CITY OF CHULA VISTA, CALIFORNIA
Held Tuesday December 1, 1964
An adjourned regular meeting was held in the Council Chambers by the City
Council on the above date at 7:00 PoM. with the following Councilmen present~
Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson
Absent: None
Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer
Ross, Director of Planning Warren, Assistant Administrative Offi-
cer Stenberg
Mayor Sparling led the pledge of allegiance to the Flag and asked for a moment of
silent prayer.
~,~UBLIC HEARING - Loma Verde Park Annexation
This being the time and place, as advertised, for a public hearing on the
proposed Loma Verde Park Annexation, Mayor Sparling declared the hearing open.
No one wishing to be heard either for or against the annexation and the Clerk
having received no written protests, the Mayor declared the hearing closed.
ORDINANCE NO. 909 - Approving Loma Verde Park Annexation - First reading
It was moved by Councilman McAllister, seconded by Councilman McCorquodale,
and carried that Ordinance No. 909 be placed on its first reading and that read-
ing of the text be waived. The motion carried by the following vote, to-wit:
AYES: Councilmen McAllister, Sparling, McCorquodale, Anderson, McMains
Noes: None
Absent: None
~z~BLIC HEARING - Amendment to zoning ordinance providing for day nurseries
This being the time and place, as advertised, for a public hearing on a
proposed amendment to the zoning ordinance which would allow day nurseries in
R-3 and C-1 zones, Mayor Sparling declared the hearing open. Mr. Chris DeBoyer
spoke in opposition to day nurseries in R-3 zones and asked that they be restricted
to commercial.zones. There being no others wishing to be heard either for or
against the zoning amendment and the Clerk having received no written protests~
the Mayor declared the hearing closed.
ORDINANCE NO. 910 - Amending zoning ordinance - Day Nurseries - First reading
It was moved by Councilman McAllister, seconded by Councilman McCorquodale,
and carried that Ordinance No. 910 be placed on its first reading and that read-
ing of the text be waived. The motion carried by the following vote, to-wit:

~/'PUBLIC MEARING - Rezoning south side of "F" Street between Guava and Garrett
Avenues, south to Memorial Park - FromM-1 and C-2 to C-land R-3
This being the time and place, as advertised, for a public hearing on the
proposed rezoning from M-1 and C-2 to C-1 and R-3 property on the south side of
"F" Street from a point 310 feet west of Fourth Avenue to Garrett Avenue and the
area bounded by Fourth, Third, Center and Madrona Streets, Mayor Sparling declared
the hearing open°
Attorney G. L. Bendickson, representing H. H. Green and Sidney Morris,
spoke in opposition to the rezoning and requested that his clients' property be
left in a C-2 zone. Attorney Robert Caplan, representing owners of the Chula
Vista Center, protested the rezoning of his clients' property and asked that the
zoning remain as it is in order to facilitate proposed expansion. Mr. Robert
Miles protested the rezoning of his property and Mr. J. D. Peters, representing
Ruth Klindt, opposed the rezoning of the Klindt property.
A letter was read from the San Diego Gas & Electric Company requesting
that they be permitted to maintain a ten-foot setback on Fourth Avenue for a dis-
tance of 100 feet south of "F" Street in front of their property. The findings
of the Planning Commission were read to the Council°
No others wishing to be heard and the Clerk having no More written protests,
it was moved by Councilman McCorquodale, seconded by Councilman Anderson, and car-
ried that the hearing be closed.
After discussion, it was moved by Councilman McAllister, seconded by Coun-
cilman McCorquodale, and carried that the matter be referred back to the Planning
Commission to consider rezoning the entire area C-1.
ORDINANCE NO. 876 - Approving rezoning of portion of Bonita Cove Subdivision from
R-!-B-9 and R-l~-12 to R-1 and R-l-B-15 - Second reading
It was moved by Councilman McMains, seconded by Councilman McAllister, and
carried that Ordinance No. 876 be placed on its second reading, that reading of
the text be waived and the ordinance adopted. The motion carried by the following
vote, to-wit:

~z~%.SCUSSION ON TEEN-AGE DANCE ORDINANCE
Each Councilman having received for study a copy of the amended ordinance
regulating teen-age dances, Councilman Anderson suggested that Section 11.81 be
amended to includ~ the posting in a conspicuous place of one copy of the permit
to hold the dance as approved by the Chief of Police.
Councilman Anderson also questioned the phraseology of Section 11.62(d)
stating that the County requires that all private patrolmen be registered, finger-
printed and~ti~nr any criminal background. She asked that consideration be
given to this in the City's ordinance.
Councilman Anderson suggested that Section 11.69(c) be amended to include
"under the influence of drugs and narcotics".
Councilman McCorquodale suggested that the words "all dancin~ shall be of
an acceptable social standard" be deleted from Section 11.71.
It was moved by Councilman McMains, seconded by Councilman McCorquodale,
and carried that action be held over one week in order for the City Attorney to
incorporate any suggestions made into the proposed ordinance regulating teen-age
dances.
RESOLUTION NO. 3575 - Adopting official City Flower - Geranium
Offered by Councilman McCorquodale, passed and adopted by the following
vote, to-wit:
AYES: Councilmen McCorquodale, Anderson, McAllister
Noes: Councilmen McMains, Sparling
Absent: None
Mrs. Jane Lehr, representing the Chula Vista Star-News, reported that the
poll taken by the newspaper indicated that fifty-seven persons were in favor of
the geranium, thirty-six for the rose and eighteen for the Bird of Paradise as
the official City Flower with a scattering of votes for other flowers.
8:15 P.M. - Councilman McCorquodale was excused from the meeting at this time.
RESOLUTION NO. 3576 - Providing for "No Parking" - south side of "I" Street, west of Corte Maria
Offered by Councilman McMains, passed and adopted by the following vote,
to-wit:
AYES: Councilmen McMains, McAllister, Sparling, Anderson
Noes: None
Absent: Councilman McCorquodale
V'RESOLUTION - Approving Planning Commission action granting conditional use permit
to Truman Anderson, Inc. - Car Wash in C-2 zone
City Planning Director Warren reviewed the conditions under which the appli-
cation for a do-it-yourself car wash is being recormnended by the Planning Commis-
sion for approval. City Engineer Cole stated that should :he Council approve the
conditional use permit, he would suggest that it be on the condition they connect
to the sewer when it is available.

Discussion centered on the appearance of the building, it being on the
order of a quonset hut. Mr. Lyle Doer, with the E1 Cortez Realty C~npany of
San Diego, stated the building would not be obnoxious looking and submitted
pictures of the building proposed.
Councilman McAllister offered the resolution contingent upon the building
being built concurrently with the proposed installation of sewer south of "K"
Street. It failed to pass by the following vote, to-wit:

Absent: Councilman McCorquodale
Councilmen voting against the conditional use permit were of the opinion
the building would not be compatible to future development of the surrounding area.
RESOLUTION NO. 3577 - Approving Planning Commission action granting conditional
use permit to William Minkoff - Office building in R-3 zone
Offered by Councilman McAllister, passed and adopted by the following vote,
to-wit:

I~MUNICIPAL GOLF COURSE
Counc±lman HcMa±ns stated that the Fark and Recreation Corrtm±$sion hay±rig
made a study on munfcipal golf courses and it having been reported that the Bon±ta
Valley Golf Gourse is for sale, ±t might be w±se for the Council to g£ve some ±n-
dicat±on to the Admln±stratiYe Officer the Counc±l's feel±ng on the purchase or
development of a municipal golf course.
It was moved by Counc±lman Anderson, seconded by Councilman McMains, and
carried that it be left to the d±scret±on of the Administrative Officer to pursue
the idea of a mun±c±pal golf course for the City.
~RMISSION FOR PARADE AUTHORIZED
Upon request of the Junior Chamber of Cormnerce, it was moved by Council-
man McAllister, seconded by Councilman Anderson, and carried that they be granted
permission to hold a small parade on Saturday, December 5 at 2:00 P.Mo in connec-
tion with their Ounior Miss contest.
OURT ACTION AGAINST POLICE CHIEF
Administrative Officer Ross stated that the Chief of Police has been served
with a summons and complaint for slander in a civil action No. 288842 brought by
Attorney George B. Corn on behalf of James W. Morgan, owner of Party Boats, alleg-
ing that the Chief injured the plaintiff and his business because of statements
made before the Unified Port Commission. It was requested that the Council auth-
orize the City Attorney to represent Chief Quinn in this action.
It was moved by Councilman McMains, seconded by Councilman Anderson, and
carried that the Administrative Officer be authorized to proceed with this matter
for action.
Sj..~OPES FOR SCHOOL BAND IN ROSE PARADE
Mayor Sparling suggested and hopes that the public will consider holding
a competition among the bands in the Sweetwater Union High School District for
selection of one to participate in the Rose Parade on New Year~s Day 1966. He
urged that the Chamber of Corm~erce and other interested bodies push the idea.
N~TIONAL SCENIC ROADS AND PARKWAYS STUDY
A letter was read from the State Division of Highways inviting City partici-
pation in a study for National Scenic Roads and Parkways and asking for recormmen-
dations for any local roads or streets which might be of scenic interest. Referred
to Administrative Officer Ross.
~'CHRISTMAS CAtD FOR SISTER CITY
Mrs. Ruth Hyde stated that a Christmas Card has been prepared for sending
to Sister City General Roca and asked that all present sign a parchment paper to
be included with the card.
INFORMATION ON BOAT RAMP
As a matter of information Mr. Ronald Komendera informed the Council that
the South Bay Boating Club has signed a lease with the Port District for operation
of the boat ramp on the tidelands, and hopes that with the new boating season,
more improvements will be made in the area.
~'REQUEST FOR PARKWAY CARE
Mr. Roger Moore requested that the Council do something to make property
owners improve the parking strips in front of their properties. Also many side-
walks are covered with dirt and debris and need cleaning. Mayor Sparling asked
that the Administrative Officer check this out with the proper authorities and
also to see what can be done to enforce the ordinance requiring citizens to re-
move their trash cans from the parking strips except on trash collection day.
~/'REQUEST FOR CORRECTION OF DRAINAGE PROBLEM
Mrs. Helen Bastedo, 843 Riverlawn, stated that water from Broadway drains
across Riverlawn Avenue about 75 feet south of her place when it rains, leaving
mud and debris and making it impossible for pedestrians to pass when the water
is running. She asked that th~ matter be corrected. Administrative Officer
Ross was directed to have a study made to determine the best way of making the
correction.

~REQUEST FOR ELIMINATION OF TRAFFIC HAZARDS
Mrs. Helen Bastedo stated that since "L" Street has been widened near the
Freewa~ the center dividing line for east and westbound traffic has never been
changed which constitutes a traffic hazard. She asked that this be remedied.
Also that employees of the garment factory are using "L" Street in the vicinity
of Riverlawn as a parking area which causes a traffic hazard when driving out
onto "L" Street. Referred to Administrative Officer Ross.
