MEETING OF THE CITY COUNCIL OF
THE CITY OF CHULA VISTA, CALIFORNIA
Held Tuesday April 2, 1957
The Council met in the Council Chamber at City Hall on the
above date at 7:00 P.M. with the following Councilmen present:
Councilmen Radar, ,~ith, DeGraaf, Dillon, DeUolfe
Absent: None
Also present: City Ach~tntstrator Wade~ City Attorney Mo Campbell,
City Engineer Floyd, Purchaser-Analyst Ross, City

Mayor DeGraaf led the salute to the Flag,
PUBLIC HEARING - Whittington No, 1 Annexation
This being the time and place, as advertised, having been held
over from the March 26th meeting due to lack of a quorum~ Mayor beGraaf
declared the public hearing open on the above mentioned annexation and
called for protests from the audience. There being no protests either
oral or written from property owners within the territory proposed to be
annexed, or otherwise, the Rayor declared the public hearing closed.
ORDINANCE No. 562- Approving Whittington No. Annexation-First reading
It was moved by Councilman l)eWolfe, seconded by Councilman
S~ith, and carried, that Ordinance No. 562 be placed on its first reading.
The motion carried by the following votes to-wit:
AYES: Councilmen DeWolfe, Radar, S~ith, DeGraaf, Dillon
Noes: None
Absent: None
The Ordinance was thereupon read in full.

declared the public hearing open on the above mentioned annexation and
called for protests from the audience. There being no protests either
oral or written from property owners within the territory proposed to be
annexed~ or otherwise, the Rayor declared the public hearing closed.
ORDINANCE No. 563- Approving Telegraph Knolls Annexation~- First Reading
It was moved by Councilman Smith, seconded by Councilman DeWolfe
and carried, that Ordinance No. 563 be placed on its first reading.
The motion carried by the following votes to-wit:
AYES: Councilmen ~aith, DeGraaf, Dillon, DeWolfe, Radar
Noes: None
Absent: None
The Ordinance was thereupon read in full.

This being the time and place, as advertised, having been held
over from the Rarch 26th meeting due to lack of a quorum, Mayor DeGraaf
declared the public hearing open on the above mentioned annexation and
called for protests from the audience. There being no protests either
oral or written from property owners within the territory proposed to be
annexed, or otherwise, the Mayor declared the public hearing closed.
ORDINANCE No. 564- Approving Pardee-Phlllips Annexation- First reading
It was moved by Councilman Radar, seconded by Councilman Dillon
and carried, that Ordinance No. 564 be placed on its first reading.
The motion carried by the following votes to-wit:
AYES: Councilmen Radar. Smith, D~Graaf, Dillon, DeWolfe

~PUBLIC HEARING - Industrial Lands Annexation No. 1
This being the time and place, as advertised, having been held
over from the March 26th meeting due to lack of a quorum, Mayor DeGraaf
declared the public hearing open on the above mentioned annexation and
called for protests from the audience. There were no oral protests.
The Clerk reported there was a 71.6% written protest b~sed upon the land
valuation. Mayor DeGraaf declared the hearing closed.
It was moved by Councilman Smith, seconded by Councilman Dillon,
and carried, that due to there having been filed with the City Clerk in
writing prior to the time of public hearing, objections to the Industrial
Lands No. 1 Annexation of over 71% of the assessed valuation according to
the last equalized assessment rolls, proceedings be dropped.
ORDINAJiCE No. 560 - Approving Jo Street Annexation- Second reading
It was moved by Councilman Rader, seconded by Councilman Smith,
and carried, that Ordinance No. 560 be placed on its second reading; that
the reading of the text be waived and the Ordinance adopted.The motion
carried by the following vote, to-wit:
AYES: Councilman Rader, Smith, DeGraaf, Dillon, DeWolfe

~PDBLIC HEAMING - Resoning of portion of "E~ Street
This being the time and place a~ advertised, having been held
over from the March 26th meeting due to lack of a quorum, Mayor DeGraaf
declared the public hearing open on the res.ninE of the North sidd of
"E" Street from Third Avenue to Del Mar Avenue. The Clerk read a letter
from James Connolly protesting the res.ninE on the grounds that the
Planning Commission would not rezone 'E' Street from Fourth Avenue to
Broadway for cogmercial use. Mr. Connolly was directed, if he so desired,
to appeal to the Council within twenty days upon the action taken by the
Planning Com-insion on his petition for res.ninE "g" Street between Fourth
Avenue and.Broadway. Mr. Richard Wilson, upon requesting that his
property at 249 'Bo Street be included in the res*ninE for which the hearing
was being held, was told he would have to submit his own application.
There were no other written or oral communications. Mayor DeGraaf
declared the hearing closed.
It was moved by Councilman Smith, seconded by Councilman Dillon,
and carried, that the res.ninE of the North side of "~' Street between
Third Avenue and Del Mar Avenue to a C-1 zone be approved, and the City
Attorney directed to prepare the necessary ordinance along with other
res*ninEs now in the offing. The motion carried by the following vote,
to-wit:

~I~UILDING D~PARTM~IT TRANSFER OF FUNDS AUTHORIZED
A request was made by the building inspector to transfer $400.
from account b-2.10 to D-1 for the purpose of purchasing office fu~niture.
It was moved by Councilman Dillon, seconded by Councilman Smith, and
carried, that transfer of the $400. be authorized as requested.The
motion carried by the following vote, to-wit;

~//DIVISION OF STREETS TRANSFER OF FUNDS AUTHORIZED
A request was made by H. C. Ballard, Associate Civil Engineer,
Division of Streets, that $1290. be transferred from account 13.92 C-ii
to 13.92 D-1 for the purpose of purchasing a ten gallon pressure tank,
compressor and paint shaker. It was moved by Councilman Mader, seconded
by Councilman Smith, and carried, that the purchase be authorized and
$1290o be transferred as requested. The motion carried by the following
vote, to-mit:

~/~RANSFEROF FUNDS IN CIVIL SERVICE ACCOUNT ATHORIZED
A request was made by the Personnel Clerk for authorization
to transfer $50. from account 1-16 B1.4 to account 1-16 D1 to augment
that sccount in order that a bookcase might be purchased.
It was moved by Councilman Dillon, seconded by Councilman DeWolfe, and
carried, that the puuchase be suthortzed and the ~50. be transferred as
requested. The motion carried by the following vote, to-wit:

~/4CEIMBUR3EHENT OF OVERCHARGE AUTHORIZED
A letter was read from Fo S. Fulwiler, Director of Recreation,
requesting that funds in the amount of $1015o be reappropriated to account
12-81 C.2, this figure representing the deposit charge on chlorine
cylinders not credited to this account upon their return to the Chemical
Company. It was moved by Councilman Smith, seconded by Councilman Dillon,
and carried, that the request be granted.
~/,'PURCHASK OF PARKING EETERS REQUESTED
City Finance Officer Grant requested that parking meters be
purchased for the new parking lot. The matter was held over until the
next meeting.
~PPOINTMgNT OF DISASTER COUNCIL
A letter was read from E. Bo Culntno Defense Director, listing
names of citizens he was recommending be appointed to the Civil Defense
and Disaster Council. It was moved by Councilman Dillon, seconded by
Counctlmn Smith, and carried, that those persons whose names appear on
the list now on file in the office of the City Clerkp be appointed to
serve on the Civil Defense and Disaster Council,

City ~ngineer Floyd presented plans showing changes proposed
in remodeling the Hilltop Fire Station. It was moved by Councilman DeWolfe
seconded by Councilman Dillon, and carried, that the City Administrator be
authorized to advertise for bids on the remodeling project.
RESOLUTION No. 1934 - Approving tentative map of Telegraph Knolls Subdivision°
Offered by Councilman Rader, read in full, passedp adopted and

RESOLUTION No. 1935- Approving tentative mp of Pardee-Phillips Subdivision

']LESOLUTION Deed from School District for street purposes
Accepting
It was suggested this Deed be held up until the next meeting in
order for the City Administrator to ascertain to what extent the School
intends to participate with owners on the South side of the 8trees in
installation of the water main, drainage and other improvements and to ask
for the dedication of a one foot strip on the North side of the center
line of the proposed street.

POINTMENTOF MEMBER TO SAFETY COUNCIL
~ayor DeGraaf submitted the name of Colonel O. Ao Axelson
and Councilman Rader submitted the name of Hal Johnson for appointment
on the Safety Council to fill the vacancy created by the resignation of
Kyle Stewart. No other na~es were submitted. A ballot was taken with
the majority of votes heine cast for Colonel O. A. Axelson. Mayor
DeGraaf thereupon appointed Col. Axelson to fill the eacancy on the Safety
Council, ~
RESOLUTION No. 1936 - Adoption of minimum waEe scale (Fire Depto)
Offered by Councilman Smith, read in full, passed, adopted and
approved by the following vote, to-wit:

~//RETIR~NT ACTUARIAL SURVEY AUTHORIZED
A letter was read from the Polioe and Fire Departments request-
ing that an actuarial survey with the State Retirement Systen be made for
the ~urpose of amending the contract to include provisions of Section
21264of the State Retirement Law. It was moved by Councilman S~lth,
seconded by Councilman Dillon, and carrieds that the actuarial survey be
made, the funds to be appropriated for its cost upon presentation of bill.
ORDINANCE No. 561- Providing for Boulevard stops, time limit parking
and installation of parking meters - second reading
It was ~oved by Councilman Rader, seconded by Councilman Smith
and carrieds that Ordinance No. 561 be placed on its second reading;
that the reading of th~,.text be waived and the ordinance adopted. The
motion carried by the following vote, to-wit:

RESOLUTION No. 1937 - Urging defeat of Senate Bill No. 2521

A letter was read from the Civil Service Co--lsslon requesting
that Rule 4~ Section 9 (a) and sub-section (g) pertaining to eligibility
lists be a~ended. It was ~oved by Councilman lhaith, seconded by Councilman
Dillon, and carried, that Rule 4, Section 9 of the Civil Rervice Rules be
amended as recommended in said letter on file in the City Clerk*s office.
..~IAGONAL PARKING AUTHORIZED AT LUTHERA~ CIIURCII
A letter was read from the Safety Council recommending that
the Lutheran Church at Fifth and E. Streets be permitted to install combina-
tion sidewalk, curb and ~utter on Fifth Avenue adjacent to their property
and be allowed to use the parking strip for diagonal parkinRo It was
~oved by Councilman Smith, seconded by Councils~ua Rader, and carried, that
the request be granted subject to a reflector being installed and
sOnStruction of a swail.
AFETY C~UNCIL RECO~ENDATIONS
The Sefety Council reconended that the Boulevard stop sign on
the ramp from Montgomery Freeway at H. Street (for south bound traffic)
· e retained. The City Engineer was directed to re-install the sign.
The Safety Council ~aked to be brought up to date on the
proposed traffic lights at Fourth Avenue and Fo Street. City Engineer
Floyd was directed to inform the Safety Council that the traffic lights
had been placed No. 3 in priority for gas tax projects.
The Safety Council recommended that Joseph Carpenito be appointed
to serve with William Cannon on the San Diego County Traffic Safety Council.
It was moved by Councilman Reder, seconded by Councilmmn Dillon, and carried
that Joseph Carpenito be appointed as recomended.

~STREET CONSTRUCTION LEAD MAN AUTHORIZED
City Engineer Floyd presented an organizational chart for the
Department of Public Works, Division of Streets, ss requested by the
Council, in order to deter~ine the need for creation of the position of
Street Construction Lead Man as recommended by the Civil Service Commission.
It was moved by Councilman DeWolfe, seconded by Councilman Dlllon~ and
carried, that Section 12 of Rule 2 of ~e Civil Service Rules be a~ended
by adding Class No. H-IO~ Street Con~ction Lead Man with a salary at
range 20 for a 40 hour week~ to the Classification and Compensation Plan.
~DIRsCTIONAL SIGNS - St. Mark's Lutheran Church
A letter was read fro~ the Planning Co~ission reco~ending that
the request of the Lutheran Church to erect directional signs on public
property be denied. City Ach~inistrstor Wade was directed to contact the
Ministerial Association for a study on the matter of Church directional
signs.
NEW NOI~q~OUTH STRF~T ACROSS SWKE~fATF~ VA~I,KY
A letter was read from the Planning Commission recommending
that the Council toke no action on the proposed new street across the
valley between Fifth Avenue in Chula Vlsta and Do Avenue In Nstional City
as a traffic count, in the opinion of the ~lannersf shoved the expense was
not warranted at this.~i~e. It was moved by Councilman Dillon, seconded
by Councilman DeWolfe~ and carried, that the recommendations of the
Planning Conission be accepted.

I letter was read from the Library Board statin~ they had
received a gift of $1OO. and asking the Council if they should r~turn the
check, or keep it with the understanding the Library Board would control
and ad~inister it. It was ~oved by Councilman DeWolfe, seconded by
Councilman S~ith, and carried, that a letter be written to the Board
infolming them they have a right to disposition of the honey with the
exception of using it for any building alterations.

A letter was read from Ao A. Acksrmann requesting that the
h UnCil adopt an ordinance requiring that private swimming pools be fenced°
e letter was referred to the Sefety Council for recommendation.
AMBER OF COMMRRC~ ilE~UEST FOR ADDITIC~AL FUNDS
A letter was received from the Chamber of Commerce requesting
that their contract with the City be revim~d to provide payments of
$800. instead of the present $500. per mofiSh to the Chamber. The
request was held in abeysnce until the budget sessions,

SOUTH BAY CHAMBER OF CO~ERCE LETTER
A letter was read from the South Bay District Chamber of
Commerce a~king that their area be given their own choice as to annexation
~estres. No action taken.
~//CHA~BEM REQUEST FOg Chriatmas Decoration Fund
A letter was read from the Chamber of Comerce requesting that
some action be taken on their former request that the Council give considera-
tion to a method of collection of a Christmas Decoration fund through
business licensem. The Clerk was inetructed to place the matter on the
~enda for the ne~t ~eeting.
t/ SPEED LIMIT ON ~' Street
A letter was read from J. Ho Mack~ County Road Commissioner
requesting that the present 35 mile per hour ep~ed zone illegally posted
on "~' Street between Highland and Broadway be corrected. It was moved
by Councilman ~ith, seconded by Councilman Delolfe, and carried, that
no action be taken. Councilman Rader voted "no".
A letter wU ~ad from Harry Le Mire requesting that the
existing **K' Street Sign in front of him home at X00 Country Club D~ive
be changed to one reading 'Country Club Drive'** The Council directed
that a letter be written to Mr. L~ Mire informing him that anything rest
of First Avenue Zs to be considered **K' Street,

A notice of public hearing before the Public Utilities Commission
regarding an application of the ~an Diego Transit System to consolidate
its passenger stage operative rights was read. It was filed.
