REGULAR MEETING OF THE CITY COUNCIL OF THE CITY
of Chula Vista, California
Held Tuesday September 25, 1956
The Council met in the Council Chambers at the City Hall on
the above date at 7:00 PoMo with the following Councilmen present:
Councilmen Rader, S~ith, DeGraaf, Dillon, DeWolfe
Absent: None

Mayor DeGraaf led the salute to the Flag
~UBLIC HEARING - Zoning of Hazel Goes Cook School site, Country Club
Manor~ Mar~il Heights, Bella Vista Heights, Country
Club Hills 2, 3, Casey Annexation, Judson Tract, Sun
Valley, Country Club Park S, 4~ 5~ 6~ Gibson-Dudley
Annexation, Hobart Properties, Hilltop Housing
Annexation.
This being the time and place for a public hearing on the above
mentioned zoning, Mayor DeGraaf declared the public hearing open. There
being no red, arks or objections, either oral or written, Mayor DeGraaf
declared the hearing closed.
Ordinance No. 556 - Amending zoning Ordinance No° 398-First reading
It was moved by Councilman Smith, seconded by Councilman ~ader,
and carriedt that Ordinance No, 398 be placed on its first reading.
The motion carried by the following vote, to-wit:

The Ordinance was thereupon read in full,
J~-ELECTRICALOUTLETS FOR CHRISTMAS DECORATIONS
Elmer Sorensen, Secretary of the Chamber of Conerce, reported
the merchants have agreed to be assessed sixty cents a front foot of
their property to cover cost of Christmas decorations this year. He
requested that the Council l authorize the installation of electrical
outlets along the Avenue using funds budgeted for Christmas decorations.
It was moved by Councilman DeWolfe, seconded by Councilman Smith, and
carried, that Purchaser-Analyst Ross be authorized to determine the cost
of permanent installation of the requested outlets~ and report back at
the next meeting.
~Lilian Jo Rice School Sewer Connection
Through a misunderstanding at a previous meeting, the Council
waived sewer connection charges payable to the City under Ordinance
No. 405, as requested by the City School District for connection of
the Lilian J. Rice School to the City Sewer. City Attorney Mo Campbell
stated the Council could not legally waive the fees. Supt. of Schools
Lauderbach asked that the City Attorney and County Council work out a
solution to the matter, as he had already advised the School Board that
the fee would be waived°
It was moved by Councilman Smith, seconded by Councilman DeWolfe,
and carried, that the City Attorney be instructed to contact the County
Council and clarify the matter°
RESOLUTION No. 1896 - Accepting Deed of dedication for School District
-- for street purposes.
Offered by Councilman Rader, read in full, passed, adopted and approved
by the following vote, to-wit:

RESOLUTION No. 1897 -Granting easement to California Water & Telephone

City Administrator Wade was requested to check on the Deed to the
triangle at Vista Way and Hilltop Drive to determine how the owner
acquired the property, and the City Engineer was directed to check to
see if a tree could be saved in the re-alignment of Hilltop Drive.
~'~BID AWARDED ON MANKATO STREET WATER LINE
City Attorney M, Campbell reported that the license of Reid
Plumbing, low bidder on the Mankato Street water line, was found to be
in order, and that h~ could be awarded the bid. Purchaser-Analyst Ross
stated the low bid of Reid Plumbing was $559.46 more than the amount
budgeted for the project and recommended that an additional appropriation
be made.
It was moved by Councilman DeWolfe, seconded by Councilman Smith
and carried, that the low bid of Reid Plumbing be accepted, and $~59.46
be appropriated from unappropriated surplus of the General Fund to make
up the difference between the bid and budgeted amount. The motion
carried by the following vote, to-wit:

~0~UsING BUILDING TO BE RETAINED AND CONVERSION TO GAS AUTHORIZED
A letter was read from Housing Manager Stanley recommending that
building No. 34, slated fro demolition, be reopened to occupancy due to
an expected housing shortage in the area. Mr. Stanley also requested
that buildings 31 and 32 be converted from oil burners to gas, said cost
to be approximately $250.
It was moved by Councilman DeWolfe, seconded by Councilman Dillon,
and carried, that building No. 34 be retained as requested.
It was moved by Councilman DeWolfe, seconded by Councilman Dillon,
and carried, Shat buildings Nos. 31 and 32 be converted from oil to gas
burners, and that $250° be appropriated from unappropriated surplus of
the general fund to cover conversion costs. The motion carried by the
following vote, to-wit:

CQUISITION OF RIGHT-OF-WAY ACROSS DIETERLE PROPERTY DISCUSSED
A letter was read from AoO. Dteterle requesting that the City
prepare a plan for his study, showing the location, drainage channel
and other improvements planned in conjunction with the proposed Hilltop
extension, before he would deed to the City a right-of-way across his
property.
It was moved by Councilman Rader, seconded by Councilman Dillon,
and carried, ~hat the City Administrator be instructed to contact
Mr. Dieterle ~d give him an opportunity to take advantage of an agreement
that has been.~repared, within twenty-four hours. If Mr. Dieterle does
not agprove o~' ~he agreement, the City Administrator is authorized to
instruct the ~ity Attorney to begin condemnation proceedings under right-
of-~ment d~ain ~ the property in question, and to authorize the C~
Attorney to e~ploy a~ appr~er of his own choice to make an appraisal
of the land. Councilman Smith voted "no".
City Ach~imis~tor Wade was directed to contact Hobart Properties to
explain the-~fficulty the City was having in obtaining the right-of-way
and see if there could be an extension of time before they moved the
dirt the City has proposed to bVy, until we are in a position to legally
accept it.
.~E~UEST FOR SCHOOL CROSSING AT GARRETT AVENUE
A letter was read from Richard Smith requesting a school cross-
ing be established at Garrett Avenue and E. Street with a school-boy
patrol and "no right turn when light is red" signs posted at Fourth
Avenue and E. Streets. Mr. Smith spoke in support of his written
request.
It was moved by Councilman Smith, seconded by Councilman Dillon,
and carried, that the letter be referred to the Safety Council, and in
the event the Safety Council recommends a Junior patrol at Fourth Avenue
and E. Streets, the Chief of Police take immediate action to place one
there.
~NILLTOP VILLAGE FIRE STATION
Purchaser-Analyst Ross stated that the Public Housing Administration
have requested that the Council submit a letter of intention or desire
.to purchase for $8,500. the fire station property in the Hilltop Hous~g
Project.
It was moved by Councilman DeWolfe, seconded by Councilman Dillon,
and carried that City Administrator Wade be instructed to write the
letter as requested by the Housing Administration.
L/INTER-COM~C~NICATION SYSTEM FOR POLICE DEPT.
Purchaser-Analyst Ross reported that the low bidder on the inter-
communications system for the Police Dept. had withdrawn his bid due
to his being non-union. Mr. Ross recommended that the bid of the
Communications Company, the next lowest bidder for $660.04 be approved.
It was moved by Councilman DeWolfe, seconded by Councilman Smith
and carried, that the bid of the Communications Company be accepted,
and that an additional $177.29 be appropriated from the building fund
(1-18--dl) to cover the differenoe in co~t from the original low bidder.
The motion carried by the following vote, to-wit:

~I~ADAMS-PLOURDE PLAN
Mr. Ronald Landells, Harbor Commissioner, stated Mr. Wesley Mohr
was expecting a favorable answer momentarily from the Santa Fe Railway
pertaining to participation in his industrial development plan, and was
requesting that the Council authorize at this time, someone to sign the
agreement for the City.
It was moved by Councilman Smith, seconded by Councilman DeWolfe,
and carried, that the Mayor be authorized to sign the agreement, subject
to the Attorney*s approval, and contingent upon receipt of written
approval of Santa Fe Railway's participation in the agreement.
~FOINTMENT OF MEMBER TO HARBOR COMMISSION
It was moved by Councilman Smith, seconded by Councilman Rader,
and carried, that a vacancy be declared on the Harbor Commission by
removal of Mr. Orley E. Hitchcock, due to absence.
Councilman Dillon nominated Eugene Trook for membership on the
Harbor Commission. Councilman Rader nominated Milton Bull for membe~
ship on the Harbor Commission. There were no other nominations. A
ballot was taken with:four votes going to Eugene Trook and one to Milton
Bull. Mayor DeGraaf thereupon appointed Eugene Trook a member of the
Harbor Commission. It was moved by Councilman Smith, seconded by
Councilman Dillon, and carried, that appointment of Eugene Trook be
~pprovedo
/~IVIL SERVICE RECOMMENDATIONS - Swimming instructor
A letter was read from the Civil Service Commission recommending
that Section 12 of Rule 2 be amended to include the statement that
compensation for lifeguard be one salary step higher when assigned as
a swimming class instructor more than fifty percent of the working time.
It was moved by Councilman Rader, seconded by Councilman Dillon,
and carried, that action on the recommendation be held up until the
next Council meeting.
~//~IVIL .SERVICE RECOMMENDATIONS - Probationary period
A letter was read from the Civil Service Commission recommending
that Rule 5, Section 7 (f) of the Civil Service Rules be amended by
adding the sentence "No periods of absence shall be credited toward
the completion of the probationary period, provided, however, that
at the written request of the appointing authority the Civil Service
Commission may credit toward completion of a probationary period
not to exceed 15 calendar days of leave of absence during the proba-
tionary period.
It was moved by Councilman Smith, seconded'by Councilman Rader,
and carried, that Rule 5, Section 7 (f) be amended as recommended.
ORDINANCE No. 557 -Increasing speed limit on E. Street and portion
of Broadway - First reading
It was moved by Councilman Rader, seconded by Councilman Smith
and carried, that Ordinance No. 557 be placed on its first reading.
The motion carried by the following vote, to-wit:

RESOLUTION No, 1898 - Giving notice of proposed annexa~tion-
Naples Street School Site

f:'/~OI¥IC CENTER ROOF City Engineer Floyd reported
that
the
cost
'of constructing full gable roofs on the two wings to the Civic Center
and tying them into the present building would be $5,271.20. The
cost of erecting cupolas on each wing and false fronts connecting
to the present building would be $3197.
It was moved by Councilman Rader, seconded by Councilman I)eWolfe,
and carried, that the plan for full gable roo~s.: be accepted and that
$5,271.20 be appropriated from the building fund (1-18-dl) to cover
the cost. The motion carried by the following vote, to-wit:

~ORIAL PARK LIGHTING City Engineer Floyd reported that the
estimated cost of the proposed lighting for Memorial Park was
$1172.69 and presented a plan showing placement of the lights for
Council study.
It was moved by Councilman Rader, seconded by Councilman Dewolfe,
and carried, that the City Engineer be instructed to obtain bids
for~he park lighting.
~P~N TO BE SENT TO HARBOR COMMISSION
City Administrator Wade stated the Harbor Coemission had requested
a plan showing the pierhead and bulkhead lines, and suggested sendhg
them a copy of the Master Plan of Major Streets which shows most
clearly the pierhead and bulkhead lines. It was moved by Councilman
Smith, seconded by Councilman Dillon, and carried, that the plan
r~o~uaended by Mr. Wade be sent to the Harbor Comission.
~-~*~R'EQUEST FOR USE OF STREETS FOR PARADE PRACTICE
A letter was read from Chester DeVote,Principal of Chula Vista High
School requesting permission to use Fourth Ave. between K. and L. Sis.
during the week for parade practice, City Attorney M. Campbell ruled
the Council had no authority to give permission to block the streets
for private purposes. The Clerk was instructed to so notify Mr. DeVote.
~.~' AT F. STREET BALL PARK
Councilman Rader stated that in ma~y instances the lights at
the F. Street ball park were left burning all night, a~d sug~sted
a lock be put on the switch box and key kept at the Police Dept.
City Administrator Wade was directed to look into the matter.
BOAT HARBOR
Mr. Landells, Harbor Commissioner, stated the County Planning
Commission would like to know what plan the City has for a small
boat harbor. He was told to wait until the Mohr-Adams-Plourde plan
is completed.
