RESOLUTION NO. 3557 - Amending agreement with Downtown Association for payment of electrical hook-ups and appropriating funds - Christmas decorations Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McMains, McAllister, Sparling, McCorquodale Noes: None Absent: None RESOLUTION NO, 3558 - Approving agreement with auditors for 1964-1965 Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McMains~ McAllister, Sparling, McCorquodale Noes: None Absent: None ~,,~7~DLUTION - Designating the geranium as the official City Flower Offered by Councilman McCorquodale, this resolution failed to carry by the following vote, to-wit: AYES: Councilmen McCorquodale, Anderson Noes: Councilmen McMains, McAllister, Sparling Absent: None Mrs. Dee Pauline, Carl Truby and Norma Schubert all spoke in favor of the rose being designated the City Flower. Mr. A. S. Moore suggested that the Bird of Paradise be selected as the City Flower. Speaking for the geranium were Mrs. Betty Bozic and Mrs. Bertha Ellis. Councilman Anderson read a letter from a La Mesa resident endorsing the geranium. Mr. Bob Yokes, Florist, answered questions from the Councilmen pertaining to the selection of a City Flower. The Administrative Officer was directed to report back at a later date as to the exact purpose of a City Flower in order that the Council can better deter- min~ the best selection. ~S OF PERSONS TO BE APPOINTED TO STUDY COMMITTEE TO BE SUBMITTED AT NEXT MEETING Mayor Sparling asked~that Councilmen submit names at the next meeting of persons they would like to serve on the Citizens Committee for study of the Sani- tary Service. ~i~qUEST FOR TRAFFIC LIGHT A letter was read from Rick Correa requesting the installation of a traffic signal at Fourth Avenue and "D" Street. The letter was accompanied by a petition containing seventy-two signatures. It was moved by Councilman McMains, seconded by Councilman Anderson, and carried that the petition be referred to the Safety Council. ~/~ETITION FOR ALLEY RESURFACING A petition was submitted from property owners in the 500 block on Roosevelt and Vance Streets requesting that the alley between Broadway and Smith Street and Roosevelt and Vance Streets be resurfaced at no cost to the property owners. Re- ferred to City Engineer Cole. ~//STREET IMPROVEMENTS IN PRINCESS HILLTOP A letter was read from D. K. Speer, County Surveyor, recommending that the Council order that the streets in the Princess Hilltop Subdivision be made a part of the maintained street system of the City of Chula Vista. City Engineer Cole stated that no action was necessary because this is done automatically when the Subdivision map is filed. ~z~[DOPTION OF ALTERNATE "E" FOR FREEWAY ROUTE RECOMMENDED A letter was read from J. Dekema, District Engineer, State Division of Highways, recommending that the Council indicate by resolution the endorsement of Route "E" as the location of a portion of freeway between 2.5 miles north of Otay Mesa Road and Route 54. Administrative Officer Ross was directed to have the necessary resolution ready for the next meeting. VITATION TO BEACH EROSION CONTROL CONFERENCE An invitation was read from William E. Warne, Director of Water Resources, inviting Councilmen to a Beach Erosion Control Conference to be held December 2 at Miramar Hotel, Santa Monica. ~qUEST TO LEASE CITY LAND Councilman McMains stated he has had a request from a Joe Lawrence to lease the five acres the City purchased for Loma Verde Park for agricultural ~urposes. Referred to Administrative Officer Ross for negotiation of a lease agreement. (~z~STUDY REQUESTED ON PROVIDING COUNCIL AGENDA TO PUBLIC ON SUBSCRIPTION BASIS It was moved by Councilman McCorquodale, seconded by Councilman Anderson, and carried that the Administrative Officer and City Attorney be directed to study the means by which the Council may offer to the public the Council agenda on a subscription basis. ~/~RASH COLLECTION ORDINANCES COMPARED Councilman McCorquodale stated that he has compared the San Diego City and Chula Vista trash collection ordinances and has not been able to see a great difference in the two ordinances. Administrative Officer Ross stated that ordinances from other cities are also being assembled for a study and report which will be made available to the Council and the Citizens Cor~nittee appointed to study the Sanitary Service in Chula Vista. ADJOUiLNMENT Mayor Sparling adjourned the meeting at 8:50 P.M. until November 17 at 7 P.M. City Clerk
