There being no protests either oral or written from property owners within the territory proposed to be annexed, or otherwise, the Mayor declared the public hear- ing closed. Mrs. Albert meyer, Mr. Stephen Petrovich, and Mr. Bullen appeared tn person to protest tho EranttnE of the zero hack. Mr. Melvin Morrell spoke in favor of the sero sot-hack. Zone Variance appeal A report vas read from the Planning Commission in answer to an appeal of their decision in denying · zone variance to the Svatko Bros. for a car vamh at the corner of Fourth Avenue and E. Street° Mayor DeOraaf set December 11, 1950 at 7:00 P.M. as the time for a public hear- ins on the appeal. ~///IMvBSTIGATION RF.UORT on Foster Eviction from HouSing A report vas read from Councilman Dillon on hie investigation of Manager Stanley, Manager o~ the Vista Square Housing Project. The investigation .had been ordered after Mr. Clarence Fo~ter, evicted from the project by Mr. Stanley, appealed to the Council. Councilman Rader was of the opinion the investigation had not been impartial as he had requested. It was moved ~y Councilman Dillon, seconded by Councilman hith, and carried, that the Council accept the investigation report and uphold the action of Mr. Stanley in evicting Mr. Foster. Councilman Rader voted no. mmpi.yes Association Petition for Salary Increase A petition was read from the Miscellaneous ihmployees Association requesting five percent increase in salary for 63 of its members; maid raise to be effective December 10 1950. Mr. Lewis Fry, President of the Association, elaborated on the request. The Council decided to hold the matter over until the November 27th meeting. RATIFICATIOn( OF'FINANCE COMMITT~BS'APPBOVAL OF BILL8 Councilman Dillon reported that he had gone over the Warrants, · nd recommended that they bm paid. Xt was moved by CounCilman Dillon, nwconded by Councilman Smith, and. carried, that Warrants Nos. 788 through 1045 be approved for payment. The motion carried by the following vote, to-wit: Ayes: Councilmen lieder, bath, De~raaf, Dillon, DeW, Ifs #oes~ None Absent: None Councilman Dillon was of the opinion the Council should consider dis- continuing the procedure of presenting the monthly list of warrants for Council approval inasmuch as they are all budgeted items. ~/RKQUKST FOIt ltETAINING WALL A letter was read from the First Christian Church requesting the City to erect · concrete retaining wall ·nd railing over · large culvert adjoining their property at 430 Second Avenue. It wan moved by Councilman Smith, seconded by Councilmen Dillon, and carried, that the City 2nginemr bm directed to make · survey and make recommendations. ' REQUEST FOR CEMENT FLOOR ON BALCONY AT SWIMMING P~OL A letter was read from the Park · Recreation Dept. requesting cement flooring on the balcony overlooking the swimming pool. The matter wis referred to the City Engineer for an estimate of the coat. RESOLUTION No. 1903 - Water Conservation program Offered' by Councilmen hath, read tn full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Red.r, Smith, DeGraaf, Dillon, DeW. Ifs Noes: None Absent: None ORAL COMMUNICATIONS - Discussion on Housing Eviction Mr. Clarence Foster, evicted tenant from Vista Housing, stated he did not feel the lnvontigation by Councilman Dillon regarding the Housing Manager was sufficient, and protested the action of the Council in support- ing the Manager on his notice of eviction. Among others objecting to the manner in which Mr. Stanley managed the housing and demanding that Mr. Foster be permitted to remain in the housing were Mr. and Mrs. William C. Percival, Mrs. James A. Berry, and Lieut. Schlapik. Mr. Foster was informed the Council was upholding the action of Mr. Stahley, and it would now be up to Mr. Stanley if the eviction was to be carried out. 2 City Attorney Mo Campbell stated s new thirty day eviction notice would have to be served on Nr. Foster. ~/~IVILIAN DEFENSE Nr. Edward B. Culnan, Director of Civil Defense, asked 'that each Councilman study the defense plans he had presented them, and stated he had appointed Chief-of-Police Roberts as Acting Assistant Director. ~rreiDS ON FIRE TRUCK City Purchaser-Analyst Ross stated he had ceived the following bids on a new fire truck: Crown Corp. ~34,980.00 Albro'Co. 33,249.30 ~eafravo Coo 24,935.68 Van Pelt Co. 33,661.04 Mr. Rose stated he had ruled out the Van Pelt bid because the Ctty form had not been used and suggested awarding of the bid be put off gntil the next meetinso in order that mere study could be given to the bids. It was mewed by Councilman Smith, seconded by Councilman Rader, and carried, that Mr. Grant be Eranted permission to make the investment as requested, ~///R~QUEST FOE ADDITIONAL LEGAL AID City Administrator Wade asked authority to hire additional legal aid for the Civil Dervice Coemkeaion and the Chief-of-police, and stated 8800. had been included In the budget for outside legal service. Attorney IdlEr B. Nervey~ in the audience, stated he was of the opinion the District Attorney's office might send a deputy to counsel the Civil Service Commission if the City Council so requested. Xt wis mewed by Councilman Smith, seconded by Councilman Dillon, and carried, that City Adminiltrltor Wade attempt to obtain the services of s deputy from the District Attorney's office to represent the Civil brvice Commission, but that if the services Ire not' obtained by Thursday the 15th, that he be authorized to hire an attorney to represent the Civil Service Commission. In either event, he i8 authorized to hire an attorney for the Chief of Police. Councilman Bader was of the opinion City Attorney M. Campbell should represent Chief Roberts, and voted "No" 8IDEWALK, CURB& GUTTIR REPORT Held over until the meeting of November 27th. ~//REPOET ON TRAFFIC COUNT AT NAPLSS AMDMO88 STRILITS A report was read from the Engineering Department on the results of traffic counts taken on Moss and Naples streets. After discussing the report it was moved by Councilman Dillon, seconded by Councilman DeWolfe, and carried, that Moss gtrset not be vacated as was proposed. RESOLUTION Ho. 1904 -Approving agreement with Hobart Properties for fill dirt. It was moved by Councilmen Rader, seconded by Councilmen DeWolfe and carried, that the recommendations of the Civil Service Commission be accepted. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, Smith, DeGraaf, Dillon, DeWolfe None: Hone Absent: None ~//~LARIFICATION OF PitOCKIMJRE - PlanninE Clerk A letter was read from the Personnel Clerk outlining procedure for establishing a tmmperary position of Senior Clerk tn the Planning Deportment. It wmm moved by Councilm DeWolfe, seconded by Councilman Rader, and carried, that the Council establish a position of Senior Clerk in the Planning bpmrtmont, for a temporary period, effective October 16th, until employment of a Director of Plming. DlSCUNSlON OH L, STRIrF OPENING City Engineer Floyd presented mope on the proposed L. Street opening and discussion followed on methods of realignment. No action taken. ~/'CAR WASHING AT VISTA ~UAR~ HOUSIMO Councilman Smith recommended that parking on tho lawns for any reason be prohibited at the houainN project, in order to eliminate confusion. Other Councilmen were afraid the streets would be ruined if tenante were forced to wanh cars in the street, City Administrator Wade was directed to look into the metier and nee if there is nome feanible place for tenants to wash their cars. ~/~NIGHT LIGHTS ON YOUTH CEN?~R Councilman ~ader etated he had otmerved that the flood lights on the West end of the Youth Center were not beia~ left on all night. ~t was ~oved by Councilm ~ader, leconded by Councilman ~lth and carried~ that City &d~inietrator Wade direct the bcreation Director to have a timer tnetalled for the lights on the West end of the Youth Center, and the lilhta left on from du~k to dawn. ~LOOD LIGHTS IN FI~ONT OF~II~flNGPOOL Councilman ~ader .was of the opinion that the flood lighte outside the entrance to the ewimain~ pool should be put in use as long as the City went to the expense of having them installed. City Ad~inietrator Wade wae directed to look into the matter to see if there was some ~ay the lights could be protected from vandaliem.
